HomeMy WebLinkAbout1962-08-15 125 Bozeman, Montana Augus t 15, 1962 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Buiiding, Wednesday, August 15, 1962 at 1:00 orclock p.m. ~resent were Mayor Staudaher, Commissioner Sedivy, Commissioner Morrow, I City Manager Cutting, City Attorney Berg and the Clerk. The following proceedings were had: Minutes of the last regular session were read and it was moved by Commis. sioner Sedivy, seconded by Commissioner Morrow, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. Claim -- Transportation for Mayor to American Municipal Association Convention A claim in the amount of $226.85 in favor of the Bennett Agency to purchase air transportation for Mayor Staudaher to attend the American Municipai Associ- ation Convention at Philadelphia, Pennsylvannia was presented. It was moved by Commissioner morrow, seconded by Commissioner Sedivy, that the claim be approved and the Director of Finance directed to issue a warrant in payment. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. Ordinance No. 836 I Affidavit of publication of the Annual Appropriation Ordinance for the fiscal year ending June 30, 1963 was presented together with the Appropriation Ordinance No. H36, entitled: ORDINANCE NO. 836 AN ORDINANCE Ai"' l'ROl:'RIA TING MONIES FOR EXl:'ENDrruREs DEEMED NECESSARY AND IN ACCORDANCE WITH BUDGETARY REQUIREMENTS FOR MAINTENANCE ETC., OF THE MUNICIPAL GOVERNMENT OF THE CITY OF BOZEMAN, MONTANA FOR THE FISCAL YEAR ENDING JUNE 30th, 1963. The City Manager recommended that the ordinance be approved and finally adopted. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, - that the ordinance be finally adopted and the motion was carried by the follow. ing Aye and No vote: those voting Aye being Mayo~ Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. Public Hearing .- Special Improvement District No. 426 This was the time and place set by Commission Resolution No. 1045 to hear protests to the creation of Special Improvement District No. 426. Affidavit of I publication of Notice and the Clerk's Mailing Certificate stating that all pro- perty owners had been notified as required by law were presented. No written pro- tests were on file and no one appeared to protest the creation or the extend of the district. The City Manager recommended that the district be created. The City Attorney, as instructed, had prepared a resolution creating Special Improve- ment District No. 426. Resolution No. 104H was presented, enti tled: (Continued on Page No. 126) 126 COMMISSION RESOLUTION NO. 1048 - A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPE- CIAL IMPROVEMENT DISTRICT NO. 426 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING AN EIGHT INCH OUT- FALL SEWER FROM EAST MAIN STREET AND ROUSE A VENUE TO THE NORTH LINE OF UNIVERSITY SUB-DIVISION AND FOR THE CONSTRUCTING AND INSTALLING AN EIGHT INCH LATERAL SEWER FROM THE NORTH LINE OF I UNIVERSITY SUB-DIVISION TO THE NORTH LINE OF WESTRIDGE SUB-DIVISION. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the resolution be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, commis- sioner Morrow and Commissioner Sedivy; those voting No, none. Engineering for S.I.D. No. 426 -- (Harold Hoskins & Associates) Based upon an agreement for a "Contract for Engineering Services" entered into between the City and Harold Hoskins & Associates, on August 9th, 1961, it was recommended by the City Manager that the firm be authorized and directed to proceed with the engineering services required for the preparation of plans and specifications for the construction of Special Improvement District No. 426. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that, under the aforementioned agreement, Harold Hoskins and Associates be directed to furnish the engineering services as recommended and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. I Special Improvement District No. 426 -- Application for Federal WPC Grant (Approx. $20,000) The City Manager stated that the engineer's estimate of construction costs for the sewerage facilities contemplated in Special Improvement District No. 426 is approximately $62,000 and recommended that application be made to the State Board of Health, acting as the State Water Pollution Control Agency, for a 3U% grant of Federal funds in the approximate amount of $20,000 under the pro. visions of 33 U.S.C. 466 et seq., "Federal Grants for Sewage Treatment", to assist in the accomplishment of the proposed project. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the City Manager be authorized and directed to pre- pare the application and the motion was carried by the foLloWing Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. Extension of City Limits to the West During the Commission meeting held August 8th, 1962, Commission action I on a proposed extension of the City limits to the West was tabled for a period of one week. A letter addressed to Mayor Staudaher and the City Commission, dated August 14, 1962, from the Bozeman City-County Planning Board, was pre- sented recommending a number of revisions of the boundaries of the area west of Bozeman proposed for annexation. The ietter was accompanied by a plat of the area with recommended revisions in the boundaries indicated, being essentiaily the exclusion from the previously recommended area of the Edens, LeClair, BORder, 127 Gerry, Niven, Keenan, Dixon, Edsall and Axtell properties on North Seventeenth Avenue, north of Durston Road and the wtswi of Section 12, T2S, R5E, MPM, be- ing the tract between West Babcock Street extended and Huffine Lane and between Fifteenth and Nineteenth Avenues. Following a thorugh discussion of the proposed annexation by City officials I and several interested parties attending the meeting, the general layout of a sanitary sewer trunk system proposed to serve the area, if annexed, was also reviewed and considered. The City Manager in concurrence with the Planning Board recommended that the City Engineer and the City Attorney be instructed to pre- pare the appropriate resolution to accomplish the annexation of the revised area West of Bozeman as outlined above, and in addition recommended, on the basis of new information presented by property owners at this meeting, the re-inclusion in this area proposed for annexation the swtswt of Section 12. Thus, the total area proposed for annexation may be generally described as containing the follow- ing tracts: (10, rrhe Hoey, Simpson, Nelson and Hardesty properties north of Durston Road on North Seventeenth Avenue; (2) , the E~Et of Section 11, T2S, R5E, MPM, excluding the Mountain Vista Subdivision and the Wiegand property; (3) , the W!NWt and NEtNWt of Section 12, T2S, R5E, MPM, excluding those portions already within the City limits; and (4) , the swtswt of Section 12, T2S, R5E, MPM. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, tha t the recom- mendations of the City Manager be approved and the motion was carried by the I following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. Peti tion -- Change of Fo~ of City Government The City Manager commented that the petition on file with the Clerk of the Commission to petition that the question of retaining or rejecting the pre- sent Commission-Manager Form of Government be placed to a vote of the qualified voters of the City is, at present, being processed to determine its sufficiency. Purchase of Police Uniforms The City Manager presented the written request of Police Chief Saunders for authorization to purchase from the Blumenthal Uniform Company of Seattle various items of police uniform apparel for the police force in the amount of $858.95. Following the recommendation of the City Manager that the purchase be approved, it was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the purchase be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none.
