The following proceedings were bad: Minutes of the last regular session were read and it was moved by Commis- sioner Morrow, seconded by Mayor Staudaher, that the minutes be approved a8 reaa and the motion was carried by the follow1ng Aye and No veto: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those vo ting No, none. Public Hearing -- Speoial Improvement District No. .24 This was the time and place set by Commission Resolution No. 1U39 to hear protests to the creation of Special Improvement Distriot No. 424. Affidavit of publication of Notioe and the Clerk's Mailing Certificate stating that all pre- perty owners had been notified as required by law were presented. Protests bear- ing the signatures af 31.68% of the property owners within the boundaries of the proposed dtstrict were presented. Following a thorough discussion of the proposed district with the grQup of interested citizens attending the meeting, the City Manager recommended that I the protests filed be declared insuffic'ient and the Ci ty Attorney instructed t. prepare a resolution to create the district. Commission Resolution No. lu41, entitled: COMMISSION RESOLUTION NO. 10.1 - . A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 42. Affidavit of publication of Notice waa pre'sent'" and it wa. moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the bids I tiled with the Clerk be opened and read and the motion was carried by the follow- ing Aye and No vote: those voting Aye being Kayer Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. The foliowing bids were opened and read: Nalle Aaeunt - W. D. Howells Construction Co. $2,269.50 Howard. Gower .1,924.80 The bids were referred to the City Engineer to prepare an accurate tabu- latien of the bids and to determine the lewest and best bid in the interest of the City. Resolution No. 1042 -- Extension"of-Boundaries of City of Bozeman (Thompson - Weaver Addition) During the regular session of the City Commission held on May 31, 1962, the Commission regularly passed and adopted Commission Resolution No. lU40, declar- ing its intention to extend the beundarles of the City limits to include a cen- t1gueu8 tract of land to the south of the present City limits. The affidavit of publication of the Notice was presented. ~nere were no protests filed and no I one appeared to protest the action. Commission Resolution No. 1042 prepared by the City Attorney to accomplish the extension ot the City ~imits and complete the action was presented entit~ed: COMMISSION RESOLUTION NO. 1042 - A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN EXTENDING THE .- BOUNDARIES OF THE SAID CITY OF BOZEMAN SO AS TO EMBRACE AND INCLUDE A CERTAIN TRACT OF LAND CONTIGUOUS TO THE SAID CITY OF BOZEMAN AND HEREIN MORE PART,tICULARLY DESCRIBED WITHIN THE CORPORATE LIMITS THEREOF. It was moved by Cemmlss10ner Sedivy, seconded by CommiSSioner Morrow, that the resolution be passed and adopted and the motion was carried by the following Aye and No vote: these veting Aye being Mayor Staudaher, Commissioner Sedivy and Cemmiesioner Morrow; those voting No, none. Confirmation of Leland J. Lewis (Fire Department) c A communication from Fire Chief Penttila was read recommending confirmation of Leland J. Lewis as a regular member ot the Fire Department as of July 1, 1962, he having satiefactorily completed the required slx-aontb probationary serv1ce. I The City Manager concurred in the recommendation of the Fire Chief and it was aoved by Commissioner Morrow, seconded by Co~ssioner Sedivy, that Leland J. Lewis be confirmed as a regular member of the Fire Department as recommended. The motion was carried by the following Aye and No vote: those voting Aye be- ing Mayor Staudaher, Commissioner Morrow and CoDlD11ssioner sedivy; those voting No, none. 100 Purchase of Water Meters The City Manager reported the Water Department has need for an additional supply of water meters and requested authorization to plaoe an order for 35, 3/4" meters at a total approximate oost Gf $980.00. It was moved by Commis- sioner Sedivy, seconded by Commissioner Morrow, that the purchase be authorized I and the motion was carried by the tollowmg Aye and. S.I.D., No. ~22 -- Acoeptance of Contraot and Final Payment to Contractor The certificate of the engineer on apecial Improvement Distriot No. 422, Harold Hoskins & Associates, stating that oonstruction of the water and sewer lines in the district had been oompleted in accordance with the terms and speci- fioations of the contract by the contraotor, Gardner Construotion Co., and reoe- mmending that the City accept and approve the project as oompleted-was place. before the C.mmission. The City Manager and the City Engineer ooncurred in the reoommendation of the consultant engineer, and the City Manager informed the Commission that a determination bad been made that all valid claims against the contractor resulting from ~e construction have been paid and all recorda of the project oompleted. The City Manager p1aced before the Commission a claim in the amount of $929.43 which represented final payment to the contractor. It waa moved by CODmissioner Morrow. seconded by Commissioner Sedivy, the t, in concurrence I with the foregoing recommendations. the contract work on Special Improvement Distriot No. 422 be approved and aocepted aa completed and the Direotor of Fin- ance be authorized to issue a warrant in the amount ot $929.43 for final payment to Gardner Construction Co. on ~ the contraot. Award of Contract (W &: C, 1962) The City Engineer having oompleted his tabulation of the bids submitted tor W &: 0, 1962 construction stated that the bid of Howard Gower in the amount of $1,924.80 was the lowest bid submitted and recommended that in the interests of the City of Bozeman he be awared the contract. The City Manager ooncurred in the recommendation and it was moved by Commissioner SediVY, seconded by Commissioner Morrow, that the contract be awarded to Howard Gower 1n the amount of $1.924.80 as recommended and the bid security of the unsuocessful beidder be returned. