'!he Commission of the City of Bozeman met in regular session in the
Commission Room, City Hall Building, Wednesday, July 11, 1962, at 1:00 o'clock

p.m. Present were Mayor Staudaher, Commissioner Sedivy, Commissioner Morrow, ,"
City Manager Cutting, City Attorney Berg and the Clerk.
The fOllowing proceedings were had:
It was moved by Commissioner Sedivy, seconded by Commissioner Morrow,
that the reading of the minutes of the regular meetings of the Commission
held June 27th and July 5th, and the specia~ _eating held July 6th, be deferred
until the next regular session of the Commission. The motion was carried by
the following Aye and No vote: those voting Aye baing Mayor Staudaher, Commis-
sioner Sedivy and Commissioner Morrow; those voting No, none.
Authority to Buy Bonds -- $5,000 -- Water Bonds
It was reported that Stanton Aby, Vice t'resident of Kalman & Co.,
Minneapolis, Minnesota, had advised the Director of Finance that his company
has $5,000 of the City's Water Revenue Bonds which are due July 1, 19BO, and
could be purchased by the City at a $6.50 premium plus accrued interest. The
Director of Finance has ample funds in the bond redemption fund and requested I
authority to oomplete the transacation at a saving to the City of approximately
3.3% interest charges. The City Manager recommended that the Director of Fin-
ance be given authority to complete the purchase of the bonds and it was moved
by Commissioner Morrow, seconded by Commissioner Sedivy, that the Director of
Finance be authorized to purchase the bonds specified above and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor
Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none.
Reinves tmen t -- Wa ter Funes ($100,000)
The Director of Finance reported that $100,000 of Water Fund invest-
ments are maturing and requested authority to reinvest the funds as follOWS:

The City Manager recommended that the reinvestments be approved and it
was moved by commissioner Sedivy, seconded by Commissioner Morrow, that the I

Sedivy and Commissioner Morrow; those voting No, none.
Federal Grant -- East Side Sanitary Sewer Trunk Line
During the Commission meeting of June 13, 1962, authority was granted
by the Commission to the City Manager to apply for a grant of Federal. funds
in the amount of $24,076.31 to assist in the construction of the City's pro-
posed project !mown as the "East Side Sanitary Sewer Trunk Line", and, in turn,

the Mayor was designated the legal representative to sign the applioation and
other documents pertaining thereto. Proposed Commission Resolution No. 10434,
prepared to accept the offer of the Federal grant was presented, entitled:

BY THE UNITED STATES OF AMERICA, PUBLIC HEALTH SERVICE, TO
PARTICIPATE IN THE AMOUNT OF 124,076.31 IN THE CONSTRUCTION
OF AN OUTFALL SEWER TO SERVE HILLCREST RETIREMENT HOMES AND
ADJACENT RESIDENTIAL AREAS, AND FURTHER AUTHORIZING THE
MAYOR OF THE CITY OF BOZEMAN, MONTANA, TO MAKE THE ASSUR-
ANCES REQUIRED BY THE SURGEON GENEHAL OF THE PUBLIC HEALTH
SERVICE AS A CONDITION TO SAID FEDERAL GRANT
The City Manager reoommended that the Commission approve and adopt the
resolu tion. It was moved by Commissioner Morrow, seoonded by Commissioner
Sedi vY, that the resolution be passed and adopted and the motion was oarried
by the fallowing Aye and No vote: those voting Aye being Mayor Staudaher,
Commissioner Morrow and Commissioner Sedivy; those voting No, none.
Resolution for Purchase of Road Oil
A resolution authorizing the City Manager to purchase not to exceed
25,000 gallons of road oil during the fisoal year July 1, 1962 to June 30,
1963, for use by the Street Department in repairing pavement and for sealing
cartaln seotions of existing pavement within the City from the Montana State
I Highway Department was presented as tollows:

WHEREAS the City of Bozeman will have need during the
fiscal year, July 1, 1962 - June 30, 1963, for road oils for
use in repairing streets and for sealing certain sections of
existing pavements within the City, and
WHEREAS the City of Bozeman does not have proper facili-
ties for handling and storing the needed quantities of oils,
and
WHEREAS The Montana State Highway Department does have
quantities of the required types of oils stored in Bozeman
from whioh it oan supply the quantities needed for the City
of Bozeman,
NOW, THEREFORE, BE IT RESOLVED:
That an emergency does exist reLative to the pro-
ourement of road 011S by the City of Bozeman and the City
Manager is hereby authorized to purchase s tooks in storage
in Bozeman, approximately twenty-five thousand (25,UVO)
gallons of road oil, this to be purchased from time to time
during the fiscal year, July 1, L962 - June 3u, 1963, as
needed by the City of Bozeman for repair and sealing of
existing pavements, and these quantities of road 011s to
be purchased at cost plus normal handling charges.

