The Commission of the City of Bozeman met in regular session in the
Commission Room, City Hall Building, Wednesday, August 8, 1962 at 1:00 o'clock
p.m. Present were Mayor Staudaher, Commissioner Sedivy, Commissioner Morrow,
City Manager Cutting, City Attorney Berg and the Clerk. I
The following proceedings were had:
Minutes of the last regular session were read and it was moved by
Commissioner Morrow, seconded by Commissioner Sedivy, that the minutes be
approved as read and the motion was carried by the following Aye and No vote:
those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner
Sedivy; those voting No, none.
Request -- Torchlite Parade (Democratic Party)
Dr. Paul H. Visscher and Mrs. Cleo Butler appeared to request that the
City grant the local central committee of the Democratic party permission to
stage a torchlite parade on Main Street preceding a party rally scheduled for
7:30 p.m., Wednesday, Sept., 26th. The City Manager recommended that permission
be granted as requested prOVided the committee use all safety precautions possi-
ble for its policing of the parade to insure the proper use and disposal of the
torche s . It was moved by Commissioner Sedivy, seconded by Commissioner Morrow,
that the request be granted as recommended and the motion was carried by the I
following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner
Sedivy and Commissioner Morrow; those voting No, none.
Public Hearing -- Special Improvement District No. 425
This was the time and place Bet by Commission Resolution No. 1044 to hear
protests to the creation of Special Improvement District No. 425. Af fida vi t
of publication of Notice and the Clerk's Mailing Certificate stating that all
property owners had been notified as required by law were presented. Dave Vaughan,
an owner of property within the proposed district, appeared to discuss the possi-
bility of apportioning the difference in cost between a 12t1 trunk line and the
proposed 15" trunk line to future improvement districts connecting to the pro.
posed line. After a general discussion of the matter, Mr. Vaughan stated it was
not his intention to reg1ster a protest against the creation of the proposed
dis tric t. No written protests were on file and no one appeared to protest the
creation or the extent of the district. The City Attorney, as instructed, had
prepared a resolution creating Special Improvement District No. 425. Resolution

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZE-
~~N CREATING A SPECIAL IMPROVID~ENT DISTRICT TO BE KNOWN
AS SPECIAL IMPROVEMENT DISTRICT NO. 425 OF THE CITY OF
BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING AN
OUTFALL SANITARY SEWER TO SERVE HILLCREST RETIREMENT HOMES
AND ADJACENT RESIDENTIAL AREA.

Purchase of Stone Chips for Seal-Coat Oiling of Streets
The Street department has need for a supply of stone chips for use
in its program for seal-coat oiling of paving on various streets within the
City. The City Manager requested authorization to purchase 150 cubic yards
of the material at $4.00 per yard or the total approximate cost of $600.00
and it was moved by Commissioner Sedivy, seconded by commissioner Morrow, that
the purchase be approved and the motion was carried by the following Aye and
No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and
Commissioner Morrow; those voting No, none.
Water Meters -- Purchase
The City Manager reported that the Water Department has need for an
I additional supply of water meters and requested authority to place an order
for thirty-five (3/4") meters at a total approximate cost of $978.25, or
$27.95 each. It was moved by Commissioner Morrow, seconded by Commissioner
Sedi vy, that the purchase be authorized and the motion was carried by the
following Aye and No vote: those voting Aye being Mayor Staudaher, 'Commis-
sioner Morrow and Commissioner Sedivy; those voting No, none.
Bids for Fluorine
This was the time and place set for opening bids on the purchase of
50,000 lbs. (minimum carload) of sodium silicofluoride. The affidavit of
publication of the uCall for Bids't was presented. It was moved by Commis-
sioner Sedivy, seconded by Commissioner Morrow, that the bids filed with the
Clerk of the Commission be opened and read and the motion was carried by the
following Aye and No vote: those voting Aye being Mayor Staudaher, Commis-
sioner Sedivy and Commissioner Morrow; thOBe voting No, none.
The fOllowing bids were opened and read:

In view of the apparent nation-wide shortage of this material, as
evidenced by reports from other chemical firms, the City Manager recommended
that the bid of McKesson & Robbins be accepted, it being the only qualified
bid. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow,

that purchase of the material be authorized and the bid of McKesson & Robbins
be accepted and the motion was carried by the following Aye and No vote:
those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner
Morrow; those voting No, none.
Engineering for S.I.D., No. 425
Based upon an agreement for a "Contract for Engineering Services" I
entered into between the City and Harold Hoskins & Associates, engineers,
on August 9th, 1961, it was recommended by the City Manager that this firm
be authorized and directed to proceed with the engineering services required
for the preparation of plans and specifications and for the construction of
the sewer lines in Special Improvement District No. 425. It was moved by
Commissioner Morrow, seconded by Commissioner Sedivy, that, under the afore-
mentioned agreement, Harold Hoskins and Associates be directed to furnish
the engineering services as recommended for Special Improvement District
No. 425 and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy;
those voting No, none.
Resolution No. 1046 -- Tax Le vy /
Resolution Number L046 setting the tax levy at 44.9 mills for the
year 1962 was presented, en ti tIed:

It was moved by Commissioner Sedivy, seconded by Commissioner Morrow,
that the resolution be passed and adopted and the motion was carried by the
folloWing Aye and No vote: those voting Aye being Mayor Staudaher, Commis-
sioner Sedivy and Commissioner Morrow; those voting No, none.
Extension of City Limits to the West
The Commdsslon was referred to its action of May 16th, 1962, regarding
the extension of the City limits to the West. The City Manager presented a
proposed resolution which had been prepared by the City Attorney, as instructed.
Action was deferred for a period of one week to provide opponents of the annex-
ation to present further information on the matter.

The City Manager commented on the reports and recommended their approval.

Petition -- Change Form of City Government
The City Manager reported that a petition had been filed with the Clerk
of the Commission to petition that the question of retaining or rejecting the
present Commission-Manager Form of Government be placed to a vote of the qualified
voters of the City. The City Attorney stated action on the matter would be deter-
I mined following the Clerk's determination as to the sufficiency of the petition.
Bonds for City Officials
Reneral of annual bonds of the following persons in the amounts and for a
one year term beginning on the dates shown opposite their respective names were
presented:

Helen M. Wansink - Office Clerk and Assrt. - - 10,000 - 8/1/62

by commissioner Morrow, seconded by Commissioner Sedivy, that the bonds be

"Kiddy Rides" - (JC) Rodeo
It was reported that the local (Jcts) have requested authorization to sponsor
a "Kiddy Ride"! show at Main Street and 10th Avenue during its rodeo schedule on
Augus t 11 th. It was moved by Commissioner SediVY, seconded by Commissioner Morrow,
I that the request be granted subject to proper licensing of the show. The motion
was carried by the following Aye and No vote: those voting Aye being Mayor
Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none.

The City Manager stated he had audited the claims and found them to be true
and lawful claims against the City of Bozeman and recommended that they be approved
and the Director of Finance directed to issue warrants in payment. After examin-

There being no further business to come before the Commission at this
time, it was moved by Commissioner Morrow, seconded by Comndssioner Sedivy,
