HomeMy WebLinkAbout1966-09-07 420 Bozeman, Montana 7 September 1966 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, 7 September 1966, at l:OO o'clock P. M. Present were Mayor Sedivy, Commissioner Morrow, Commissioner Langohr, City Manager Cutting, Ass't City Manager Fryslie, City Attorney Berg and the Clerk. Commissioner Langohr opened the meeting with a prayer and the following proceedings were had: Minutes of the last regular session held Wednesday, 31 August 1966, were read and it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the minutes be approved as read and the motion was carried by the following Aye and No,vote: those voting Aye being Comm~ issioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Authorization to attend Hontana Municipal League Convention - Roundup, 8-l0 September 1966: ~ Commission and City Hanager It was reported the Montana Municipal League has scheduled a convention to be held 8-10 September 1966 at Roundup, Montana and the City Manager recommended that members of the City Commission and the City Manager be authorized to attend the Convention and that Harold A. Frys1ie, Ass't City Manager, be designated to perform the duties of the City Manager during this period. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the authorization for the officials cited to attend the convention be granted as recommended and, it being in the public interest, the expenses incurred be paid from the General Fund and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. Contract for 1966 Sidewalks - W. D. Howells: Documents for execution Walks and Curbs: The contract documents for the construction of Walks and Curbs, as awarded to W. D. Howells, Bozeman, Montana, on 3 August 1966 was presented. The contracts and bonds were approved as to form by the City Attorney and it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the Mayor and the Clerk of the Commission be authorized to sign the contract for the City of Bozeman, that W. D. Howells be authorized to proceed on the construction of the Walks and Curbs, that the bid security in the amount of $200.00 be returned to Mr. W. D. Howells and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Comm~ issioner Langohr and Mayor Sedivy; those voting No, none. Hearing Resolution No. 1296 - Authorizing 1966 Garbage Assessment for final passage: This was the time and place set for hearing on levying assessment for the collection and disposal of garbage for the year 1966 in the amount of $63,304.55. Affidavit of publication of Notice was presented. No one was present to protest and no written protests having been filed, Resolution No. l296 was presented for final passage. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the resolution be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow, and Mayor Sedivy; those voting No, non~. Hearing Resolution No. 1297 ~ Authorizing 1966 Street Sprinkling Assessment for final passage. This was the time and place set for public hearing on levying assessment for street sprinkling and cleaning for the year 1966 in the amount of $3,559.68. Affidavit of Publication of Notice was presented. No one was present to protest and no written protests having been filed, Resolution No. l297 as presented for final passage at the meeting of 3l August 1966 was presented for final passage. License Bond Continuation - Electrician George Norman, Belgrade: 1 In compliance with Chapter 15 of the Bozeman Municipal Code, a Certificate of Continuation of the Electrical Bond of George Norman, Belgrade, was presented. The City Manager stated the Building Inspector had recommended approval of the Certificate approved as to form by the City Attorney. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the aforementioned bond be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. Consideration of a Vacation for the Clerk of the City Commission 12-26 September 1966: The Clerk of the City Commission has requested that she be granted vacation leave of absence from l2-26 September 1966, and the City Manager recommended the leave be approved. It was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the above request be granted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Commission Resolution No. 1298 - Levying Assessment for SID No. 454 East Main Street: Resolution No. l298 levying assessment for the construction of Special Improvement District No. 454 in the amount of $26,984.58 was presented. COMMISSION RESOLUTION NO. 1298 I A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 454 IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND MAKING THE IMPROVEMENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 454. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the resolution be provisionally passed and adopted and l4 September 1966 be set as the date for public hearing and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. Reports for August: The following reports were presented for August: Water Collector Police Chief Fire Chief The City Manager commented on the reports and recommended their approval. It was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the reports be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Comm- issioner Langohr and Mayor Sedivy; those voting No, none. Claims for August: 1 Claim No's. 6045 - 6338 inclusive were presented on the various funds as follows: $24,501. 82 7,5l7.l9 12,220.41 4,715.69 2,961. 94 38.60 9,151.49 3,831.89 Band Garbage Parking Meter Police Reserve Cemetery Susp. Library Planning Board Park Cemetery Total $167,039.17 The City Manager commented on the claims and found them to be true and lawful claims against the City of Bozeman and recommended they be approved and the Director of Finance be directed to issue warrants in payment. After examination of the claims in detail and checking against the 421 422 claim register, it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the claims be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. Retirement - Chief of Police C. V. Saunders: A letter dated 1 September 1966 from Chief of Police C. V. Saunders addressed to the City Manager and requesting that he be passed from the active Police Force to the Police Reserve in accordance with the provision of Montana Law, was presented and, upon the recommendation of the City Manager, the Commission meeting was recessed to permit the Board of Trustees of the Police Reserve Fund to meet to consider Chief Saunde~' request, as required by law. The Board of Trustees of the Police Reserve Fund did meet, as reflected by the minutes of that board, and upon the meeting of the City Commission being reconvened, the written recommendation of the Board of Trustees that the request of Chief Saunders to be passed to the Police Reserve be granted, was presented. The City Manager paid tribute to Chief Saunders and in turn recommended that his request be granted. Mayor Sedivy, Commissioner Morrow, Commissioner Langohr and City Attorney Ben Berg, in turn paid high tribute to Chief Saunders for the outstanding service he has rendered to the City of Bozeman and for the excellence of the Police Department that he has maintained. It was then moved by Commissioner Morrow, seconded by Commissioner Langohr, that Chief of Police C. V. Saunders be passed from the active Police Force to the Police Reserve in accordance with his request and the motion was carried by the following Aye and No vote; those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none.
