The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday, 1 March 1967, at 1:00 dclock p.m. Present were Mayor Sedivy, Commissioner
Morrow, Commissioner Langohr, City Manager Cutting, Ass't City Manager Fryslie, City Attorney
I Berg and the Clerk.
Commissioner Morrow opened the meeting with a prayer and the following proceedings were had:
Hinutes of the regular session held Thursday, 23 February 1967, were read and it was moved by
Commissioner Langohr, seconded by Commissioner Morrow that the minutes be approved as read and
the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr,
Commissioner Morrow and Mayor Sedivy; those voting No, none.

This was the time and place set for openeing bids on a 2~ ton dump truck for use by the Water
Department. The affidavit of publication of the "Call for Bids" was presented. I t was moved by
Commissioner Morrow, seconded by Commissioner Langohr, that the bids be opened and read and the motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner
Langohr and Mayor Sedivy; those voting No, none.
The following bids were opened and read:

Upon the request of the City Manager, the Commission directed that the bids be referred to the
City Engineer for checking and tabulation and for recommendation to be made to the Commission at its
next meeting, Wednesday, 8 March 1967.

This was the time and place set for public hearing on levying assessment for construction of
Special Improvement District No. 439 in the amount of $16,259.01. Affidavit of publication of
Notice was presented. No one was present to protest and no written protests having been filed,
Resolution No. 1316 was presented for final passage. It was moved by Commissioner Langohr, seconded
by Commissioner Morrow, that the resolution be finally passed and adopted and the motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow
and Mayor Sedivy; those voting No, none.

This was the time and place set for public hearing on levying assessment for construction of
Special Improvement District No. 424 in the amount of $306,578.82. Affidavit of publication of
I Notice was presented. No one was present to protest and no written protests having been filed,
Resolution No. 1317 wa~ presented for final passage. It was moved by Commissioner Morrow, seconded
by Commissioner Langohr, that the resolution be finally passed and adopted and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner
Langohr and Mayor Sedivy; those voting No, none.

Mrs. Thomas Morgan of 422 West Babcock, representing the Senior Citizens Club, the World War I
Veterans & Ladies Auxiliary and the Happy Homes Makers & Extension Club appeared before the Comm-
ission to present petitions signed by sixty-three members of the indicated organizations proposing
that the former Post Office Building be preserved and used as a City-County Public Library building. I
A thorough discussion followed and it was moved by Commissioner Langohr, seconded by Comm-
issioner Morrow, that the presentation of the petitions is hereby acknowledged and they will be
given full consideration before final action is taken and the motion was carried by the follBwing
Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy
those voting No, none.

Mrs. Thomas Morgan, Chairman of the Better Street Lighting Committee of the Bozeman Housekeepers
Club informed the Commission that they have $500.00 available for presentation to the City to assist
in installing street ligh type lights in Kirk Park when development plans have been complete.
Mayor Sedivy thanked Mrs. Thomas Morgan and the Bozeman Housekeepers Club for their generous
civic gesture and informed her that members of the Park department and the City Engineer are pro-
graming work to be done in Kirk Park and the Bozeman Housekeepers Club will be contacted in regard
to same as soon as all arrangements have been completed in th is regard.

This was the time and place set for public hearing on levying assessment for construction of Special
Improvement District No. 452 in the amount of $l6,859.83. Affidavit of publication of Notice was I
presented. The City Manager informed the Commission that there were no written protests filed. Mr.
Lyman Bennett, Attorney, on behalf of his client, Mr. Jack Lovelace, objected to the passage of this
resolution on this date stating it was felt that such action would compromise his clients position
at the hearing on litigation in regard to this district scheduled for Thursday, 2 March 1967. It
waS therefore moved by Commissioner Morrow, seconded by Commissioner Langohr, that the hearing on
this resolution be postponed until the next regular meeting, 8 March 1967, and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner
Langohr and Mayor Sedivy; those voting No, none.

A letter received from Mr. John J. Ahern of 1212 North Rouse Avenue, requesting authorization
to continue the operation of a fish bait business and the inauguration of the business of warehousing
and distributing Silver King Vacuum Cleaners as enterprises within the Industrial Aone of Bozeman
located at 1212 North Rouse Avenue were presented. Mr. Ahern also appeared before the Commission
in this regard
Following a discussion on Mr. Ahern's request to locate a mobile home at 1212 North Rouse, he
was informed that this was a matter for the consideration of the Board of Adjustment. I twas then I
moved by Commissioner Langohr, seconded by Commissioner Morrow, that the operation of the enter-
prises as stated above be approved and the motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No,
None.

It was reported that the "Major Case School" conducted by the Montana Law enforcement Academy

is scheduled to be held April 2nd thru the l4th, at Montana State University. Chief of Police
Benny Davis has requested authorization to submit the application of Officer George Jensen to attend the
"Major Case School." The City Manager recommended the submission of the application of the afore-
mentioned member of the Police Department be approved and submitted and if accepted, it being in
the public interest, the expenses of the student be charged against the general fund. I twas

City Manager be approved and the motion was carried by the following Aye and No vote: those voting

A letter addressed to the City Manager together with a proposed "Cooperative Agreement for
Stream Gaging in Bozeman Creek" to be entered into by the City of Bozeman, Montana, and the Fores t
Service for the establishment of a stream gaging station on Bozeman Creek was presented to the
Comnliss ion. Following a discussion of this Agreement and in concurrence with the recommendation
of the City Manager, it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that
the City of Bozeman enter into this "Cooperative Agreement for Stream Gaging in Bozeman Creek" with
the United States Forest Service in order to obtain valuable statistical stream-flow information
and that the Mayor and the Clerk of the City Commission be authorized and directed to sign the
Agreement and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Langohr, Commissioner Morrow and Mayor SedivYi those voting No, none.

I The Report of the Director of Finance was presented. The City Manager commented on the report
and recommended the approval thereof. It was moved by Commissioner Morrow, seconded by Commissioner
Langohr, that the report be approved and the motion was carried by the following Aye and No vote;
those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting
No, none.
