HomeMy WebLinkAbout1962-09-12 138 Bozeman, Montana September 12, 1962 The Commission of the City of Bozeman met in regular session in the C08lD1ission Room, City Hall Building, Wednesday, September 12, 1962 at 1:00 o'clock p.m. Present were Mayor Staudeher, Commissioner Sedivy, Commi8- I sioner Morrow, Acting City Manager Fryslie, City Attorney Berg and the Clerk. The following proceedings were had: It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, tha t approval of the minutes of the previous meeting be post.poned. until aD acceuntlng of the distribution of warrants issued on the claims approved dur- ing the previous meeting had been aocomplished and the motion was carried by the tollowing Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; ,those voting No, none. Proposed Ordinance .. .. Amendment to Present Traffic Ordinance No. 768 to Establish Koch as ArterIal (Stop Street from Willson to 15th) As instructed, the City Attorney placed before the Commission a pro- posed ordinance he had prepared for the purpose of amending the present City Traffic Ordinance, (No. 768), to establish Koch street as an arterial (stop) street from Willson to 15th Avenue with four-way stopa at its interseotion. with 8th and 11th avenues. A group of residents from the neighborhood of tb. area to be affeoted by the proposal appeared before the Commission to regi- I ster its protest to the amendment. City officials disoussed the prob~e. with the group and it was agreed the matter was of such a nature that it oon- oerned the City as a whole, rather than that of a comparatively small neigh- borhood, and it was mutually agreed that within the near future City official. would meet with representatives of the group 1n an attempt to arrive at a result which might serve to a measurable degree the Interests of the public in general and the neighborhood paralleling Koch street lying west of Wil~s.n to 15 th a venue. A petition in protest to the proposal which contained the aignatures of seventy-one residents of the area was filed by the group and tinal action on the matter by the Commission was tabled. Report -- Meeting of Planning and Zoning Boards at Billings H. D. Korslund, preSident of the Bozeman-City County Planning Board, reported on proposed iegislative matters which were disoussed at a meeting of the various boards within the State he~d in Billings, September 11th. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy/ the t the report be accepted and the motion was carried by the following Aye and No I vo te : those voting Aye being Mayor Staudaher, Commissioner Morrow and Commis- sioner Sedivy; those voting No, none. Mayor 8taudaher compliment.. Mr. Korslund for his attending the meeting to represent the community and for his interest 1n publio affairs. Thompsonts 2nd Addition -- Final Plat The proposed plat of Thompson's 2nd Addition was plaoed before the 139 Commission for approval. Ac ting City Manager Fryslie sta_ted the Bozeman Ci t,I- County .t'lannlng Board had approved the plat on August 27, 1962, and, in concur- renoe with the City Engineer, recommended that the plat b. approved and he be authorized to sign the plat as Acting Director of Publio Service for the City. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the I City approve the plat and the Acting City Manager as Director of Public Service be authorized to sign for the City and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Coamlssioner Morrow; those voting No, none. Agreement for Land for Park Purposes -- ~ompson's 2nd Addition An agreement between the City and Thompson Herferd Ranches, Inc. obligating oertain property owned by Thompson tierferd Ranches, Inc. for park purposes when Thompson's 2nd and 3rd Additions as incorporated in 'J.'hollpson'. Master Plan are approved and platted was placed before the Commission. The agreement was approved by the City Attorney. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the agreement be approved and the Mayor and the Clerk of the Commission be authorized to sign the agreement for the City of Bozeman and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. Deed -- Thompson's 2nd Addition I A war~nt,. deed from Thompson Hertera Ranches, Inc. conveying to the City of Bozeman the East one-half of that portion of South Third Avenue, extended. whioh abuts Thompson's 2nd Addition te the City of Bozeman was presented. Upon recQMmendation of the Acting City Manager, it was moved by commissioner Sedivy, seoonded by Co~ls8loner Morrow, that the deed be accepted and the motion wa. carried by the following Aye and No vote: those votIng Aye being Mayor Staudaher, CommIssioner Sedivy and Commissioner Morrow; those voting No, none. Ordinanoe No. 837 -- "DWI Dri ving" Ordinance No. 837 defining "DWI Driving" was presented. entitled: ORDINANCE NO. 837 - AN ORDINANCE AMENDING SECTION 11.0<4.372 OF THE BOZEMAN MUNICIPAL CODE RELATING TO PERSONS OPERATING OR HAVING PHYSICAL CONTROL OF MOTOR VEHICLES WHILE UNDER THE IN- FLUENCE OF INTOXICATING LIQUOR OR DRUGS; PROVIDING FOR THE USE OF CHEMICAL ANALYSIS OF BLOOD, URINE, BREATH OR OTHER BODILY SUBSTANCE TO MEASURE DEGREE OF INTOXICATION OF DRIVERS; PROVIDING THAT MILLIGRAMS OF ALCOHOL .t'ER ONE HUNDRED (100) MILIGRAMS OF BLOOD SHALL BE BASIS OF PER CENT OF ALCOHOL IN THE BLOOD; PROVIDING FOR THE DUTIES I AND AUTHORITIES OF POLICE OFFICERS IN RELATION TO PERSONS OPERATING MOTOR VEHICLES WHILE UNDER THE IN- FLUENCE OF INTOXICATING LIQUOR OR DRUGS; PROVIDING FOR THE IMPOSITION OF FINES AND PENALTIES; AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HERE~ WITH. Request -- Holy Rosary Grade School The Acting City Manager placed before the Comm1ssion the request of the Holy Rosary School for permission to block off Third Avenue between West Main and West Babcock from 1U:UO to lU:l~ A.M., and from 12:00 P.M. to 1:00 P.M., I during the days school is 1n session. The Acting City Manager reported that a somewhat similar request had been denied by the City Commission on September 6th, 1961, and, as he was not aware of any change that would warrant a reversal .~ the previous action, he recommended that the request be den1ed. It was moved. by Commissioner Sedivy, seconded by Commissioner Morrow, that in the public inter- est the request be denied and the motion was carried by the following Aye and No vote: those voting Aye being Ma10r Staudaher, Commissioner Sedivy and C.mmis- sioner Morrow; those voting No, nene. C.P.A. Examination & Report of Water Department - 1962 The 1962 report of the examination of the records and operatione e~ the City Water Department prepared by H. H. Kirchhott, C.P.A., was presented.
