The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday, 9 November 1966, at 1:00 o'clock p.m. Present were Mayor Sedivy, Commissioner
Morrow, Commissioner Langohr, City Manager Cutti.ng, Ass't City !manager Frys1ie, City Attorney Berg
and the Clerk.
Commissioner Langohr opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular session held Wednesday, 2 November 1966, were read and it was moved by
Commissioner Morrow, seconded by Commissioner Langohr, that the minutes be approved as read and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow,
Commissioner Langohr and Mayor Sedivy; those voting No, none.
Request to have Car~liva1: Lion's Club (West CoastShows) l(i,-18 June 1967:
A request from Mr. B. G. Nordling, President of the Bozeman Lions Club to reserve the dates of
June 14 to June l8, 1967 for the presentation of the West Coast Shows Carnival was presented. It was
moved by Commissioner Langohr, seconded by Commissioner Morrow, that the Lions Club request be approved
with license fee consideration as a charitable project and that the Commission reserve the right to
consider other performances that may be held in Bozeman before 15 July 1967, when deemed to be in
the public interest even though they might be considered in conflict with the above request and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr,
Commissioner Morrow and Mayor Sedivy; those voting No, none.

Notice has been received of the annual meeting of the Middle Creek Water Users' Association to
be held on Monday, If.t November 1966, at 2:00 o'clock P.M. It was moved by Commissioner Langohr,
seconded by Commissioner Morrow, that Ass' t. City Manager Pryslie be designated as the official re-
presentative of the City of Bozeman at this meeting and authorized to vote the stock of the City of
Bozeman, and the motion was carried by the following Aye and No vote: those voting Aye being Comm-
issioner Langohr, COITmlissioner Morrow and Mayor Sedivy; those voting No, none.

Mr. Don Nell representing himself to be the option owner of the property appeared to request
that the City vacate the alleys in Block 3, Springbrook Addition on West Main Street between North
Ninth and North Tenth Avenue. He explained this location would be for a proposed building and a
parking lot encompassing the entire block. After thoroughly discussing the above proposal, it was
moved by CommisRioner Morrow, seconded by Commissioner Langohr, that they a~ree to vacate the alleys
in Block 3, Springbrook Addition on West Main Street between North Ninth Avenue and North Tenth
Avenue with the understanding that the entire block remain under signle unit development and if at
any time this property is othen7ise developed, the alleys would then revert back to their present
status and that the City Attorney be instructed to draw up the necessary legal papers for initiating
action to vacate the alleys and the motion was carried by the following Aye and No vote: thos0 vcting

Petition - Lighting Dis tric t North 3rd, 4th" 5th, and 6th bet~leen H. 1~Iendenhall and I-J. Pe":Kh Street:
Mr. C, Mrs. L. R. Hoogson of 418 North Fourth Avenue Here present to oppose the erection of a,
proposed Street Lighting District on North Third, North Fourth, North Fifth and North Sixth Avenue

unity to sign. Mr. and Mrs. Hodgson Here informeCl that no official action in respect to this district
had been taken by the Commission and they were assured by the Commission that in the event the petitions
requesting the street lighting are received, both pro and con petitioners will be given full consider-
ation before any action is taken in regard to the creation of the subject Special Improvement
Lighting District.

Mr. Guy Sperry Manager of the Bozeman Chamber of Commerce was present to discuss additional
Christmas Street decorations on Main Street and North Seventh Avenue. He explained that a suggestion
had been made to attach two "live" evergreen trees to each street light pole on Main Street and
North Seventh Avenue. These trees would be banded to the sides of the pole at ground level. It was
moved by Commissioner Langohr, seconded by Commissioner Morrow, that this authority be granted after
checkinp; with the Po lice Department and the Fire Departmen t as to locations. They "lOuld also be
required to acquire clearance from the Montana Power Company in regard to the company owned poles
on North Seventh Avenue. The motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none.
John Handeville and Guy Sperry_- Rural }'ire District:
John Mandeville Chairman of the Chambers Rural Fire District Committee and Guy Sperry of the
Chamber of COTImlerCe were present to discuss the formation of a Rural Dire District in the suburban
area of Bozeman. Mr. Mandeville explained that they have not had the necessary cooperation from the
rurala rea for any accomplishment. As long as the City of Bozeman Fire Department is going out to
the rural areas, these property owners are not too concerned about having a Rural Fire Protection
District. In discussing the proposed fire district, it was believed that it would be advantageous
to have a cutoff date for the Fire Department to leave the City limits. It was moved by Commissioner
Morrow, seconded by Commissioner Langohr, that the City Manager be instructed to fully enforce, after
3l December 1967, that section of the Bozeman Municipal Code that prohibits the fire department from
going out of the City limits on a fire call and the motion was carried by the following Aye and No
vote: those voting Aye being Corrnnissioner Morrow, Corrnnissioner Langohr and Mayor Sedivy; those
voting No, none.

A request from the Ross Jensen Chapter of the De-Molays and Rainbow Girls to conduct their
annual houff! to house march or drive against Muscular Dystrophy on the night of Thursday, 17 November
1966, was presented. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that
permission to conduct the drive be granted and the motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Langohr, Conmlissioner Morrow and Mayor Sedivy: those
voting No, none.

The City Manager corrnnented on the reports and recommended their approval. It was moved by
Commissioner Morrow, seconded by Commissioner Langohr, that the reports be approved and the motion

ioner Langohr and Mayor Sedivy; those voting No, none.

The City Manager commented on the claims and found them to be true and lawful claims against
the City of Bozeman and recommended that they be approved and the Director of Finance be directed
to issue warrants in payment. After examination of the claims in detail and checking against the
claim register, it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the
claims be approved and the motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Langohr, Commissioner Morrmv and Mayor Sedivy; those voting No, none.
Ad journrnent:
There being no further business to come before the Commission at this time, it was moved
by Commissioner Mtirrow, seconded by Commissioner Langohr, that the meeting be adjourned and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow
Commissioner Langohr, and Mayor Sedivy; those voting No, none.
