HomeMy WebLinkAbout1966-08-03 1 I 'I Bozeman, Montana 3 August 1966 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, 3 August 1966, at 1:00 o'clock p.m. Present were Mayor Sedivy, Commissioner Morrow, Commissioner Langohr, City Manager Cutting, Ass't City Manager Fryslie, Acting City Attorney O'Connell and the Clerk. Commissioner Langohr opened the meeting with a prayer, and the following proceedings were had: Minutes of the last regular session held Wednesday, 27 July 1966, were read and it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the minutes be approved as read, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Confirmation of Fireman Bruce Thompson - Effective 1 August 1966: A letter received from the Fire Chief announcing that Bruce Thompson had satisfactorily com- pleted the required six months period of his temporary and probationary appointment in the Bozeman Fire Department was presented. The City Manager had confirmed the appointment of Thompson to a the commiJsion. It was moved I permanent status on the Fire Deparoment subject to the approval of by Commissioner Langohr, seconded by Commissioner Morrow, that the permanent appointment of Bruce Thompson as a regular member of the Fire Department be approved, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. Request - Jaycee Rodeo Parade - Saturday 10:30 A. M. August 27, 1966: A request from the local Jaycees to sta~e a rodeo parade Saturday, lO:30 o'clock A.M., 27 August 1966, to begin at Buttrey's Shopping Center and proceed down Main Street to Bogarts Grove was presented. It was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the re- quest be granted, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Open Bids for Sidewalks - 1966: This was the time and place set for receiving bids for the repairing of miscellaneous Walks and Curbs. Affidavit of publication of "Notice to Bidders" was presented and it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the bids filed with the Clerk of the City Commission be opened and read, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohe; Commissioner Morrow and Mayor Sedivy; those voting No, none. The following Bids were opened and read: Name of Bidder Wallace Diteman, Inc. W. D. Howells Long Construction Co., Amount of Base Bid Bozeman, Montana Bozeman, Montana Billings, Montana $2,054.00 $1,970.00 $2,115.00 The bids were then referred to the City Engineer for his study and final recommendation. Authority to purchase Water Refunding Bonds: $20,000.00: It was ~oved By Commissioner Langohr, seconded by Commissioner Morrow, that the Director of Finance be authorized to purchase Water Refunding Bonds in the amount of $20,000.00 due in 1983 on K the open ma~et at a price of ninety percent on the dollar or a price of $18,000.00 plus accrued in- terest to date of delivery of the bonds. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. 403 404 Public Hearing - Ordinance No. 862 - Appropriations (1966-1967) This was the time and place for public hearing on the Appropriations Ordinance No. 862 for the fiscal year ending 30 June 1967: Affidavit of publication of Notice of hearing was presented. No one appeared to verbally pro- test and the Clerk of the Commission stated no formal protest had been filed in opposition to the adoption and passage of the proposed ordinance and accompanying annual appropriation budget. In concurrence with the recommendation of the City Manager, it was moved by Commissioner MorroW, sec- onded by Commissioner Langohr, that the Clerk of the Commission be authorized mld directed to publish the ordinance as required by law, and the motion was carried by the following Aye and No vote: those voting Ay~ being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Resolution No. 1294: Tax levy for 1966-1967 Fiscal Year: Resolution No. 1294 setting the tax levy at 5l.l mills for the year 1966-67 was presented, en- ti tIed: COMMISSION RESOLUTION NO. l294 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN DETERMINING THE AMOUNT OF CITY TAXES FOR ALL PURPOSES, GENERAL AND SPECIAL, TO BE LEVIED AND ASSESSED ON TAXABLE PROPERTY IN THE CITY OF BOZEMAN, STATE OF MONTANA, FOR THE FISCAL YEAR ENDING 30 JUNE 1967. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the resolution be passed and adopted, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner MOrrow and Mayor Sedivy; those voting No, none. Surety Bond - $10,000.00 Helen Wansink - Ass't Water Collector and Cashier: The surety bond in the amount of $lO,OOO.OO written by Hartford Accident and Indemnity Company for Helen Wansink Ass*t Water Collector and Cashier for a period of one year from 1 August 1966 to 1 August 1967, and approved as to form by the Acting City Attorney was presented. It was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the bond be approved as presented, and the motion was carried by the Following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. License Bonds - William S. Lynas: a) Plumber, b) Gas Fitter: In compliance with Chapters fifteen and sixteen of the Bozeman Municipal Code, the plumbing and gas fitter license bonds of William S. Lynas, Bozeman, Montana, were presented for approval. The City Manager reported that the Building Inspector recommended that the bonds be approved. The City Attorney approved the bonds as to form, and it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the bonds be approved and accepted, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. Sale Portion Booster Station Site to State Highway for Interstate RighE-of-Way with Right-of-Way Agreement: 2,550 Sq. ft. @ $150.00: A Right-of-Way Agreement for the City to sell to the State Highway Department a tract of land in lots 28, 29 and 30 of Block 97 of the Northern Pacific Addition to the City of Bozeman, Montana, containing 2,550 sq. ft. in consideration of payment of the sum of $l50.00 and a quit claim deed conveying that property to the State for Right-ofWay for Interstate Highway No. 90 was presented. The City Manager recommended that the City enter into the agreement and convey the property as requested. It was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the subject agreement be entered into by the City, and the Mayor and the Clerk of the Commission be authorized I I 1 and directed to sign for the City and the quit claim deed conveying the property be executed, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohn and Mayor Sedivy; those voting No, none. Reports for July: The following reports were presented for July: Fire Chief Po lice Chief Librarian The City Manager commented on the reports and recommended their approval. It was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the reports be approved, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. After examination of the claims in detail and checking against the claim register, it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the claims be approved, and the motion was carried by the following Aye and No vote: those voting Aye being CommissLoner Langohr, Commissioner MOrrow and Mayor Sedivy; those voting No, none. Meeting with Exchange Club: It was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the City Manager, and/or Assistant City Manager, and the Chief of Police meet with the Exchange Club 8 August 1966, at the Baxter Hotel for a discussion of the annual fireworks demonstration, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Consideration of Bids: Award of Walks and Curbs: The City Engineer having completed his study of the bids for construction of Walks and Curbs (l966) recommended that W. D. Howell, Bozeman, Montana, be awarded the contract for the improvement of the walks and curbs on the basis of his low bid of $1,970.00, with the stipulation that the final cutoff date on construction would be 20 September 1966. The City Manager concurred in the recommendation of the City Engineer, and it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the bids be swarded as recommended, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lan@ohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. Salary - Police Chief: The Manager reported that Police Chief Saunders had rejected the salary offer of $750.00 per month contingent on a two year contract with the City, but had agreed to accept a salary of $725.00 per month for such undetermined period that he may remain with the City. It was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the salary of $725.00 per month for the Chief of Police 1 I 1 I I .1 be approved, and the motion waS carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Lan~hr and Mayor Sedivy; those voting No, none. Certificate of Engineer - SID No's 454, 456, 457 and 458: Final es timated: A letter from Harold Hoskins and Associates, Inc., certifying the completion of Special Improve- ment District No's 454, 456. 457 and 458 and concurred in by the City Engineer was presented. Also their recommendation that the time limit be extended fifteen days and the contractor assessed a total of thirteen days at $60.00 per day as excess engineering in accordance with the contract. The Manager concurred in the recommendation of the City Engineer, and it was moved by Commissioner Lan- gohr, seconded by Commissioner Morrow, that the project be accepted and the contractor assessed the amount of excess engineering as recommended, and the final estimates be paid when presented in proper form, and the motion was carried by the following Aye and No vote: those voting Aye being Commission- er Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none.
