The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday, 8 March 1967, at 1:00 o'clock p.m. Present were Mayor Sedivy, Commissioner Mor-
row, Commissioner Langohr, City Manager Cutting, Ass't City Manager Fryslie and the clerk.
Commissioner Langohr opened the meeting with a prayer and the following proceedings were had: I
Minutes of the regular session held Wednesday, 1 March 1967, were read and it was moved by
Commissioner Morrow, seconded by Commissioner Langohr, that the minutes be approved as read and
the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow,
Commissioner Langohr and M&yor Sedivy; those voting No, none.

Mr. Richard Carlson of the Fleetways Equipment Rental, Inc., requesting authorization for the
location of the Truck Transport Terminal as an enterprise within the Industrial Zone of Bozeman loc-
ated at 1010 North Rouse Avenue was presented.
Following a discussion of Mr. Carlson's request, it was moved by Commissioner Langohr, seconded
by Commissioner Morrow, that the location of the Truck Transport Terminal, as an enterprise, be
approved as stated above and the application for a building permit will be referred to the Building
Inspector and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, None.

A Lease Agreement with the Tractor and Equipment Company of Billings providing for the rental I
of a new Caterpillar 977 Traxcavator previously discussed with the Commission as a replacement of
the present unit at the City Dump, for a period of six months at $1,000.00 per month, was presented.
"It was explained that at the expiration of this agreement a further arrangement will be made that
may be properly budgeted for the new fiscal period." It ,.,as moved by Commissioner Morrow, seconded
by Commissioner Langohr, that the Atreement be approved and the Mayor and the Clerk of the City Comm-
ission be authorized to sign the Agreement for the City and the motion was carried by the following
Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy;
those voting No, none.

A petition signed by Hale Hubbard, Roger B. Hough and LaMont Bair of the "Rambler Motel" and
"Topper" restaurant, requesting permission to develop offstreet parking in front of the Rambler Motel
in the area of the pres~ntly dedicated frontage road, bordering on North Seventh Avenue was presented.
Upon examination of the request, it was moved by Commissioner Langohr, seconded by Commissioner
Morrow, that the request be denied primarily because of the large amount of other area on the property
that could be developed for parking purposes and because of the undesirability of the destruction of
the landscaping now encroaching in the frontage road area and the motion was carried by the following I

A letter received from the Chief of Police announcing that Patrolman Larry Scott Ross, had
satisfactorily completed the required six months probationary period in the Bozeman Police Department
was presented. The City Manager announced that in accordance with the original action of the Police

Commission and in concurrence with the recommendation of Chief Davis, he had confirmed the appoint-

ment of patr.olman Ross as a member of the Police Department subject to the approval of the Commission.

of Patrolman Larry S. Ross be approved and the motion was carried by the follm~ing Aye and No vote:

Mr. Conrad Yerger appeared to discuss with the City Commission a plat entitled "Ponderosa
Mobile Home Subdivision". A copy of a letter addressed to the Board of County Commissioners by
Harold A. Fryslie, Secretary of the Bozeman City-County Planning Board was also presented. The
City-County Planning Board favorably recommended that the plat be approved subject to the satisfaction
of Park requirements. In accordance with this proceedure it was moved by Commissioner Langohr,
seconded by Commissioner Morrow, that action be deferred on this plat until the next regular meeting
on Wednesday, l5 March 1967, in order that the plat can be submitted to the Park Recreation Board
on Tuesday, l4 March 1967, for their recommendations relative to the park requirements and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr,
Commissioner Morrow and Mayor Sedivy; those voting No, none.

Commission Resolution No. 1318 providing for a Special Levy for SID No. 452 was again presented
for Commission consideration in accordance with the instructions of the Commission, that the hearing
on this resolution be continued to this date. Attorney Lyman Bennett Being present again on behalf
of his client, again objected to the Commissions consideration of this resolution at this time. It
I was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the hearing on Resolution
No. 1318, District No. 452 be continued until judgement has been entered by the District Court in
the Lovelace versus The City of Bozeman and the motion was carried by the following Aye and No vote:

Board appeared before the Commission to advise of their examination of applicants and recommendations
for the selection, of a Lieutenant and two Sergeants, as fo llows :

