SUBJECT: Approval of Resolution No. 4764, Adopting Specific Pollutant
Limits for Industrial Contributions into the City’s Wastewater
Collection and Treatment System.

RECOMMENDATION: Approve Resolution No. 4764, adopting specific pollutant limits for
industrial contributions into the City’s Wastewater Collection and Treatment System.
BACKGROUND: Ordinance No. 1923 amends the Bozeman Municipal Code to comply with all
applicable state and federal laws required by the Clean Water Act and the General Pretreatment
Regulations. It provides that discharge limits for specific pollutants be established periodically by
Commission Resolution. The City has developed specific local limits on discharges to its
treatment works, as listed in the Table attached to the Resolution.
FISCAL EFFECTS: Proposed Resolution specifies requirements. Staff does not anticipate any
increase in compliance costs beyond what is currently required.
ALTERNATIVES: As suggested by the City Commission.

COMMISSION RESOLUTION NO. 4764
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA,
ADOPTING SPECIFIC POLLUTANT LIMITS, KNOWN AS “LOCAL LIMITS,” TO ENSURE
THAT INDUSTRIAL USERS COMPLY WITH THE PROHIBITIONS IN 40 C.F.R. SECTIOIN
403.5(a) AND (b).
WHEREAS, Chapter 40, Article 3, Division 3 of the Bozeman Municipal Code, Wastewater
Collection and Treatment System, sets forth requirements for direct and indirect contributors into the
City’s wastewater collection and treatment system and enables the City to comply with all applicable state
and federal laws required by the Clean Water Act of 1977 and the General Pretreatment Regulations (40
CFR, Part 403); and
WHEREAS, it is necessary to adopt new or revised provisions to implement and enforce a
pretreatment program that fulfills requirements set forth in the Code of Federal Regulations; and
WHEREAS, Section 40.03.1115 of the Bozeman Municipal Code provides that discharge limits
for specific pollutants be established periodically by Commission Resolution; and
WHEREAS, the City has developed specific local limits on discharges to its treatment works,
as listed in the attached Table.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana:
Section 1
That pursuant to Section 40.03.1115 of the Bozeman Municipal Code, it adopts the Bozeman 2016
Local Limits as the official pollutant limits of the City of Bozeman as follows:

Effective Date. This Resolution shall be in full force and effect on the effective date of Ordinance No.
1923.
PASSED AND APPROVED by the City Commission of the City of Bozeman, Montana, at a
regular session thereof held on the 23rd
