The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday, 3l August 1966, at 1:00 o'clock p.m. Present were Mayor Sedivy, Commissioner
Morrow, Commissioner Langohr, Acting City Manager Fryslie, City Attorney Berg and the Clerk.
Mayor Sedivy opened the meeting with a prayer, and the following proceedings were had:
Minutes of the last regular session held 24 August 1966, were read and it was moved by Commissioner
Morrow, seconded by Commissioner Langohr, that the minutes by approved as read, and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner
Langohr, those voting No, none.
Public Hearing Resolution No. 129l - Intention to Create SILD No. 475 - Street Lighting on South Grand:
This was the time and place set in Commission Resolution No. l29l to hear protests to the creation
of Special Improvement District No. 475. Affidavit of publication of Notice and the Clerks mailing
certificate stating that all property owners had been notified as required by law were presented. The
Acting City Manager presented a written protest filed with the Clerk of the Commission, 26 August 1966,
and signed by owners of property representing 36.99% of the proposed district as determined by the
engineer. Several property owners were present to affirm the written protest to the creation of Special
Improvement District No. 475, and the City Commission, having examined the protests and determined it to
be in the best public interest to proceed no further under Commission Resolution No. 1291, it was moved
by Commissioner Langohr, seconded by Commissioner Morrow, that no proceedings shall be had under
Commission Resolution No. l29l and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none.
Public Hearing Resolution No. l292 - Intention to Create SILD No. 476 - Streeting Lighting on South Tracy:
This was the time and place set in Commission Resolution No. l292 to hear protests to the creation
of Special Improvement District No. 476. Affidavit of publication of Notice and the Clerks mailing
certificate stating that all property owners had been notified as required by law were presented. The
Acting City Manager presented a written protest filed with the Clerk of the Commission, 26 August 1966,
and signed by owners of property representing 84.9l% of the proposed district as determined by the
engineer. Several property owners were present to affirm the written protests to the creation of Spec-
ial Improvement Lighting District No. 476, and the City Commission having determined the protests to
be sufficient, it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that under the
provisions of Section 11-2205 R.C.M., no further proceedings shall be had under Commission Resolution
No. 1292, and the motion was carried by the following Aye and No vote: those voting Aye being Comm-
issioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none.'
Public Hear'ng Resolution No. l293 - Intention to Create SILD No. 477 Street Lighting - South Willson:
This was the time and place set in Commission Resolution No. l293 to hear protests to the creation
of Special Improvement Lighting District No. 477. Affidavit of publication of Notice and the Clerks
mailing certificate stating that all property owners had been notified as required by law were presented.
The Acting City Manager presented a written protest filed with the Clerk of the Commission. 26 August
1966, and signed by owners of property representing 76.18% of the proposed district as determined by the
engineer. Several property owners were present to affirm the written protest to the creation of Special
Improvement Lighting District No. 477, and the City Comm1sson having determined the protests to be suffi-
cient, it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that under the provisions

of Section 11-2205 R.C.M., no further proceedings shall be had under Commission Resolution No. 1293,
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr,

Resolution No. l296 - Levying 1966 Garbage Assessment, Provisional Adoption - Hearing 7 September 1966:
$63,304.66
Resolution No. l296 levying assessment for the collection and disposal of garbage for the year 1966,
in the amount of $63,304.66 was presented, entitled:

A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA,
LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL REAL
PROPERTY IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF
MONTANA DURING THE YEAR 1966, TO DEFRAY THE COST AND EXPENSE OF
COLLECTING AND DISPOSING OF GARBAGE UNDER THE PROVISIONS OF ORD-
INANCE NO. 696 OF THE CITY OF BOZEMAN, AND THE BOZEMAN MUNICIPAL
CODE.
It was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the resolution be
provisionally passed and adopted and 7 September 1966, be set as the date for public hearing, and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Comm-
issioner Langohr and Mayor Sedivy; those voting No, none.
Resolution No. 1297 - Leving 1966 Sprinkling Assessment - Provis :ional Adoption - Hearing 7 September 1966:
$3,559.68
Resolution No. 1297 levying the assessment in the total amount of $,559.68 for street sprinkling
and cleaning for the year 1966 was presented, entitled:

A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND
ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN
STREET SPRINKLING DISTRICTS OF THE CITY OF BOZEMAN, COUNTY OF
GALLATIN, STATE OF MONTANA, TO DEFRAY SEVENTY-FIVE PERCENT OF THE
COST OF SPRINKLING STREETS WITHIN SAID STREET SPRINKLING DISTRICTS
OF THE CITY OF BOZEMAN FOR THE YEAR 1966.
It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the resolution be
provisionally passed and adopted and 7 September 1966, be set as the date for public hearing, and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr,
Commissioner Morrow and Mayor Sedivy; those voting No, none.
Semi-final Payment - Federal Building Site Street Widening - Long Construction:
The Certificate of the engineer of Thomas, Dean and Hoskins for the street widening around the
Federal Building site, stating the construction had been completed in accordance with the terms and
specifications of the contract by the contractors Long Construction Company and recommending that the
City accept and approve the construction project was presented. The Acting City Manager concurred in
the recommendation of the engineers and place before the Commission the following claims representing
semi-final payment to the contractors as follows:
Long Construction Company, Billings, Montana Street-widening Imp. $21,645.63
Long Construction Company, Billings, Montana Street-widening Imp. 2,405.07
It was moved by Commissioner Morrow, seconded by Commissioner Langohr, that in concurrence with
the recommendation of the Engineer of Thomas, Dean and Hoskins and the Acting City Manager, the contract
work for Street-widening improvements at the Federal Building site be approved for semi-final partial
payment and the Director of Finance be authorized to issue warrants in the amount indicated, and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow,
Commissioner Langohr and Mayor Sedivy; those voting No, none.

