The Commission of the City of Bozeman met in regular sesslon in the Commis-
I sion Room. City Hall Building, Wednesday, December 6, L961 at 1:00 o'olock P.M.
Present were Mayor Swanson, Commissioner Staudaher, Commissioner Sedivy. City
Manager Cutting, City Attorney Berg. Ass't. City Manager l"ryslie and the Clerk.
The following proceedings were had:
Minutes of the last regular session were read and it was moved by Commis-
sioner Sedivy, seconded by Commissioner Staudaher. that the minutes be approved
as read and the motion was carried by the following Aye and No vote: those vot-
ing Aye being M&yor Swanson. Commissioner Sedivy and Commissioner Staudaher; those
voting No none.

It was moved by Commissioner Staudaher, seconded by Commissioner SediVY, that
the resolution be passed and adopted and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Swanson. Commissioner staudaher and
Commissioner Sedivy; those voting No. none.

It was moved by Commissioner Sedivy, seconded by Commissioner cltaudaher. that
the applications be approved and the Director of Finance be authorized to enter
the abatements on the tax records. The motion was carried by the following Aye
and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy, and
Commissioner Staudaher; those voting No, none.
Reques t -- Use of (PA) Equipment -- Mobile Ice Cream Unit (Anderson)
The re~uest of Miss Patricia Anderson for permission to use a public address
system in connection with the operation of her Mobile Ioe Cream Unit was placed
before the Commission. It was moved by Commissioner Staudeher. seconded by Commis-
sioner Sedivy. that the request be granted and Miss Anderson be advised approval
was given contingent upon her discretionary use of the sound equipment and that at
any time sufficient complaint is registered in regard to the use of this equip-
ment, she wili be directed to cease its operation. The motion was carried by the
fO.ilowing Aye and No vote: those voting Aye being Mayor Swanson. Commissioner
Staudaher and Commissioner Sedivy; those voting No. none. I
Report of Training -- Studen t Sta tus. Bil1in~s Fire Department
Captain Jack Huber appeared before the ~ommisslon to report on the training
he received at the Billings Fire Department under a student status during the week
of November 27th. Mr. Huber enumerated a number of the fields of fire fighting
he participated in during the period and placed particular emphasis on the instr-
uction he received in investigation methods being employed by the Biilings Fire
Department in ascertaining the causes of individual fires.
Commissioner Sedivy moved that the report be approved and Captain Huber be
commended for his report. The motion was seoonded by Commissioner Staudaher and
carried by the following Aye and No vote: those voting Aye being Mayor Swanson,
Commissioner Sedivy and Commissioner Staudaher; those voting No, none.
Replacement of Driveway Approach -- (Review)
I The City Manager advised the Commission that a controversy had arisen over
the replacement of a portion of sidewalk at the Ohort Street entrance to the Norine
Motor Company on the Wilbur Smith property. Under an arrangemen t made wi th the
property owner. similar to those made in a number of instances in other north
side dis tricts, the Ci ty, although under no obligation to do so. had removed a
portion of the sidewalk to permit the owner, at hin expense. to replace and slope
the driveway to the curb. The Manager reported replacement of the sidewalk had
not been made and the tenant oomplainant continues to insist such replacement is
the responsibility of the City and not of the owner. With the matter reaching a
oomplete impasse, the Manager advised the Commission both the tenant and the pro~
perty owner had been invited to attend this meeting of the Commission to take
par t. if they cared to do so. in a full review of the case. Wher:. neither the
owner nor the tenant appeared, the Manager made a full report of the case, inolud~
ing written reports from the City Engineer and from the Project Engineer for the
pavement construction, and requested instruotions from the Commission for a
I settlement to the controversy.
After due consideration by the Commission. it was moved by Commissioner Sedivy.
seconded by Commissioner Staudaher. that replacement of that portion of the side-
walk in question be held to be the responsibility of the property owner and at his
expense and that the City Manager be authorized and directed to initiate the pro-
per legal procedure under the provisions of Section 8.36 of the Bozeman Municipal
Code for notifying the owner of this deoision and the necessity for his replace-
ment of the sidewalk without further delay. The motion was carried by the follOW~

and Commissioner Staudaher; those voting No, none.

of the Librarian indicates a material increase in patronage 4t the library above
a like period in 1960. He recommended that the reports be approved. It was moved
by CommiSSioner Staudaher. seconded by Commissioner SediVY. that the reports be

The City Manager stated he had audited the claims and found them to be true
and lawful claims against the City of Bozeman and recommended that they be approved
and warrants issued for payment. After examination of the claims in detail and
cheoking against the claim register, it was moved by Commissioner Sedivy, seoonded
by Commissioner Staudaner, that ail claims be approved and the motion was carried
by the following Aye and No vote: those voting Aye being Mayor Swanson. Commis-
sioner Sedivy and Commissioner Staudaher; those voting No, none.
Adjournment
There being no further business to come before the Commission at this time
it was moved by Commissioner SediVY. seoonded by Commissioner Staudaher, tha t the I
