HomeMy WebLinkAbout1962-09-19 142 Boz emen, Mon tans September 19, 1962 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, September 19, 1962 at l:UU o'clock p.m. Present were Mayor Staudaher, Commissioner Sedivy, Commissioner I Morrow, Acting City Manager Fryslie, City Attorney Berg and the Clerk. The fOllowing proceedings were had: The approval of the minutes of the regUlar meeting held September 5th, 1962, having been postponed until this date, it was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the minutes of September 5th, 1.962, be approved and the motion was carried by the fallowing Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. Minutes of the last regular seesion were read and it was moved by Commis- sioner Morrow, seconded by Commissioner Sedivy, that the minutes as corrected be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayo~ Staudaher, Commissioner Morrow and Commissioner Sedivy; those.vo~ing No, none~ Resolution No. 1050 -- Extend City Limits to tha West of City _ During the regular session of the City Commission held on August 22, 1962, I the Commission regularly passed and adopted Commission Resolution No. lu49, dec1.aring its intention to extend the boundaries of the City limits to include a contiguous tract of land to the West of the present City limits. '!he affi- davit of publication of the Notice was presented. Two (2) valid wri tten pro- tests, each signed by two (2) resident freeholders of said territory had been placed on file with the Clerk of the Commission. The Commission was informed that the protests filed with the Clerk did not constitute a majority of the resident freeholders of the territory to be embraced by the aforementioned action and Commission Resolution No. 1050, to aocomplish the extension of the City limits and complete the action was presented, entitled: COMMISSION RESOLUTION NO. lU50 - A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN EXTENDING THE BOUNDARIES OF THE SAID CITY OF BOZEMAN SO AS TO EMBRACE AND INCLUDE A CERTAIN TRACT OF LAND CONTIGUOUS TO THE SAID CITY OF BOZEMAN AND HEREIN MORE PARTICULARLY DESCRIBED, WITHIN THE COR.PORATE LIMITS THEREOF It was moved by Commissioner SediVY, seconded by Commissioner Morrow, I that the resolution be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor staudaher, Commis- sioner Sedivy and Commissioner Morrow; those voting No, none. Opening of Bids -- Water Posting and Billing Maohine This was the time and place set for opening bids for the purchase of a water posting and billing maChine. The affidavit of the "Call for Bids" was 143 presented and it was moved by Comm.issioner Morrow, seconded by Commissioner Sedivy, that the bids be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Comm1s.s1oner Morrow and Commis- sioner Sedivy; those voting No, none. The one sealed bid received by the Clerk of the Commission was opened and read I as follows: Burroughs Corporation Burroughs Sensimatio dual $4,620.00 Billings lbrl.noh head printer - Style F Billings, Montana 5201 with split platen Plus 6% Fed. Excise Tax 277.20 l4,897.20 Less ~% Govt. Diso. 369.6U l4,527.60 Less Trade-in on 1,580.40 F 401-F3U738P To ta 1 $2,977.20 (The Federal Excise Tax of $277.20 would be waived by the furnishing of an Exemption Certificate by the City) The net delivered price of the new equipment with trade-in would be then $2,7UU.UO to the City. The Acting City Manager stated that the Director 01' Fin- anoe had advised him the equipment meets the' specifications as set forth in the calL for bids and recommended the purchase of the equipment and the award of the bid be placed with the Burroughs Corporation. It was moved by commissioner Sedivy, seconded by Commissioner Morrow, that the bid be awarded to the Burroughs Corpo- I ration and the motion was carried by the following Aye and No vote: those voting Aye being Mayor staudaher, commissioner SediVY and Commissioner Morrow; those voting No, ,none. Request -- Bozeman (JC's) & Pacers, Automobile Check Station Paul Rasmussen as representative of the local (~C's) and the Bozeman Paoers was present to request that the aforementioned groups be granted permission to eon- duet an "Automobile-Safety-Check" station on Main Street across trom the eourthouse during the hours trom 8:uO a.m. to 6:00 p.m., Saturday, September 22nd. Mr. Rasmussen assured the Commission that the service offered would be to cars whose driver's voluntarily requested the check, and that the station would be operated in a maner which would not oonflict with the Bozeman Senior High School parade sched- uled for 1:UO p.m., also, on the 22nd. It was moved by Commissioner Morrow, sec- onded by Commissioner Sedivy, that the request be granted and the motion was oar- r1ed by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. Ordinance No. 837 -- "DWI Driving'" -- Final Passage I During the Commission meeting held September 12, 1962, the Commission pro- visionally passed Ordinance No. 837 and set September 19, 1962 as the date for final adoption. The Ordinance was plaoed before the Commission, entitled: ORDINANCE NO. 837 - AN ORDINANCE AMENDING SECTION 11.04.372 OF THE BOZEMAN MUNICIYAL CODE RELATING TO PERSONS OPERATING OR HAVING (Continued on Page No. 143) . 