November 15, 1961 at l:UO o'clock P.M. Present were Mayor Swanson. Commissioner Staudaher, Commissioner Sedivy, City I Manager Cutting. City Attorney Berg, Ass't. City Manager Fryslie and the Clerk. The following proceedings were had: , Minutes of the last regular session were read and it was moved by Commis. sioner Staudaher. seoonded by Commissioner Sedivy. that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting No. none. Annual Meeting -.. Middle Creek Water Users' Ass'n. Notice nas been reoeived the annuai meeting of the Middle Creek Water Users' Association is to be held on Monday. November 20. 1961. It was moved by Commis. \ sioner Sedivy. seconded by Commissioner Staudaher, that Harold A. !"ryslie, Ass't. City Manager. be appointed as the official representative of the City of Bozeman at this meeting and that he be given a proxy to vote the stook of the City of Bozeman and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson. Commissioner Sedivy and Commissioner Staudaher; those \ I voting No, none. Request -... Additional Street Lights in Legion Housing Area The reques t ot W. H. Erwin. Manager of the Legion Housing. tha t the Ci ty place two additional street lights within the housing area was presented. The City Manager recommended that the request be reoognized; however. he deemed it necessary that it be denied until a future date. It was moved by CommiSSioner Staudaher, seconded by Commissioner SediVY. that the request be denied until a la te r de te . The motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner staudaher and Commissioner Sedivy; those voting No. none. Request to Conduct Apple Sale -- Kiwanis Club The request of the Kiwanis Club to conduct an apple sale on Saturday. November 18th, was presented. and the City Manager recommended that the request be granted. It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the request be granted as recommended and the motion was carried by the following Aye and No vote: those voting Aye being Mayor SWanson. Request -- Musoular Dystrophy Fund Drive The request of the Bozeman Assembly of Rainbow for Girls to conduct a house-to-house canvass in oonnection with its annual Muscular Dystrophy Fund drive during the hour between 6:UO P.M. and 7:00 P.M.. TueSday, November 21st. was pre- sented. The City Manager recommended that it be granted, and it was moved by Commissioner Staudaher. seconded by Commissioner Sedivy, that the request be granted 5 and the motion was carried by the fo!lowing Aye and No vote: those voting Aye be- ing Mayor Swanson. Commissioner Staudaher and Commissioner Sedivy; those voting No. none. Canoellation of Bonds -- Curley-Naylor Eleotric Co.. Billings, Montan~ A written request from the bonding company that the Electrioians Bond of the Curley-Naylor Electric Co., Bi!lings. Montana. be cancelled as ot November 15th, I 1961 was presented. It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher. that the bond be cancelled as requested by the bonding company and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson. Commissioner Sedivy and Commissioner Staudaher; those voting No, none. Vaoa tion -- City Manager (20-25, November, 1961) The City Manager requested that he be granted a vacation from November 2vth to the 25th, inclusive, and that Harold A. Fryslie. Ass't. City Manager. be desi- gnated to perform tne duties of City Manager during the period. It was moved by Commissioner Staudaher, seoonded by Commissioner Sedivy, that the request be granted and the motion was carried by the fOllowing Aye and No vote: those voting Aye being Mayor Swanson. Commissioner Staudaher and Commissioner Sedivy; those vo ting No. none. Bond & Contract (S.I.D., No. 422) The contract documents for construction of Special Improvement District No. 422 awarded to Gardner Construction Company were presented. The contract I and bond were approved as to form by the City Attorney and it was moved by ~ommis- sioner Sedivy. seconded by Commissioner Staudaher. that the Mayor and the Clerk of the Commission be authorized to sign the contract for the City of Bozeman and the motion was oarried by the fo!lowing Aye and No vote: those voting Aye being Mayor Swanson, Commissioner sedivy and Commissioner Staudaher; those voting No. none. Montana MuniCipal League Committees Meetings -- Helena, Montana CommiSSioner Staudaher and the City Manager reported on their attendanoe at the meetings of the Executive and Legislative Committees of the Montana Municipal League held at Helena, November 9th. ~he report included a description of the meeting. its attendance and the values to be derived by the City in having repre- sentatives at meetings dealing with municipal problems and their solution. It wa s moved by Commissioner SediVY, seconded by Mayor Swanson. that the report be approved and the motion was carried by the fOllowing Aye and No vote: those voting Aye be- ing Mayor Swanson and Commissioner Sedivy; those voting No, none. Report -- Cemetery (Oc tober) I The City Manager reviewed the October report of the Cemetery with the Commis- sion and reoommended that the report be approved and filed. It was moved by Commis- sioner Staudaher. seconded by Commissioner Sedivy. that .the report be approved and filed and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Swanson.
