COMMISSION RESOLUTION NO. 3878
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, EXPANDING THE BUSINESS IMPROVEMENT DISTRICT IN THE
CITY'S DOWNTOWN AREA.
WHEREAS, pursuant to Title 7, Chapter 12, Part 11, Montana Code Annotated, the City of
Bozeman is authorized to create and expand business improvement districts; and
WHEREAS, on the 3rd day of October 2005, the City Commission acknowledged receipt of
a petition requesting expansion of the business improvement district; and
WHEREAS, said petition contained the signatures of owners of more than 60 percent of the
area of the property to be included in the district; and
WHEREAS, on the 17th day of October 2005, the Commission adopted Commission Resolution
No. 3870, stating its intention to expand the Business Improvement District; and
WHEREAS, the notice was duly published and copies of the notice were duly mailed to owners
of real property within the proposed district, in accordance with Section 7-12-1112, Montana Code
Annotated; and
WHEREAS, on the 21 st day of November 2005, the Commission conducted a public hearing
on intention to expand the Business Improvement District; and
WHEREAS, one protest was received, either in writing prior to the public hearing or during the
public hearing.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana:
Section 1
The City Commission ofthe City of Bozeman expands the Business Improvement District which
will serve a public use, and promote the health, safety, prosperity, security and general welfare of the
inhabitants thereof. The purpose of the Business Improvement District is to improve retail marketing in
the district, promote private investment and business expansion in this district, the general management
of the district, and such other functions as are authorized by, and necessary to carry out the purposes
of, Section 7-12-1102, Montana Code Annotated.
Section 2
The boundaries of the district, as set forth in Exhibit "A", attached hereto, shall be as follows:
Beginning at the intersection of the centerline of West Mendenhall Street and North
Grand Avenue; thence northward 'Y:2 block to the intersection of alleyway and North
Grand Avenue; thence eastward along the centerline of the alleyway to the centerline
of North Tracy Avenue; thence north along the centerline to the intersection of North
Tracy Avenue and Lamme Street; thence eastward to the intersection of North Black
Avenue and East Lamme Street; thence southward 'Y:2 block to the alleyway and
South Black Avenue; thence eastward along the centerline of the alleyway to the west
property boundary of the City of Bozeman Library parking lot; thence north along the
west side property boundary to the centerline of East Lamme Street; thence eastward
to the intersection of East Lamme Street and North Rouse Avenue; thence south to
the intersection of East Mendenhall Street and North Rouse Avenue; thence eastward
along the centerline of East Mendenhall Street to the intersection of East Mendenhall
Street and North Wallace Avenue; thence south along the centerline of Wallace
Avenue to the alleyway 'Y:2 block south of East Main Street on South Wallace Avenue;
thence westward along the centerline of the alleyway to the eastern property
boundary of the parking lot (c/o Moosepoint LP); thence southward along the eastern
property boundary of said parking lot to the centerline of East Babcock Street; thence
westward along the centerline of Babcock Street to the intersection of West Babcock
Street and the extension of the western property boundary of First Interstate Bank
(c/o Cowdrey LLC); thence northward along the entire western property boundary of
First Interstate Bank to the centerline of West Main Street; thence westward to the
intersection of West Main Street and Third Avenue; thence northward to the
intersection of West Mendenhall Street and North Third Avenue; thence eastward to
the point of beginning, excluding those properties whose ownerShip is held on
September 4, 2004, by government entities, by non-profit owners having section
501 (c)3 IRS status, and properties whose primary use is considered residential under
the Bozeman zone code.
Section 3
The duration of the expanded business improvement district shall be ten (10) years from the
date of the original district's creation.
PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a
regular session thereof held on the 5th day of December