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Co.missioner Sedivy and Commissioner Morrow; those voting I No, none. Petition for Sanitary Sewer Trunk Line (Intersection of Main Street and -- Rouse Avenue to North Boundary of Westridge Add.) A petition bearing the signatures of McKinley T. Anderson, Jr., Thompson Hereford Ranohes, Inc. by Robert L. ~hompson, Neal F. and Donald K. Weaver, pro- perty owners in the area, requesting that the City create a Special Improvement . 101 District to construct a sewer trunk line trom the intersection of Main Street and Rouse Avenue to the North boundary of the Weatrldge Addition in the City ot Bozeman was placed before the Commission. The Oi ty Manager recommended that the City Engineer be instructed to ascertain district boundaries for maximum parti- I cipation in the project, the City Attorney be directed to prepare a resolution ot intention to area te the distric t, and proper applica tion be filed with the Water Pollution Control Agency to request federal participation in the project. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, tha t the above action as recommended by the City Manager be approved and initiated. Meeting Reconvened The regular meeting ot June 27th, having been adjourned until this date, that meeting was resumed in the Commission Room, City Hall Building, Tuesday, I July 3rd, 1962 at l:UO o'clock p.m. Present were Mayor Staudaher, Commissioner Sedivy, Commissioner Morrow, Oity Manager Cutting, City Attorney Berg and the Clerk. The following proceedings were had: Licenee Fee -- Carnival Sponsored by Lions' Club R. R. Hardgrove and H. C. Campbell ot the local Lions' club appeared to inquire as t. the license fee that would be charged the club in connection with its sponsoring the Inland' Bmp1r. Carnival while showing at the Fair grounds dur- ing July 26th to July 29th, inclusive. It was moved by Commissioner Sedivy, sec- onded by Commissioner Morrow, that, in view of the tact that net proceeds of the show will be used for charitable purposes, the lioense fee be set at 50% of the regular tee and that, upon submission of an application in proper form together with the required tee herein set, a license for the four-day showing be granted carr! ed and the motion waslby the fellowing Aye and Ne vote: those voting Aye being Mayor Staudaher, Cemmissioner Sedivy and Cemmissioner Morrow; those voting I No, none. Petition for Street Light -- Story Street & South 15th Ave. The City Manager presented a petition signed by residents in the immediate vicinity of the intersection of Story Street and Seuth 15th Avenue, Which requeste4 that the City install a street light at the intersection. He recom- .ended that he be authorized to notify the Montana Power Company to install a ',000 lumen type light as requested. Engineering for S.I.D., No. 424 Based upon an agreement for a "Contract for Engineering Servioes" entered into between the Oi ty and Harold Hoskins & Assooiates. engineers. on July 10th, I 1957. it was recommended that Harold Hoskins & Associates be direoted to pro- ceed with the engineering services required for the preparation of plans and speoifications for the oonstruction of the proposed improvements in Special Improvement District No. 424. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow. that. under the aforementioned agreement, Harold Hoskins & Assooiates be directed to furnish the engineering servies for this improvement district and the motion was carried by the fOllowing Aye and No vote: those v.ting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; these voting No. none. Engineering for Construction of East Side Sanitary Sewer Trunk Line -- (Harold Hoskins & Assooiates) Based upon an agreement for a "Contraot tor Engineering Servioes. entere. into between the City and Harold Heskins & Assooiates. engineers. on August 9th, 1961, it was reoommended by the City Manager that, subjeot to the approval of the Water Pollution Control Agency, the firm be authorized and directed t. pro- ceed with the engineering services required for the preparation of plans and I specifioations for the cCtnstruotion of the proposed project knQWD as the "East Side Sanitary Sewer Trunk Line". Resolution No. 1043 -- Authorizing "Open-Space" for Federal Grant on Purchase of Elks Country Club Property During the regular meeting of the City Commission of April 11, 1962, the City Manager was authorized and directed to initiate the proper procedure for the purchase of the property sometimes lmown as the "Old Ceuntry Club" new oweil by the Bozeman Elk's lAdge. The City Manager placed before the Commission a proposed resolution pre- pared by the City Attorney for the purpose of granting permission and authorizing the filing of an application for a Federal Grant to assist the City in acquiring for future cemetery purposes the aforementioned property, entitled: I RESOLUTION NO. 104:3 - A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AUTHORIZING THE FILING OF APPLICATION FOR A FEDERAL GRANT TO ACQUIRE OPEN SPACE LAND. Report -- Firemen's Association Meeting Ass't. Fire Chief Huber reported on his and Lt. Herbert Hoey'. attendanoe at the Firemen's Association meeting oonducted at Havre, June 28th thru the 30th. I His report consisted of a resume of the program, its attendance and the values 4erived by the City in having representatives at such meetings.
