HomeMy WebLinkAbout1966-07-06 1 I 1 :'JR7 Bozeman, Montana 6 July 1966 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, 6 July 1966, at 1:00 o'clock p.m. Present were Mayor Sedivy, Commissioner Morrow, Commissioner Langohr, City Manager Cutting, Ass't City Manager Fryslie, City Attorney Berg and the Clerk. Commissioner Morrow opened the meeting with a prayer, and the following proceedings were had: Minutes of the last regular session held Wednesday, 29 June 1966, were read and it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the minutes be approved as read, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, were none. Commission Resolution No. 1277 Special Levy for SID No. 443 Paving 13th and 14th Avenue for final passage: This was the time and place set for hearing protests to levying assessment for Special Improvement District No. 443. Affidavit of publication of Notice was presented. No one was present to protest and no protests having been filed, Resolution No. 1277, provisionally passed and adopted at the regular session held 29 June 1966 was presented.for final passage. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the resolution be finally passed and adopted, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Resolution No. 1278 Special Levy for SID No. 447 Paving Greek Way for final passage: This was the time and place set for hearing protests to levying assessment for Special Improvement District No. 447. Affidavit of publication of Notice was presented. No one was present to protest and no protests having been filed, Resolution No. 1278, provisionally passed and adopted at the regular meeting held 29 June 1966, was presented for final passage. In concurrence with the recommendation of the City Manager, it was moved by Commissioner MOrrow, seconded by Commissioner Langohr, that the resolution be finally passed and adopted, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Change~Order: Replace curbing on South side of Olive Street between S. Tracy and S. Black Avenue: A Change-order in the amount of $2,268.00 to renew or replace all the curbing on the south side of Olive Street between South Tracy Avenue and South Black Avenue and to replace the drainage inlets and an alternate change-order to the above to replace the curb radius and adjust the inlets to eliminate what is co~nly known as the baby carriage crossing in the amount of $1,266.00 was again presented to the Commission for their further consideration. The engineers having given the change-orders considerable study strongly recommended the alternate change-order in the amount of $1,266.00. The City Manager concurred in the recommendation of the City Engineer and it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the above change-order in the amount of $1,266.00 be approved as prepared and included in the contract, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and the Mayor; those voting No, none. Local No. 53 Teamsters, Chauffeurs, Warehousemen & Helpers and Local No. 1277, Laborers: A letter dated 9 May 1966 in regard to wages and other employment conditions submitted by the City of Bozeman Teamsters Local No. 53 and Laborers Local No. 1277 was presented. Mr. Virgil Buettner and Mr. Ray Marks also appeared as business representatives of these locals to verbally request the Commission's consideration of a twenty (20~ cent per hour increase across the board for hourly wages, maximum participation in payment of health insurance premiums and granting a minimum of four hours 388 pay for "Call-Out" time. The Commission thanked Mr. Buettner and Mr. Marks for their appearance and advised that the City Employees would be given such consideration as budgetary limitations would permit. Contract Documents: SID No's 463, 465, and 466 - Long Construction Company: The Contract documents for the construction of street pavement and drainage improvements in Special Improvement District No's. 463, 465 and 466 as awarded to Long Construction Company, Billings, Montana, on 22 June 1966, ware presented. The contracts and bonds were approved as to form by the City Attorney, and it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the Mayor and the Clerk of the Commission be authorized to sign the contract for the City of Bozeman, and that the Long Construction Company be authorized to proceed on the construction of the street pavement, and drainage improvements in Special Improvement District No's. 463, 465 and 466 and the pledge fpr bid security be returned to Long Construction Company, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Refund from State Highway Department on SID No. 452: Main Street and North Seventh Avenue: A letter dated 29 June 1966 from the State Highway Department and addressed to the Mayor was presented in regard to the contemplated refund of City participation funds, paid to the Highway De- partment as the City's share of the State Highway project for the reconstruction of Main Street and North Seventh Avenue, designated by the Highway Department as Project No. U 222 (16). This letter outlined the new policy of the Montana Highway Commission adopted on 27 April 1966 under which the City would only be called upon to participate in the subject project on the basis of one-half (~) of the State's share of the contract cost of the curbs and gutters installed within the City Limits, citing Highway Department method of computing this cost to the City under this new policy and offering the City two options for requesting the refund of the difference between the computed cost and what had been initially paid by the City. The City Manager reported that the Director of Finance estimates that by choosing the option requesting immediate refund, subject to adjustment when final accounting is completed, a saving of between five and six hundred dollars could accrue to the property owners involved in this Special Improvement District. B.!