Bozeman, Mon tana April 25, 1962 The Commission of the C1ty of Bozeman met 1n regular session in the Commis- sion Room, City Hall Building, Wednesday, April 25, 1962 at 1:0U o'clock p.m. I Present were Mayor Staudaher, Commissioner Sedivy, Commissioner Morrow, City Manager Cutting, City Attorney Berg and the Clerk. The fOLlowing proceedings were had: Minutes of the last regular session were read and it was moved by Commis- sioner Morrow, seconded by Commissioner Sedivy, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. Minutes of the SpeCial Meeting of the Commission held April 24th, 1962 at 9:00 o'clock A.M. were read and it was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the minutes be app~oved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. Discussion -- Paving North Tenth Avenue between Beall and Durston A proposed special improvement district for paving on North Tenth Avenue between Beail and Durston was again discussed. Action was deferred when I Mr. Tschache was unable to attend the meeting. Petition and Donation From Housekeepers Club -... Street Lite at Entrance to Sunset Hills Cemetery Mrs. Minerva Morgan, PreSident, and Mrs. P. W. Peterson, Treasurer of the Bozeman Housekeepers Club, appeared before the Commission to file a petition that a street light be installed at the entrance to Sunset Hills Cemetery on Buttonwood and presented a $1UO.UO contribution from the Club to assist in the maintenance 0f the light. The g1tt was part of a "Better Street Lighting for the City" pro- ject of the club and represented a prize won by the local club in a nationwide contest. In accepting the gift, City officials stated the project of the club was most worthy, and it was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the Montana Power Company be authorized and requested to install a mercury vapor light of the Itdusk-to-dawn" type a t the entrance to the Sunset Hills Cemetery and the motion was carried by the following Aye and No vote: those voting Aye being Mayor staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. I JC' 8 Reque st - - Painting of Luminous House Numbers The Commission was referred to the request filed by the Jaycees that the club be permitted to solicit home owners to have Members of the club paint luminous house numbers at homes located in the City for a charge of $l.UO per home. The City Manager reported he was not aware of any reason which would warrant denial of the request, but stressed that the project would be at the sole discretion of property owners and was not to be conSidered mandatory. It was moved by Commie- sloner Sedivy, seconded by Commissioner Morrow, that the request be granted 72 subject to approval of the individual property owners. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. Report -- Montana Municipal League Committee Meetings The City Manager reported on the prooeedings of the meetings of various committees of the Municipal League held at Helena on April 12th and 13th, and I copies of the minutes of the meetings were distributed. It was moved by Mayor Staudaher, seconded by Commissioner Morrow, that the report be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. License and Permit Bond -- Mannix Electric, Inc. The Electrician's License and Permit bond of Mannix Electric, Inc. in the amount of $5,000.0U, issued for the period ending May 26th, 1963, and written by the Western Surety Company as surety to the City of Bozeman was presented. The instrument was approved as to fom by the City Attorney, and it was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the bond be accepted and filed and the motion was carried by the fo~lowing Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those Toting No, none. Miscellaneous Walks & Curbs 1962 -- Order to Repair and/or Construct The City Engineer, under provisions and authority of Sections 11-967 and 1- 11-2226, R.C.M., 1947, and Chapter 9.36 of the Bozeman Municipal Code, relating to construction of Walks and Curbs without formation of a Special Improvement District, submitted his final recommendations in detail with reference to needed repairs and new installation of walks and curbs in the City. The City Manager stated that, from time to time during the period above specified, additional walks and curbs which require repair or new installation may be discovered and be added to the aforementioned recommendations, and recommended that the report be adopted, and that the Clerk of the Commission be authorized and direoted to advertise for bids for the work. Commissioner It was moved by Commissioner Sedivy, seconded by/Morrow, that the final report of the City Engineer as to the repair and installation of Misceilaneous Walk and Curb for 1962, including those walks and curbs now or hereafter deter- mined to require repair or new installation be and the same is hereby accepted, approved, adopted, ordered filed and that the Clerk of the Commission be author- ized and directed to advertise for bids for this work for an opening date of May 23rd, 1962. Said adopted report of the City Engineer is hereby referred to I and made a part of this minute entry by such adoption and reference for the purpose of designating and identifying the streets and avenues on Which such new installations or repairs are to be made and such new installation or repairs are hereby ordered to be made under and pursuant to the provisions of Section 11-967 and 11-2226, R.C.M., 1947, and Chapter 9.36 of the Bozeman Municipal Code, and the City Manager is hereby instructed to give or oasue to be given, to