Gentlemen:
I The Civil Service Commission has met on the question of the recommendations for

appointment in the Police Department to the position of Police Lieutenant and Sergeant
and have conducted interviews with all candidates, examined all candidates' records,
in terviewed the Chief, Captain, and a short interview with the City Manager. We con=
sidered the interviews in the form of an examination together with the examination of the
jackets of each one of the men and after completion of the above we assigned the
following percentages to the following factors:
I Seniority - 40'70 Interview with candidate - 20%
Service Record - 25% Chief's interview - 15'70
(Seniority was considered on a non-interrupted basis.)
Based upon the above criteria we recommend the following officers be promoted:
Sgt. Dorman to Lieutenant
Officer Johnson to Sergeant
Officer McDowell to Sergean t

Following the offering of their recommendations, Joseph P. Gary speaking for himself and other
Board Members Robert L. Rampy and R. L. Bradford requested tha t, in the fu ture the Board not be re-
quested to make recommendations relative to promotions in rank of department personnel as they fee 1
the Chief of Police and City Manager are in a better position to make these appointments because
of their knowledge of the personalties, character and service record of the candidates.
The Commission highly commended the Civil Service Board members for their assistance in I
this recommendation. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that
the City Commission approve the proceedure outlined in the report from the Civil Service Board for
the promotion of the Lieutenant and Sergeants and refer the recommendations to the City Manager for
consideration and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none.

The Commission was referred to the opening of bids for the 2~ ton dump truck for use by the
Water Department on 1 March 1967. The bids having been analyzed, the City Manager concurred with
the City Engineer, recommending that the purchase be awarded to Rolfe and Wood of Bozeman, Montana
on the basis of their bid in the amount of $4,480.94 it being the lowest bid and equaling the speci-
fications as contained in the "Call for Bids". In concurrence with the recommendation of the City
Manager, it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the purchase
of the 2~ ton dump truck be awarded to Rolfe & Wood of Bozeman, Montana, as recommended and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow,
Commissioner Langohr and Mayor Sedivy; those voting No, none. I

The Director of Finance reported there are Police Reserve funds in the amount of $2,500.00
and Cemetery Permanent Care Funds in the amount of $5,000.00 available for reinvestment and re-
quested authorization to invest the funds in U. S. Treasury Bonds. In concurrence with the recommend-
ation of the City Manager, it was moved by Commissioner Langohr, seconded by Commissioner Morrow,
that authorization for the investment, as requested, be granted and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and
Mayor Sedivy; those voting no, None.

of the gas fitter bond of Chaney's of Livingston. Montana was presented. The City Manager reported
the Building Inspector had recommended the continuation of the bond and the City Attorney had app-
roved the certificate as to form. It was moved by Commissioner Langohr, seconded by Commissioner
Morrow, that the bond be approved and accepted and the motion was carried by the following Aye and
no vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those
voting No, none.

polis, Minnesota, offering $5,000.00 City of Bozeman Water revenue Bonds, 4 3/4% coupon, due 1 July
1970 which have been called as of 1 July 1967, to the City of Bozeman was presented. It was moved
by Commissioner Langohr, seconded by Commissioner Morrow, that the Director of Finance be author-
ized to purchase the $5,000.00 in Water Revenue Bonds and the motion was carried by the following

The City Manager reported that the National League of Cities has scheduled its 3rd Annual
National Legislative Conference to be held l2-l5 March 1967; in Washington, D. C. and recommended
that a member of the City Commission be authorized to attend the meeting. Mayor Sedivy having
I stated he would be unable to attend, it was moved by Commissioner Langohr, seconded by Mayor Sedivy
that Commissioner Morrow be authorized to attend the meeting with Commissioner Langohr and the Ci ty
Manager as alternates and, it being in the public interest, his expenses will be paid from the
General fund. The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Langohr and Mayor Sedivy; those voting N , none.

David Bruck appeared before the Commission to inqure as to the possibilities of an install-
ation of four-way stop signs at the intersection of South Tracy Avenue and Babcock Street in the
interest of traffic. Mr. Bruck was assured that these matters are now under study and that his
remarks will be given full consideration.

The City Manager commented on the claims and found them to be true and lawful claims against
the City of Bozeman and recommended that they be approved and the Director of Finance be directed
to issue warrants in payment. After examination of the claims and checking against the Claim
