HomeMy WebLinkAbout1966-10-13 , 1 1 1 Bozeman, ~'1ontana 13 October 1966 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, 13 October 1966, at 1:00 o'clock p.m. Present were Mayor Sedivy, Commissioner Morrow, Commissioner Langohr, City Manager Cutting, Ass't City Manager Fryslie, City Attorney Berg and the Clerk. Commissioner Morrow opened the meeting with a prayer and the following proceedings were had: Minutes of the regular session held Wednesday, 5 October 1966, were read and it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. Removal of fence on Cherry D.,"ive - pasturing horses: Mazanic & Nord tved t: Mr. & Mrs. Bernard Mazanic - 1220 Cherry Drive, Mr. Edwin J. Mazanic - 708 South Eighth Avenue, D" Kenneth Nord tved t, Jr., - 1222 Cherry Drive and Attorney Eugene Brown representing the above clients appearted before the Commission to inquire as to the removal of a barbwire fence built by Donald Strang for the purpose of pasturing horses behind his property on 1320 Cherry Drive and ad- joining their property on land belonging to the City dedicated as City Park. It was reported that Mr. Strang had been given permission to build the fence with the thought in mind that grazing the land would give the property owners in that area some protection against grass fires as well as assisting Mr. Strang by providing pasture for his horses. Following a thorough discussion on the area involved, it was moved by Commissioner Langohr, seconded by Comm- issioner Morrow, that the above reques t be tabled for a period of one week in order that all parties concerned may be contacted and a more thorough investigation made and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. Jack Lovelace and Lyman H. Bennett: Frank Swanson - Montana Motor Supply: Mr. Frank Swanson, Jack Lovelace and Lyman H. Bennett appeared before the Commission to request the removal or relocation of one parking meter on West Babcock Street in the area which adjoins the parking lot leased by Montana Motor Supply in order to permit a driveway to accomodate the traffic moving in and out of the parking lot. Mr. Swanson explained that if the meter was moved ~ back to the east it would allow them to construct a thirty foot driveway which would be sufficient to serve their parking lot. A Thorough discussion followed, and it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the request be granted and the City Engineer and Acting Police Chief be instructed to inspect the area involved and work out a satisfactory curb opening to permit a driveway as requested by the Montana Motor Supply and the motion was carried by the following Aye and No vote; those voting Aye being Commissioner MorroW, Commissioner Langohr and Mayor Sedivy; those voting No, none. Jack Stover and Bob VanEpps - Nolly Brown: Jack Stover and Bob Van Epps of the Molly Brown were present to discuss the continued complaints of excessive noise at that establishement received from several property owners in that area. Mr. Stover explained he had tried in many ways to cut down the noise by changing the door to the North- west corner and by closing the windows and asking the music to quiet the amplifiers. He informed the Commission that he would continue his efforts to cooperate with the City and make a further attempt 439 440 to moderate the live music. The City Commission thanked Mr. St~ver for attending the meeting and his continued cooperation in this matter although the City Attorney cautioned Mr. Stover that con- tinued complaints could lead to legal action. I-layor's Proc;lamation: "Rnd Heart Tag Day" Saturday 22 October 1966 - Women of the Moose: A request from the ladies of the Moose for the Mayor to proclaim Saturday, 22 October 1966" as 1 "Red Heart Tag Day" in the City of Bozeman for the benefit of crippled children was presented. The City Commission concurred in the recommendation of the City Manager, and it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the Mayor proclaim Saturday, 22 October 1966, as "Red Heart Tag Day" and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. Hearing Resolution No. 1303 - SID No. L:.24 Northside paving - for Final Passage: This was the time and place set for hearing protests to levy;l.ngassesstpent for Special Improvement I District No. 424. Affidavit of publication of Notice was presented. No one was present to protest and no protests having been filed, Resolution No. 1303, provisionally passed and adopted at the regular session held 5 October 1966, was presented for final passage. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the resolution be finally passed and adopted, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Hearing Resolution No. 130!+ - SID No. !j,65 North l8th & Beall Pav ing - For Final Passage: This was the time and place set for hearing protests to levying assessment for Special Improvement District No. 465. Affidavit of publication of Notice was presented. No one was present to protest I and no protests having been filed, Resolution No. 1304, provisionally passed and adopted at the regular session held 5 October 1966, was presented for final passage. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the resolution be finally passed and adopted, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. , Hearing Resolution No. 1305 - Sid No. !166 West Beall Paving - Estimated pa~~~ This was the time and place set for hearing protests to levying assessment for Sp~cial Improvement District No. 466. Affidavit of publication of Notice was presented. No one was present to protest and no protests having been filed, Resolution No. 1305, provisionally passed and adopted at the regular' session held 5 October 1966, was presented for final passage. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the resolution be finally passed and adopted, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Petition for Sanitary Sewer on West Babcock Street., 11th to 15th Avenue: A petition to create a Special Improvement District for the construction of a Sanitary Sewer Lateral on West Baboock Street between South lith Avenue and South l5th Avenue, signed by six of the 1 property owners involved, was presented to the City Commission. The City Manager recommended that it being in the public interest, the City Engineer be instructed to ascertain Districk boundaries for participation and the City Attorney be directed to prepare a resolution of intention to create the District. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the foregoing action as recommended by the City Manager be approved and the district initiated. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. 1 1 1 441 Change-Order No.2: to improve dra'nage etc., Federal Building Street Hidening: The Change-order on the Street Improvements at the Federal Building Site, Bozeman, Montana, prepared by Thomas, Dean and Hoskins, Inc., to become a part of the original contract for construction of improvements in the project described was presented as follows: Street improvements at Federal Building Site: Removal of concrete ramp at driveways on the North side of Babcock street between South Tracy Avenue and South Black Avenue, and re- moval and replacement of asphalt concrete. Cost - - $600.00 The City Manager concurred with the Engineer and recommended the Change-order No. 2 be accepted and approved as presented. It was moved by Commissioner Morrow seconded by Commissioner Langohr, that the Change-order be approved and that the Mayor and the Clerk of the Commission be authorized to sign for the City and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Hontana State University Homecoming Parade Saturday, 22 October 1966 - 10:00 o'clock A.H.: A request from the Montana State University to stage its annual Homecoming Parade Saturday, 22 October 1966, at lO:OO o'clock A.M. was presented. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that permission to stage the parade as requested be granted, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. Reports for September (Cont'd.): The following reports were presented as follows: Disposal Plant Operator Police Judge Water Collector Building Inspector Cemetery Cashier the City Manager commented on the reports and recommended their approval. I t was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the reports be approved, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Claims (Continued): Claim No's 665l - 6652 Inclusive, 6657-6660 inclusive was presented on the various funds as follows: General Garbage P. Meter $769.93 21.90 600.00 23.88 $~,675.40 $ 37,091.11 Street SID's Total The City Manager commented on the claims and found them to be true and correct claims against the City of Bozeman and recommended they be approved and the Director of Finance be directed to issue warrants in payment. After examination of the claims in detail and checking against the claim register, it was moved by COTImlissioner Langohr, seconded by Commissioner Morrow, that the claims be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none.