PLANS & SPECIFICATIONS: SID No. 468 Water Main North Fifteenth between Beall & Durston and
on Durston:
Plans and specifications covering the proposed improvement in Special Improvement District
No. 468 prepared by Thomas, Dean and Hoskins, Inc., supervising engineers were placed before the
Commission. In concurrence with the City Engineer, the Acting City Manager recommended that the
plans and specifications, as presented be approved. It was moved by Commissioner Langohr, se-
conded by Commissioner Morrow, that the plans and specifications be approved and the Clerk of
the Commission be directed to publish a "Call for Bids" for the construction of the improvements
for the district with an opening date of l4 September 1966, and to advertise for bids for the sale
of bonds of thedistrict in the approximate amount of $30,000.00 to be received 28 September 1966,
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none.

Commission. In concurrence with the City Engineer, the Acting City Manager recommended that the
plans and specifications, as presented be approved. It was moved by Commissioner Morrow, se-
conded by Commissioner Langobr, that the plans and specifications be approved and the Clerk of
the Commission be directed to publish a "Call for Bids" for the construction of the improvements
for the district with an opening date of l4 September 1966, and to advertise for bids for the sale
of bonds of the district in the approximate amount of $l3l,000.00 to be received 28 September 1966,
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none.
Plans and Specifications: SID No. 471 Sanitary Sewer Blocks 4 and 5 in Kirk's Second:
Plans and specifications covering the proposed improvement in Special Improvement District

Commission. In concurrence with the City Engineer, the Acting City Manager recommended that the
plans and specifications, as presented be approved. It was moved by Commissioner Langohr, se-
conded by Commissioner Morrow, that the plans and specifications be approved and the Clerk of
the Commission be directed to publish a "Call for Bids'! for the construction of the improvements
for the district with an openeing date of 14 September 1966, and to advertise for bids for the sale
of bonds of the district in the approximate amount of $11,000.00 to be received 28 September 1966,
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none.

conded by Commissioner Langohr, that the plans and specifications be approved and the Clerk of
the Corrnnission be directed to publish a "Call for Bids" for the constructions of the improvements
for the district with an opening date of 14 September 1966, and to advertise for bids for the sale

for the district with an opening date of 14 September 1966, and to advertise for bids for the

Ordinance No. 863 - Fire Zone:
Ordinance No. 863 to be known as "Fire Zone" Ordinance and repealing Ordinance No. 794 was
Presented, entitled:

AN ORDINANCE CREATING AND ESTABLISHING FIRE ZONES AND
REPEALING ORDINANCE NUMBER 794 OF THE CITY OF BOZEMAN
AND ALL ORDINANCES AND PARTS OF ORDINANCES OF SAID CITY
IN CONFLICT HEREWITH:
The Building Inspector, Fire Chief, and the City Attorney recommended that the Ordinance be
passed and adopted, and the Acting City Manager concurred in the recommendation. It was moved by
Commissioner Langohr, seconded by Commissioner Morrow, that the ordinance be passed and adopted,
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none.
Authority to purchase 300 yards one-half inch gravel - $750.00:
The Street Department has need for a supply of crushed gravel for use in its program on various
streets within the City. The Acting City Manager requested the authority to purchase 300 cubic yards
one-half inch crushed gravel at an approximate cost of $750.00. It was moved by Commissioner Morrow,
seconded by Commissioner Langohr, that the purchase be approved, and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and
Mayor Sedivy; those voting No, none.

Authority to Purchase Police Uniforms - $698.20:
A written request of Police Chief Saunders for authorization to purchase police uniforms in
the approximate amount of $698.20 was presented. Following advise that the purchase is budgeted
and the recommendation of the Acting City Manager, that the purchase be approved, it was moved
by Commissioner Langohr, seconded by Commissioner Morrow, that the purchase be authorized and
the motionwas carried by the following Aye and No vote: those voting Aye being Commissioner
Langohr, Commissioner MOrrow and Mayor Sedivy; those voting No, none.
Authority to Purchase Police Equipment and Uniforms - $727.75:
A written request from Police Chief Saunders for authorization to purchase police equipment
and uniforms in the approximate amount of $727.75~ was presented. Following advise that the
purchase is budgeted and the recommendation of the Acting City Manager that the purchase be
approved, it was moved by Commissioner Morrow~ seconded by Commissioner Langohr, that the purchase
be authorized, and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none.
Authority to purchase Middle Creek Water contract: - lO Acre Feet:
It was reported that Paul B. Smith who owns 10 Acre feet shares of water has offered to sell
his contract to the City of Bozeman at the same price that he purchased it. In the best interest
of the City, the Acting City Manager recommended the purchase of the ten shares on a thirty year
contract at $l.96 per share per year, or $l9.60 for the ten acre feet per year. In concurrence
with the recommendation of the Acting City Manager, it was moved by Commissioner Langohr, seconded
by Commissioner Morrow, that authority to purchase the ten shares be granted, and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner
Morrow and Mayor Sedivy; those voting No~ none.
Special Meeting - Swimming Pool proposal for Recreation Department:
It was moved by Commissioner Morrow, seconded by Commissioner Langohr, that a meeting of the
City Commission be called for Thursday, 1 September 1966, at 7:30 o'clock P.M. to study and review
the Fark-Recreation Program of the City of Bozeman, and the motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy;
those voting No, none.
Adjournment:
There being no further business to come before the Commission at this time, it was moved by
Commissioner Langohr, Seconded by Commissioner Morrow, that the meeting be adjourned and the motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Comm-
