HomeMy WebLinkAbout1966-01-12 294 Boz ema n , Mon tana 12 Januar y 1966 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall &lilding, Wednesday, 12 January 1966, at l:OO o'clock p.m. Present were Mayor Sedivy, Commissioner Morrow, Commi,ssioner Langohr, City Manager Cutting, 1 Ass't City Man9.ger Fryslie, City Attorney Berg and the Clerk. Commissioner Langohr opened the meeting with a prayer and the following pro- ceedings were had: Minutes of the last regular session held "Wednesday, 5 January 1966, were read and it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Commissione r Morrow, Commissioner Langohr and Mayor Sedivy; those votIng No, n'ne. Ma yor' s proc lama ti on: Mayor Edmund F. Sedivy signed a proclamation setting aside the week of .January 16th to January 22nd, 1966, inclusive to commemorate the founding of the Bozeman Jaycees and to celebrate their 26th anniversary. Plat of Green Acres Subdivision: D. W. Townsenr'l $500.00. A letter from the City-County PlannIng Board addressed to the City Commission was presen ted transmi tting the final plat of Green Acres Subdi vision and recommended approval of the plat with the following contingencies: 1) that access restriction to the frontage road easement be indicated on the plat to allow ingress and egress at the East end of the frontage road only. 2) that park requirements be considered and met to the satis- faction of the City of Bozeman. I Following a diSCUSsion of the Green Acres Subdivision, a tract along the Bridger Road northeast of Bozeman, it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the plat be approved contingent upon payment of $500.00 to the City by Mr. D. W. Townsend, developer of the property, as a satis- faction of the park requirements and the recommenda tion of the Bozeman Ci ty- County Planning Board, and that the City Manager be authorized and directed to sign the plat as the Director of Public Serviee, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow, Mayor Sedivy; those voting No, none. Proposed Zoning Ordinance - Ordinance No. 855: The proposed new zoning ordinance drafted by the Bozeman City-County Planning Board and upon which the Board of Adjustment held a public hearing on December 7, 1965, was brought before the City Commission for consideration. The Board of 1 Adjustment recommended that the proposed ordinance be revised to eliminate the suggested zoning change to "Motor Business" in the area between Eighth Avenue and what would be the alley between Eighth Avenue and Nlnth Avenue from Beall Street and Durston Road and that this section remain "e" residential as currently zoned as a result of protests to the change registered at the public hearing. After discussion and clarification, The Ci ty Manager concurred wi th the 1 recommendation of the Board of Adjustment and recommended that the subject ord- inance be passed, entitled: ORDINANCE NO. 855. AN ORDINANCE CLASSIFYING, REGULATING'\N~ RESTRICTING THE USE OF LAND AND THE USE AND LOCATION OF BUILDINGS AND STRUCTURES; REGULATING AND LIMITING THE HEIGHT AND FLOOR AREA OF B1JIL"'\TNGS AND STRUCTURES AND REGU- LATING AND DETERMINTru THE AREA OF YARDS, COURTS AND OTHER OPEN SPACES WITHIN AND SURROUNDING ALL SUCH BUILDINGS AND STRUCTURES, REGULATING THE SIZE AND LIMITING THE INTENSITY OF USE OF LOT AREA, DIVIDING THE CITY OF BO:;::EMAN INTO ZONES AND ESTII.BLISHPfG THE BOUNDARIES AND CLASSIFICATI'N THEREOF BY THE ADOPTION OF A ZONING MAP: CREATING AND ESTABLISHING TRANSITION ZONII\G AREA AND FRINGE AREASAND THE USE AND CO NSTRU- CTION RESTRICTIONS THEREIN; REQUIRING OFF STREET PARKING: REmJLATING THE PARKING AND STORAGE OF MOBILE HOMES AND TRAILERS; PRESCR IBING PENA LTIES FOR THE VIOLATION OF ITS PROVISIONS; CREATING AND ESTABLISHING THE BOARD OF A DJUS 'rMENT AND PROVIDING FOR ITS MEMBERSHIP MEETINGS AND PROCEDURES AND FOR AFPEALS THtmETO. It was moved by Commissioner Morrow, seconded by Commissinner Langobr, that Ordinance No. 855 be passed and adopted, and the motion was carried by the following Aye and No vote: those votIng Aye being Commissioner Morrow, CommissLmer LangohI' and Ma yor Sedi vy; tho se va ti r:g ND, none. Mr. ,To D. Strozzi, 2220 West Main Street - Annex Into the City: Mr. J. D. Strozzi of the Jo-Mar Trailer Cmlrt again appeared before the Comm- ission to renuest approval of the Dlat for his tract in order to permit the annex- ation of that property into the City of Bozeman. He informed the Commission that I he now has the plat completed in accordance with ins truc tions of the Bozeman Ci ty- County Planning Board and the advice oft he City A ttorney with the City's recommend- at1on. Following discus s ion, i t wa s suggested to Mr . Strozzi tba t necessary sign- 1 atures be obtained and the plat be brought to the City Commission for final consider- ation on 19 January 1966. Authority to Purchase Radar - Police Departmentj94:3.00: The City Manager reported that the Police Department has had a Radar unit on trial and now re01Jested authority to purchase the unit at a cost of $943.00. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, t ha t the au thori ty to purchase the new radar unit now on trial be granted as requested, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. Authority for Police-Fire Def~artments to move to new building: A certifica te of the Archi tects was presen ted sta ting tha t the Police-Fire Unit of the new Municipal Building Facility is now ready for occupancy, and in concurrence with the recommendation of The City Manager, it was moved by CO"Y1missioner Morrow, seconded by Commissioner Langohr, that the Police Department, the Fire Department anr'j the Police Court be authorized to move in to the new building, and that those departments be in operation in the new building on Monday, 17 January 1966 and the motion was carried by the fo llowing Aye and No vote: those vo ting Aye being Commissioner Morrow, Commissioner LangohI' and Mayor Sedivy; those voting No, none ~~95 296 Report~ for Decemb~r: The following reports were presented: Cemetery (Nov. & Dec.) After exam- ination of the claims in detail and checking against the Claim register, it was moved by Commissioner Morrow, seconded by Commissi oner Langobr, tha t the claims be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langobr and Mayor Sedivy; those voting No, none.
