The Commission of the City of Bozeman met in regular session in the Commission
Room. City Hall Building, Wednesday. November 29, 1961 at 1:00 o'clock P.M. Present
were Mayor Swanson. Commissioner Staudaher, Commissioner SediVY, City Manager
I Cutting. City Attorney Berg. Ass't. City Manager Fryslie and the Clerk.
The following proceedings were had:
Minutes of the last regular session were read and it was moved by Commissioner
Staudaher, seconded by Commissioner Sedivy, that the minutes be approved as read
and the motion was carried by the following Aye and No vote: those voting Aye be-
ing Mayor Swanson. Commissioner Staudaher and Commissioner Sedivy; those voting
No. none. .
Authority to Purchase Jaok Hammer -- . Water Department
The City Manager reported tnat the present jack hammer. a unit of equipment used
frequently by the Water Department. is broken and in all likelihood it would be a
matter of some 90 days before repairs for tne unit oould become available. As this
piece of equipment should be available for use at all, times, he recommended that
authorization be granted to purChase a new hammer at a cost of $560.00 and the pre-
sent hammer would be eventually repaired and retained to serve as a standby unit.
It was moved by Commissioner Sedivy. seconded by Commissioner Staudaher. that the
I purchase be approved a8 recommended by the City Manager. The motion was carried by
the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner
Sedivy and Commissioner staudaher; those voting No, none.
Approval -- Final Audit of Disposal Plant Projeot (WPC-Mont-50)
(Letter of Acceptance)
A letter from the Department of Health. Education. and Welfare of the Federal
Government was presented which stated that the final audit ot the Sewage Treatment
Works Construction Project No. WPC-Mont-SO of the City of Bozeman had been completed,
and final settlement could be made if the City accepts the exoeptions cited in the
audit and approves the proposition that the monetary oommitment of the Federal
Government will have been met and the project considered terminated wnen Federal pay-
ments to the City total $10,311.96. The City Manager reviewed the audit with the
Commission and stated that he, the Director of Finance and the City Engineer reoom-
mended that the City accept the audit and approve the proposition as stated above
and that the Mayor be authorized to sign a letter addressed to the Water POllution
Agency advising it of this action. It was moved by Commis sioner Staudaner, seoonded
by Commissioner Sedivy. that the City accept and approve the reoommendation as stated
I and that the Mayor be authorized and directed to submit a statement for the City to
the aforementioned Federal Agency of its concurrence of the audit and proposed final
settlement. The motion was carried by the following Aye and No vote: those voting
Aye being Mayor Swanson. Commissioner Staudaher and Commissioner Sedivy; those
voting No. none.
Disposal Plant -- Final Payment of Contract (Project WPC-Mont-50)
A claim in the amount of $3,148.33 filed by Haggerty-Messmer Co. representing

10% of the total amount of the contract retained on the sewage disposal plant
contract (WPC-Mont-5u), pending final audit by the Federal Government was presented.
The City Manager recommended that the claim be approved and a warrant issued in
payment. It was moved by Commissioner Sedivy. seconded by Commissioner Staudaher,
that the claim be approved and payment made as reoommended. The motion was car-
ried by the following Aye and No vote: those voting Aye being Mayor swanson. I.
Commissioner Sedivy and Commissioner Staudaher; those voting No. none.
Payment -- Front End Loader
A claim in favor of the Seourity Bank & Trust Company in the amount of
$5,416.67 representing the second installment payment on tne front end loader
and snow plow of the City was presented. The City Manager reoommended that the
claim be approved and a warrant issued for payment in order to meet the pawment
due-date of December 5. 1961. It was moved by Commissioner Staudaher. seconded
by Commissioner Sedivy. that the claim be approved and a warrant 1ssued for pay-
ment 8S recommended. The motion was carried by the following Aye and No vote:
those voting Aye being Mayor Swanson. Commissioner Staudaher and Commissioner
Sedivy; those voting No. none.
Report -- Director of Finanoe (Ootober. 1961)
The Ootober, 1961, report of the Director of Finance was presented. The City
Manager stated that the report indicated the financial operations of the City
appeared to be normal for the period and recommended that it be approved. It was
moved by Commissioner Sedivy. seconded by Commissioner Staudaher. that the report 1
be approved and ordered filed and the motion was carried by the following Aye and .
No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner
Staudaher; those voting No. none.
Special Improvement District (Lighting) -- South Black Avenue
A petition bearing signatures of residents and owners of property south of
College ~treet on South Black Avenue requesting the City to oreate a special
improvement lighting district was presented to the Commission. Action on the matter
was tabled until the next regular meeting to be held December 5th. 1961.

There being no furtner business to come before the Commission at this time
it was moved by Commissioner Staudaher, seconded by Commissioner sedivy, that the
meeting adjourn and the motion was carried by the following Aye and No vote:
those voting Aye being Mayor Swanson. Commissioner Staudaher and Commissioner
Sedivy; those voting No. none.