144 PHYSICAL CONTROL OF MOTOR VEHICLES WHILE UNDER THE IN- FLUENCE OF INTOXICATING LIQUOR OR DRUGS; PROVIDmG FOR THE USE OF CHEMICAL ANALYSIS OF BLOOD, URINE, BREATH OR OTHER BODILY SUBSTANCE TO MEASURE DEGREE OF INTOXICATION OF DRIVERS; PROVIDING THAT MILLIGRAMS OF ALCOHOL PER ONE HUNDRED (100) MILLIGRAMS OF BLOOD SHALL BE BASIS OR PER I CENT OF ALCOHOL IN THE BLOOD; PROVIDING FOR THE DUTIES AND AUTHORITIES OF POLICE OFFICERS IN RELATION TO PERSONS OPERATING MOTOR VEHICLES WHILE UNDER THE IN- FLUENCE OF INTOXICATING LIQUOR OR DRUGS; PROVIDING FOR I THE IMPOSITION OF FINES AND PENALTIES; AND REt'EALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HERE- WITH. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that , the ordinance be finally passed and adopted and the Clerk of the Commission dir- . ected to publish the ordinance as prescribed by law. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaner, Commis- sioner Sedivy and Commissioner Morrow; those voting ~o, none. Request -- Bozeman Senior High School Homecoming Parade It was reported that the student body of the Bozeman Senio~r H~gh School had requested permission to conduct its Homecoming Day Parade on Main Street at 1:00 o'clock p.m., Saturday, September 22nd. With the understanding that necess- ary coordina tion w1 th the police Department would be effected, it was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the request be granted and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; the voting No, none. Thompson's 3rd Addition -- Final Plat I The proposed plat of Thompson's 3rd Addition was placed before the Commis- sion for approval. Acting City Manager FTysiie stated the Bozeman-City County ... Planning Board had approved the plat on August 27th, 1962. The Commission was referred to its actlon of September 12, 1962, whereby Thompson Hereford Ranches, Inc., by an agreement had provided land for park purposes for Thompson's 2nd and 3rd Additions, and the Acting City Manager reooMmended that he be authorized to sign the plat as Aoting Director of Public Service for the City. It waa moved by Commissioner SediVY, seconded by Commissioner Morr~ tha t the Ci ty approve the pla t and the Aoting City Manager as Director of Publio Servioe be authorized to sign for the City and the motion was carried by the following Aye and No vote: those voting Aye being Mayor staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. Re-advertise for the Sale of Bonds for SID No. 424 The Acting City Manager stated that as an error had occurred in the publi- cation of the "Notice of Sale" of bonds for Special Improvement District No. 424, I as directed by the City Commission on September 5th, 1962 , it wa~ now neoessary to re-soheduLe the date of sale and recommended that October 16, 1962 be set as the da te of saLe. It was moved by Commissioner Morrow, seoonded by Commissioner Sedi vy, that the Clerk of the Commission be directed to advertise for the sale of bonds of Speoial Improvement Distriot No. 424 in the approximate amount of $400,ouU.OO on October L6, 1962 and the motion was carried by the following Aye 145 and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those vot~g No, none. Authority to Travel -- Fire Chief Penttila, Fire Chiefs' Meeting I It was reported that the Board of Directors of the State Fire Chlefsr Assoc- iation has scheduled a meeting to be held September 29th, at Lewistown. The Act- I ing City Manager stated that Fire Chief Penttila is, at present, 2nd Vice-President of the association and recommended that he be granted authorization to attend the meeting and, that, it being in the pub~ic interest, the expenses incurred be char- . ged to the General fund. It was moved by Commissioner Sedivy, seconded by Commis- sioner Morrow, that the authorization to attend the meeting as recommended be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. Report -- Annual Traffic Survey of Bozeman (1961) The report of the annual traffic survey ot the City of Bozeman for the year 1961, prepared by the National Safety Council was presented. Chief of Police Saunders commented on the report of the survey and it was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the report as presented by Police Chief Saunders be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissi~~er Sedivy; those voting No, none. I Report -- Water Collector The Wa ter Collectorts Report for the month of August was presented, and it "" was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the report be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commis- sioner Morrow; those voting No, none.