each 73 0WDer or agent of suoh owner, or either, of the property along whioh suoh new installation or repair is to be made, written or printed notice of such order, as required by the provisions of Section 11-2226, R.C.M., 1947, and Chapter 9.36 of the Bozeman Municipal Code, and such new installations or repairs are hereby ordered to be made withIn thirty days from the date of such notice, and the motion I was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. Display Parking of "MSC'" Mobile Campus -- Request of Chamber of Commerce It was reported that the Chamber of Commerce had requested that permission be granted to park the "MSC'" Mobile Campus in front of the Montana Power Officee, April 3uth thru May 5th, for display in connection with the centennial celebration of the land-grant COlleges. The City Manager recommended that the the request be granted, contingent upon approval of the Montana Power Company and provisions being made by those operating the exhibit that the area around the trailer be maintained in a clean and orderly manner during the period. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the request be granted as recommended and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. Right of Way Easement - - Gas Line to Serve Hillcrest Home Area I An easement to provide a right of way for the construction of a gas l1ne across the SEt of Section (7), Twp. (2) Sou th,Rge. (4) East, M.P.M., a portion of Sunset Hills Cemetery, to provide service to the Hillcrest Home area was pre- sented. The City Manager recommended that the City grant the easement, and it was moved by Commissioner Sedivy, seconded by Commissioner Morrow, tha t the ease- ment be granted and the Mayor and the Clerk of the Commission be authorized and directed to complete the easement for the City and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. Report -- Attendance at Fire Department Officer Command School Ass't. Fire Chief Huber reported on the attendance of himself and Lt. Herb Hoey at the Fire Department Officer Command SchOOl conducted at Yakima, Washignton, April 14th thru the 19th. His report consisted of a resume of the program, its attendance and the values derived by the City in having represent- atives at such meetings. It was moved by CommiSSioner Morrow, seconded by Commis- sioner Sedivy, that the report be approved and the motion was carried by the I following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivy; those voting No, none. Commissioner Morrow's Absence from Meeting Authorized The City Manager reported that Commissioner Morrow would be absent from the next regular meeting of the Commission to be held May 2nd, 1962. In compliance with Chapter 2.08 of the Bozeman Municipal Code, it was moved by Commissioner 74 Sedivy, seconded by Mayor Staudaher, that the absence of Commissioner Morrow be authorized and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. Purchase of Playground Equipment -- Lindle y Park It was reported that the 1961-1962, Park Recreational budget provides for I the purchase of equipment in the maximum amount of $1,000.00. The City Manager stated that in accordance with this budget provision it 1s recommended by the Board of Recreation and the Recreation Director that the following playground equipment be purchased for installation in Lindley Park: a six-unit swing, a whirl, a slide and a four-unit tetter totter; and funds being available for the purchase which would be in the approximate amount of $932.00, he recom- mended the purchase be approved and it was moved by Commissioner Morrow, seconded by Commissioner SediVY, that the purchase as recommended be approved in the approximate amount of $932.00 and the motion was carried by the follow- ing Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner sedivy; those voting No, none. Reports The following reports for the month of March were presented: Director of Finance Director of Public Service The City Manager commented on the reports and recommended their approval. Attorney General's Law Enforcement Conference, Helena, 5/2-5 It was reported the Attorney General's Law Enforcement Conference ir~".... scheduled to be held in Helena, May 2nd thru the 5th. The City Manager recom- mended that Police Chief Saunders be authorized to attend the conference. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the authority to attend the meeting be granted to Chief Saunders and that, it being in the publiC interest, his expenses be paid from the General fund. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner sedivy; those voting No, none. Agreement -- Display of American Flags by Jaycees On April 11, 1962, the City granted the local Jaycees permission to display American Flags according to a plan presented by the organization, subject to the I preparation of an agreement wnich would be mutually agreeabie to both the City and the Jaycees, and under which the Jaycees would assume ilability for damage to the general public and/or to the parking meters resulting from the attach- ment of the flags. As stipulated, the agreement, approved as to form by the City Attorney, was presented to the Commission and it was recommended by the 75 I City Manager that the City enter into the agreement. It was moved by Commis- sioner Sedivy, seconded by Commissioner Morrow, that the Commission approve the agreement and that the Mayor and the Clerk of the C1 ty Commission be author- ized and directed to sign for the City. The motion was carried by the fOilow- ing Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none.
