HomeMy WebLinkAbout1962-01-31 37 Bozeman, Montana January 31, 1962 The Commission of the City of Bozeman met in regular session in the Commis- sion Room, City Hall Building, Wednesday, January 31, i962 at l:UU o'clock P.M. I Present were Mayor Staudaher, Commissioner Sedivy, Commissioner Morrow, City Manager Cutting, City Attorney Berg, Assft. City Manager Fryslie and the Clerk. The following proceedings were had: Minutes of the last regular session were read and it was moved by Commis- sioner Morrow, seconded by Commissioner Sedivy, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner SedivYj those vo ting No, none. In Memoriam -- Death of Governor Donald G. Nutter On behalf of the City of Bozeman, Mayor Staudaher issued the following statement: "I feel that we should take official note of the tragic and untimely death of Governor Nutter and his official party and crew in the air accident last Thursday, January 25th. The sudden loss of dynamic, pubiic officials and highly skilled personnel is always a shock and saddening to all of our people regardless of differences. We should pay our tribute to these men along with the many who have attended the official cere- monies and services. I We should also realize that Governor Tim Babcock in succeeding to that office now has the full responsibility for carrying on our State government. To him should be extended our full coop- eration and best wishes." Advertise for Bids for Pickup Truck Bid specifications prepared for the purchase of a pickup truck for the Water Department were placed before the Commission. The City Manager stated the cost of the unit 1s estimated to be approximately $2,2UO.UO and recommended the City adver- tise for bids for an opening date of February 21, 1962. It was moved byCommis- sloner Sedivy, seconded by Commissioner Morrow, that the purchase of the truck be authorized and the Clerk directed to advertise for bids for the opening date of February 21, 1962. The motion was carried by the fOllowing Aye and No vote: those voting Aye being Mayor staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. Advertise for Bids for Air Compressor and Accessories Bid specifications prepared for the purchase of a 125 (cfm) Air Compressor with accessories were placed before the Commission. The City Manager sta ted the cost of the unit is estimated to be approximately $3,5UO.00 and recommended the I City advertise for bids for an opening date of February 21, 1962. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, tha t the purchase of the com- pressor and the accessories be authorized and the Clerk directed to advertise for bids for the opening date of February 2i, 1962 . The motion was carried by the to 1,1 owing Aye and No Vote; those voting Aye being Mayor Staudaher, Commissioner Morrow and Co~ssioner Sedivyj those voting No, none. 38 Fire Department -- Availability of New Looation Fire Chief Penttila, Ass't. Fire Chief Huber and Fire Captain Embry appeared to report on the Fire Department's survey of the Ci ty in an attempt to find more secure and adequate quarters for the department's equipment and personell than the present hazardous location in the City Hall. It was reported they had, as yet, failed to find a suitable location for recommendatio~~; however, the departmen t I would continue the s.tuq.y and. sl1rvey. Utility Service Connections -- Parochial High School Joe Trunk, Jr. of Frank J. Trunk & Son, Inc., the mechanical and plumbing contractor, and Frank Messmer of Haggerty-Messmer Co., the general contractor on the new Parochial High School, appeared at the meeting to further discuss pro. posed methods and layouts to provide the school with connections to the City's water and sewer systems. The City Manager referred the Commission to Commission action of August 2, 1961 authorizing the water system connection and also pre- sented a letter received from Father Paul M. Mackin Which expressed the willing- ness of the Church to be incorporated in the City Ltmits. A proposed layout scheme for water and sewer lines to serve the school was presented by the City Manager and the City Engineer. It was moved by Commissioner SediVY, seconded by Commissioner Morrow, that the layout scheme for the utility lines as presented be approved subject to like approval by Church authorities. The motion was carried by the following Aye and No vote: those voting Ave being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. -I Fire Department -- Service to Urban Areas Outside of City Ltmits The City Manager reported that it has been alleged that some agents are selling fire insurance to suburban residents at city rates, and if true, he feared such suburban residents may be lead to believe that the City is obligated to pro- vide them with fire protection. The Manager again stated that all residents ot the suburban areas adjacent to the City should understand the City Fire Department has no obligation whatever to provide any service outside of the Bozeman City Limits even though the Department has at times made an effort to render such assistance as possible in these neighboring areas. S.I.D. No. 421 -- Legal Action to Attack Validity & Recover Payment of Assessments The City Manager reported that Herbert S. Simmons, Bert H. VanDyken and Wilbur E. Smith have filed separate actions in the District Court as plantiffs to the action of the proceedings in the City's creation of Special Improvement District No. 421, the method of its assessments tor the improvements thereof and for recovery of taxes levied for this District and paid under protest. The I Commission was informed that the City Attorney had been instructed to tile answers to the complaints within the Twenty-day period required by law. Cancellation of Bond -- Bozeman Electric Company A written request from The Phoeniz of Hartford Insurance Companies, the bonding company, that the Electricians Bond of Bozeman Electric Co. be cancalled 39 as of February 28, 1962 was presented. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that cancellation' of the bond as requested by the bonding company be approved and the motion was carried by the following Aye and No vo te : those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner sedivy; those voting No, none. I Montana Municipal League Meeting ..- February 8, 1962 It waS reported that the F~ecutive and Legislative Committees of the Montana Municipal League have scheduled meetings to be held February 8th, 1962 at Butte, Mon tana . The City Manager requested that Mayor Staudaher, and he, as members of the committess, as well as the other members of the Commission be authorized to attend the meetings. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the authorization for travel to the meetings be approved as requested and that, it being in the public interest, the expenses incurred to attend the meetings be paid from the General Fund. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none.
