Present were Mayor Staudaher, Commissioner Sedivy, Commissioner Morrow, City I Manager Cutting, City Attorney Berg, Ass ft. City Manager Fryslie and the Clerk. The fOllowing proceedings were had: Minutes or the last regular session were read and it was moved by Commis- sioner Morrow, seconded by Commissioner Sedivy, that the minutes be approved as read and the motion was carried by the fo~lowlng Aye and No vote: thos e vo ting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner SedivYj those voting No, none. Continuation Certificate or Budd Plumbing & Heating (Gas Fitters Bond) A Continuation Certiricate ror a Gas Fitter's bond for Budd Plumbing and Heating Company was presented. FOllowing the reoommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Morrow, tha t the oertiricate be approved and accepted and the motion was carried by the fOllow- ing Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrowj those voting No, none. Contination Certificate of C. E. Anderson (Plumbers Bond) A Continuation Certificate for a Plumber's Lioense Bond for C. E. Anderson I was presented. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the certificate be approved and the motion was carried by the fOllowing Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, none. Mili tary Lea ve -- City Manager The City Manager informed the Commission that as a member of the Ready Reserve of the Armed Forces he has been ordered to 15 days of actiVe duty for training from February 17th to March 3rd, 1962 at He~ena, Montana and requested that military leave permitting his compliance with these orders be approved, and Harold A. Fryslie, his assistant, be designated Acting City Manager during his absence. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, tha t the request be granted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner SedivYj those voting No, none. City Center Motel Addition ...- Agreement He Removal of Residence A letter received from Garvan Wiman, Chairman of the Board of Adjustment, I and addressed to the Commission was presented. The letter stated the Board of Adjustment of the City had grante~ an appeal filed by George M. and Vivian M. Hubbard, husband and wife, owners of the City Center Motel, to construct addi- tional motel units contingent on the approval and execution of an agreement between the City and Mr. and Mrs. "Hubbard that the Hubbards within a period of 41 of sixty (60) days after January 15, 1964, remove or tear down the two-story residence now situate on the East Fourteen (14) feet of the North Fifty (5U) feet of lot Two (2) and the North Fifty (5U) feet of Lot One (1) in Block "E" of Tracy's First Addition. The City Manager presented the agreement and concur- red in the action of the Board of Adjustment. It was moved by Commissioner I Sedivy, seconded by Commissioner Morrow, that the City enter into the agree- ment and that the Mayor and the Clerk of the Commission be authorized and directed to sign for the City. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commissioner Morrow; those voting No, Done. Request for BanDer Across Main Street -- "Heart Fund Drive" - Feb., '62 The City Manager reported that Mrs. Phil Sandquist, County Chairman of the Gallatin Heart Fund Association, had requested that the association be granted permission to hang a banner sign across Main Street during the period of the Heart Fund Drive. The City Manager recommended that, in this instance, the request be granted provided that the proposed sign and its erection comply with the provisions of Chapter 14.16 of the Bozeman Municipal Code. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the request be granted contingent upon the banner being properly constructed and suspended, that permission of the owners to attach the banner to the buildings from which the sign is suspended be received and the banner be promptly removed at the I termination of the drive. The motion was carried by the following Aye and No vo te : those voting Aye being Mayor Staudaher, Commissioner Morrow and Commis- sioner Sedivy; those voting No, none. Water SUpply for Hillcrest Homes -- Proposed Water Mains The City Manager reported that the Bozeman Deaconess Hospital is desirous of providing water for its proposed Hillcrest Homes project by connecting to the City's water supply. The City Engineer presented a proposed layout scheme for we ter lines to serve the Hillcrest Homes by extending the 12" wa ter main now serving the New Hyalite View area. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the layout scheme for the water lines as presented be approved subject to like approval by the Board of Directors of the Bozeman Deaconess Hospital. The motion was carried by the following Aye and No vo te : those voting Aye being Mayor Staudaher, Commissioner Sedivy and Commis- sioner Morrow; those voting No, none. Sewage Disposal Facilities for Hillcrest Homes The Commission, City Manager and the City Engineer discussed the matter I of the Bozeman Deaconess Hospital's plans for providing sewage disposal for its Hillcrest Homes project and the matter was tabled. After examination of the claims and checking against the claim register, it was moved by Commissioner Morrow, sec- onded by Commissioner Sedivy, that the claims be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Staudaher, Commissioner Morrow and Commissioner Sedivyj those voting No, none. Reports The following reports were placed before the Commission: I Disposal Plant Uperator Sanitation Librarian Water Colleotor Building Inspector Polioe Judge Police Chief Fire Chief Cashier's Report The City Manager, commenting that all operations of the City appeared to be normal, other than that of the Street department because of sever winter weather oonditions, recommended that the reports be approved. It was moved by Commissioner Morrow, seoonded by Commissioner sedivy, that the reports be approved and filed and the motion was carried by the fOllowing Aye and No vo te : those voting Aye being Mayor Staudaher, Commissioner Morrow and Commis- sioner SedivYj those voting No, none.
