The Commission of the City of Bozeman met in regular session in the Commis.
sion Room. City Hall Building, Wednesday. December 13. 1961 at l:UO o'clock P.M.
Present were Mayor Swanson, Commissioner Staudaher, Commissioner Sedivy, City
I Manager Cutting, City Attorney Berg, Ass't. City Man~ger Fryslie and the Clerk.
The following proceedings were had:
Minutes of the last regular session were read and it was moved by Commis.

read and the motion was carried by the following Aye and No vote: those vo ting
Aye being Mayor Swanson. Commissioner Staudaner and Com.missioner Sedivy; those
vo ting No, none.
Petition -- Special Improvement Lighting District (South Black Ave.)
The petition to create a special improvement li~hting district on a portion
of Sou th Black A venue wi thin the Springdell Addition was again pLaced before the

Commission. Tne City Manager stated tnat because of development in this area.

essentiaL. However, consideration shoUld be given to the relationship of this
requested district to a greater area under study. After it was brought out in
discussion that accomplishment of a ll:l.rger district could not materialize in time
to provide for the more immediate need of the petitioned district, it was moved

be directed to prepare a Resolution of Intention to create the district as peti-
tioned. The motion was carried by the fOllowing Aye and No vote: those voting

Purchase .. Addressing Machine
The City Manager reported that the 20 year old machine used in the general

mechanical condi tion tha t requires continued costly repairs wi thout any assurance
of reliability and requested approval of the purchase of a new machine at an
approximate cost of $3.000.UO. It was moved by Commissioner Sedivy, seconded by
Commissioner Staudaher, tha t the purchase be authorized and the Clerk of the Ci ty
Commission be directed to advertise for bids for the purchase of a machine of the
foregoing type for an opening date of January lu, 1~62. The motion was carried
by the following Aye and No vote: those voting Aye being Mayor Swanson, Commis-

Revision of Fire Insurance Plan & Coverage ,

The City Manager reported that a new plan for fire insurance coverage on City
owned buildlnf,s and their contents had been offered and recommended to the Ci ty
by the companies now carrying that insurance. The coverage would be based on the
estimated replacement cost of the proper ty. rather than the present method of
ca leu la ting the coverage on an appraised depreciated value. The Commission

discussed the plan at ~ength and it was then moved by Commiss loner Sedi vy-, seconded
by Commissioner 0taudaher, that the matter be tabled for further study until the
next regular meeting. December 20th. The motion was carried by the fo~lowing Aye
and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commis-
sioner Staudaher; those voting No, none.
Reports I
The fOLlowing reports for the month of November, 1961 were presented:

The City Manager cOlTlJ'Y1ented that the sizeabLe collections in the Cashier's
report reflected the payment of 1961 special assessments during the month of
November. He recommended that the reports be approved. It was moved by ComrT'iS-
sioner Staudaher, seconded by Commissioner SediVY, that the reports be approved
and ordered filed and the motion was oarried by the following Aye and No vote:
those voting Aye being Mayor Swanson, Commissioner Staudaner and Commissioner
Sedivy; those voting No, none.
Architects' Plans & Estimates -- City Building Program -- for Approval
During the Commission meeting held April 19th. 1961, an agreement between
the Housing and Home Finance Agenoy and the City of Bozeman for an advance of
$10.4UO.UO for preliminary planning for the proposed construction of a new city
hall and shop buildings (HHFA Project No. P-Mont. 3150, Contract No. H-602-l140)
was entered into by the Cit:-. In turn. the City entered into an agreement binding
the joint firm of Oswald Berg. Jr. & Associates, Architects and William E. Grabow, I
Archi teo t, to provide architectural services for the City's proposed building faci-
lities. The City Manager presented the preLiminary plans and cost estimates pre-
pared by the arohitects under the terms of the contract which had received tent-
use
ative or partial approvel for/in the August 29th and/or November 'lth eleotions.
More specifically, these preliminary plans and estimates were those for the General
Shop Building and the Park-Cemetery Building used for the August 29th election and
those for the Administrative-Police-Fire building used for the November 'lth election.
It was recommended that these preLiminary plans and estimates be approved and their
submission to HHFA with a request for payment of the architectural fee involved
au thorized . It was moved by Commissioner SediVY, seoonded by Commissioner Staudaher.

City Hall -- Move Corr,"ission Chamber to Present Courtroom I
The City Manager reported that, as a result of the recent rejection of the
proposed City Building Facilities Program by the Voters and the continuing need to
relieve the oongested and unsatisfactory working conditions in the City Hall gen-
eral offices, consideration should be given to holding future meetings of the City
Commission in the Courtroom so that the present meeting room could be fully occupied
and utilized for day to day operations. The Mana~er stated further that in order
to provide for the Commission Meetings. the Courtroom would need to be reconditioned

and provided with adaquate light and furniture. The meeting was recessed to
inspect the present condition of the Courtroom and was again convened at 3:40 P.~.
It was moved by Commissioner Staudaher, seconded by Mayor ~wanson, tha t after the
Courtroom had been reconditioned and adequateiY lighted and furnished, the Comnis"
sion Meetings be held in that room, con tingen t upon the prior approval by the
I Commission of any expenditures contemplated for the reconditioning and furnishing
of the Courtroom. The motion was carried by the fOilowing Aye and No vote: those
voting Aye being Mayor Swanson. Commissioner Staudaner and Commissioner Sedivy;
those voting No, none.
Fire Departmen t -- Availability of New Location
The City Manager, Fire Chief Penttl1a and Fire Ca1Jtaln Huber discussed with
the Commission the availability of a new location for the equipment and personell
of the department and, also. pOSSibilities of relnforcinr or adding to the pre"
sent Fire Hall. However, the Manager informed the Commission that funds for such
relocation or construction could not be made available until after July 1, 1962,
and study of these problems would continue in the mean time.
Adjournment
There being no further business to come before the Commission at this time
it was moved by Commissioner Sedivy, seconded by Commissioner Staudaner, tha t the
meeting adjourn and the motion was carried by the following Aye and No vote:
