HomeMy WebLinkAbout1966-10-05 434 Bozeman, ])lontana 5 October 1966 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, 5 October 1966, at l:OO o'clock p.m. Present were Mayor Sedivy, Commissioner Morrow, Commissioner Langohr, City Manager Cutting, Ass't City Manager Fryslie, Acting City Attorney O'Connell and the Clerk. Commissioner Langohr opened the meeting with a prayer and the following proceedings were had: 1 Minutes of the regular session held Wednesday, 28 September 1966, were read and it was moved by Commissioner Morrow, seconded by Mayor Sedivy, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner MOrrow and Mayor Sedivy; those voting No, none. Hearing .:lesolution No. 1299 - Authorizing 1966 Street Lighting Districts: This was the time and place set for public hearing on levying assessment for Street Lighting for the year 1966 in the amount of $l3,ll9.93. Affidavit of Publication of Notice waS presented. No one was present to protest and no protests haveing been filed, Resolution No. l299, provisionally passed and adopted at the regular session held 28 September 1966, was presented for final passage. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the resolution be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. Affidavit of publication of Notice was presented. No one was present 1 to protest and no protests haveing been filed, Resolution No. 1300, provisionally passed and adopted at the regular session held 28 September 1966, was presented for final passage. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Morrow, seconded by Comm- issioner Langohr. that the resolution be finally passed and adopted, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Resolution No. 1301 - Levy Assessment for SID No. 457 - Sewer for final passage: This was the time and place set for hearing protests to levying assessment for Special Improve- ment District No. 457. Affidavit of publication of Notice was presented. No one was present to protest and no protests having been filed, resolution No. 1301 provisionally passed and adopted at the regular session held 28 September 1966, was presented for final passage. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the resolution be finally passed and adopted, and the motion WaS carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the resolution be finally passed and adopted, and the motion was carried by the following Aye and No vote: those voting Aye Being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. 1 I 1 Special Tax Levy - Resolution No. 1303 - SID No. 42L, North Side Paving (1962): Resolution No. 1303 levying assessment for the construction of Special Improvement District No. 424 in the amount of $297,611.82 was presented, entitled: COMMISSION RESOLUTION NO. l303 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 424 IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DE- FRAY THE COST OF CONSTRUCTING AND MAKING THE IMPROVEMENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 424. Special Tax Levy - Reso lution No. 1304 - SID No. L,65 North 18th & Beall St. Paving - Resolution No. l304 levying assessment for the construction of Special Improvement District No. 465 in the amount of $23,423.82 was presented, entitled: COMMISSION RESOLUTION NO. 1304 A RESOLUTION OF THE COMMIFFION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 465 IN THE CITY OF BOZEMAN, MONTANA, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND MAKING THE IMPROVEMENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 465. It was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the resolution be provisionally passed and adopted and Wednesday, l3 October 1966, be set as the date for public hearing and the motion was carried by the following Aye and No vote: those voting Aye being Comm- issioner Morrow, Commissioner Langorh and Mayor Sedivy; those voting No, none. Special Tax Levy - Resolution No. 1305 - SID No. 466 West Beall St. Paving - Estimate: Resolution No. l305 levying assessment for the construction of Special Improvement District No. 466 in the estimated amount of $31,000.OO was presented, entitled: COMMISSION RESOLUTION NO. 1305 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 466 IN THE CITY 0 OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND MAKING THE IMPROVEMENTS WITHIN SAID SPECIAL IMPROVEMENTS DISTRICT NO. 466. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the resolution be provisionally passed and adopted and Wednesday~ l3 October 1966, be set as the date for public hearing and the motion was carried by the following Aye and No vote: those voting Aye being Comm- issioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. Release of Roof Repair Obligation: John Mansville Corporation: A letter received from the City's Architect, oswald Berg, Jr. recommending that the Johns- Manville Sales Corporation, having completed the repair of the roofing at the new Municipal Building, be released from its bonded obligation was presented. The Johns9Manville Sales Corporation will issue a new standard roofing bond whereby they will remain liable to the City as provided in that bond. The City Manager concurred in the recommendation of the Architect and it was moved by Commissioner MorroW, seconded by Commissioner Langohr, that Johns-Manville be released from their obligation and that the Mayor and the Clerk of the City Commission be authorized and directed to sign the release on behalf of the City and the motion was carried by the following Aye and No vote: those Voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. 4:t-t:; 436 H.csolution No. 1306 SID No. ,~,68 fixing date Naturi ty date and amount of Bond: Resolution No. 1306 authorizing the issuance of bonds of Special Improvement District No. 468 was presented, entitled: COMMISSION RESOLUTION NO. l306 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN FIXING THE DATE, MATURITY DATE AND THE PRINCIPAL AMOUNT OF BONDS TO BE ISSUED IN SPECIAL IMPROVEMENT DISTRICT NO. 468. 1 It was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the resolution be passed and adopted, and the motion was carried by the following Aye and No vote; those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Authority to purchase Parking Meters for lTJones" lot - I:J+ meters $Lrl8.00 and 2L, months (1 $88.00 per Ho.: The City has need for an additional supply of parking meters for the "Jones" lot on the corner of North Willson Avenue and West Mendenhall Street owned by the City of Bozeman, and the City Manager requested authority to purchase 4/. parking meters from the Rockwell Company on the basis of $418.00 down and a payment of $88.00 per month for twenty-four months. It was moved by Commissioner Langohr, seconded by Conunissioner Morrow, that the purchase of the new parking meters as requested be authori- zed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No. none. Authority to hold "Pancakcll Breakfast Saturday, 8 October 1966, Khnmis Club: A request from the Kiwanis club for permission to hold a "Pancake" Breakfast on Saturday, 8 October 1966, from 7:00 o'clock A.M., to 7:00 o'clock p.m. at the American Legion Hall was presented. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the above request be granted, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. Mayor's Proclarnation: Fire prevention '-leek 9-l5 Octob~r 1966, Fire Dept. Breakfast; 10 Oct. : Mayor Edmund P. Sedivy issued a proclamation designating the week of 9-15 October as "Fire Prevention Week". The Fire Chief reported a breakfas t will be served at the Bozeman Fire Hall on Monday, lO October 1966, from 7:00 to lO:OO o'clock A.M. to kick off the annual Fire Prevention Week activities and the public is invited. The City Fire Department has also scheduled its usual program for the entire week. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the Mayor's Proclamation and the program of the Fire Department be approved, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner MorroW, Conwissioner Langohr and Mayor Sedivy; those voting No, none. Request to hold Bozeman Senior High School Homecoming parade: Saturday 8 October - 11:00 A.H.: A written request from Jim Walters, Student Body President of Bozeman Senior High School for permission to conduct a Homecoming Parade on 8 October 1966, at 11:00 o'clock A.M. was presented. The parade route will start at Bogart's Grove, proceed north on Church to Main Street and west on Main Street to the Senior High School. It was moved by Commissioner Langohr, seconded by Commiss- ioner MorroW, that permission to stage the parade be granted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. 437 438 Contract Documents: R. J. Studer & Sons: SID No. 11-69 Paving - North 15th and 16th and Beall: The contract documents for the construction of street paving on Special Improvement District No. 469 as awarded to R. J. Studer & Sons, Billings, Montana, on 14 September 1966, was presented. The contracts and bonds were approved as to form by the City Attorney, and it was moved by Comm- issioner Morrow, seconded by Commissioner Langohr, that R. J. Studer & Sons be authorized to pro- ceed on the construction of the street pavement in Special Improvement District No. 469 and the 1 pledge for bid security be returned, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. After examination of the claims in detail and checking against the claim register, it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the claims be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none.