~Q.h!!IIQ.~ WHEREAS, the Montana Highway Department did establish State Highway Urban Project No. U 222(16) for the reconstruction of Main Street and North 7th Avenue within the City of Bozeman and did complete that construction, and WHEREAS, the City of Bozeman, as required by the Highway Department at that time, did pay to the State Highway Department the sum of $182,151.42 as the City's 25% share of the project cost, and WHEREAS, under a policy adopted by the Highway Department on 27 April 1966 the City of Bozeman would be required to participate only to the extent of one-half (1/2) of the State's share of the cost on constructing the project curb and gutter constructed within the City and under this new policy and formula the City would be required to participate only in the estimated amount of $11,027.56, and WHEREAS, the State is offering to refund the difference between that estimate and the amount originally paid by the City under the option of payment when final cos t computations are made or, immediate payment of the estimated refund of $171,123.86, subject to adjustment at such time as final computations are completed. NOW, THEREFORE, BE IT RESOLVED, That the State Highway Department be requested to make immediate payment of the estimated refund in the amount of $171,123.86 under Option No.2, as outlined in their letter, subject to adjustment after final computations of the actual project costs have been made, the City agreeing to repay to the Highway Department the balance in the State's favor in the event a final computation would establish a lesser refund due and with the understanding that the Highway Department will pay to the City any balance that may accrue from the final accounting in the City's favor. 1 I 1 Passed and adoptet by the City Commission at a regular meeting of the said Commission held on the 6th day of July, 1966. Fireman William E. Hoell: Completed probationary period of 30 June for confirmation: A letter received from the Fire Chief announcing that William E. Hoell had satisfactorily com- p1eted the required six months period of his temporary and probationary appointment in the Bozeman Fire Department. The City Manager had confirmed this appointment as a permanent status subject to the approval of the Commission. It was moved by Commissioner Morrow, seconded by Commissioner Lan- gohr, that the permanent appointment of William E. Hoell be approved, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr, and Mayor Sedivy; those voting No, none. Resolution No. 1284 for SID No. 463 fixing date, Maturity date and amount of Bonds: Resolution No. 1284 authorizing the issuance of bonds of Special Improvement District No. 463 was presented, entitled: COMMISSION RESOLUTION NO. 1284 I A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN FIXING THE DATE, MATURITY DATE AND THE PRINCIPAL AMOUNT OF BONDS TO BE ISSUED IN SPECIAL IMPROVEMENT DISTRICT NO. 463. Reso1ut'on No. 1286 for SID No. 466 fixing date. Maturi ty date and amount of bonds: Resolution No. 1286 authorizing the issuance of bonds of SpeCial Improvement District No. 466 1 was presented, entitled: COMMISSION RESOLUTION NO. 1286 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN FIXING THE DATE, MATURITY DATE AND THE PRINCIPAL AMOUNT OF BONDS TO BE ISSUED IN SPECIAL IMPROVEMENT DISTRICT NO. 466. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the resolution be passed and adopted, and the motion was carried by the following Aye and No vote: those voting Aye Being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. :JA9 390 Reports for June: The following reports were presented for June: Disposal Plant Operator Librarian Fire Chief the City Manager commented on the reports and recommended their approval. It was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the reports be approved, and the motio~ was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commiss- ioner Langohr, and Mayor Sedivy; those voting No, none. Claims for June: Claim No!s. 5384 to 5689 inclusive were presented on the various funds as follows: General Street Water S.D.S. Fund 337.28 Total $81,467.85 The City Manager commented on the claims and found them to be true and 1awfull claims against the City of Bozeman and recommended they be approved, and the Director of Finance be directed to issue warrants in payment. After examination of the claims in detail and checking against the claim register, it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the claims be approved, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner MOrrow and Mayor Sedivy; ,hose voting No, none. Adjournment: There being no further business to come before the Commission at this time, it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the meeting be adjourned, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none.