City Manager to Attend Municipal League Committee Meeting - 7/27/62, (Helena) I
It was reported a meeting of the Special Committee of the Montana
Municipal League appointed for the purpose to study possibilities of pre-
paring amendments to present laws governing maximum levies for the various
departments of municipaLities is SCheduled to be held Friday, July 27th, in
Helena. The City Manager as a member of the Committee requested that he be
authorized to attend the meeting. It was moved by Commissioner Morrow,
seconded by Commissioner Sedivy, that the request to attend the meeting be
approved and, that it being in the public interest, the expenses incurred
be charged to the General fund of the City. The motion was carried by the
fOllowing Aye and No vote: those voting Aye being Mayor Staudaher, Commis-
sioner Morrow and Commissioner Sedivy; those voting No, none.
Request -- Sidewalk Bazaar, Friday, July 20th
It was reported the Bozeman Chamber of Commerce has requested permission
for the Chamber to sponsor a sidewalk bazaar, July 2uth, on Main Street, and
the City Manager recommended that the request be granted. It was moved by
Commissioner Sedivy, seoonded by Commissioner Morrow, the request be granted, I
but that Mr. Sperry, Manager of the Chamber of Commeroe, be notified that the
Chamber should oaution al~ merohants that sidewa~k displays be limited to one
day, the 20th of July. The motion was oarried by the following Aye and No
vo te: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commis-
sioner Morrow; those voting No, none.
Bond & Contraot ... Howard H. Gower (W & C - 1962)
Performance bond and contraot documents for the contract of Howard H. Gower
awarded on June 27th, for the construction of miscailaneous walks and curbs
within the City of Bozeman for the year 1962, were presented. The bond and con.
tract were approved as to form by the City Attorney, and the City Manager reported
that the City has evidenoe the oontractor is adequately insured and recommended
that the Mayor and the Clerk be authorized to sign the oontract for tbe City.
It was moved by Commissioner &orrow, seconded by Commissioner Sedivy, tha t :the
Mayor and the Clerk be authorized to sign the oontraot for the City and the
motion was carried by the following Aye and No vote: those v oting Aye being
Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, I
none.
(Operate Street Ice Cream Vending Machine)
Request -- Lynn Eilefson
The request tiled by Lynn Eilefson to be granted a license to operate a
street ice cream vending machine in the residential areas of the City was pre-
sented. The City Manager reoommended that the request be granted and it was
moved by Commissioner Sedivy,seoonded by Commissioner Morrow, that the request

be granted subject to review in thirty days. The motion was carried by the
fOlLowing Aye and No vote: those voting Aye being Mayor Staudaher, Commis-
sioner Sedivy and Commissioner Morrow; those voting No, none.
City Library Board
Mrs. T. G. Haggerty, Mrs. Henry Campbell and Edwin Howard, Jr. of the
I Bozeman ~ity Library Board appeared to express the appreciation of the Board
for the splendid cooperation it receives from City offioiaLs and to commend
the servioes of Miss Margaret Hileman, the librarian, and her staff. The City
Manager commented on the proposed budget for the current fiscal year now in
prepare tion.
Request -- Jayceens to Operate "Chuck Wagon" - Jul,. 19-21
The written request of the local Jayceens ~o operate a "Cnuck Wagon" to
be parked on Main Street during July 19th thru the 21st, was placed before the
Commission. The City Manager recommended that the request be partially granted,
tha tis, the operation be limited to one day, July 20th, and that the unit be
parked at a site other than on Main Street. It was moved by Commissioner
Morrow, seconded by Commissioner Sedivy, that the Jayceens be notified that
its request so far as recommended by the Ci ty Manager had been approved by
the Commission. The motion was carried by the following Aye and No vote:
those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner
Sedivy; those voting No, none.

Morrow and Commissioner Sedivy; those voting No, none.

The City Manager stated be had audited the c181ms and found them to be
true and lawful cla1ms against the City of Bozeman and recommended that they
be approved and the Director of Finance directed to issue warrants in payment.
After examination of the claims in detail and checking against the claim

register, it was moved by Commissioner Sedivy, seconded by Commissioner
Morrow, that all claims as presented be approved and the motion was carried
by the :following Aye and No vote: taose voting Aye being Mayor Staudaher, I

Adjournment
There being no further business to come before the Co~ssion at this
time it was moved by Commissioner Sedivy, seconded by Comadssloner Morrow,
