HomeMy WebLinkAbout1966-03-09 320 Bozeman, Montana 9 March 1966 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, 9 March 1966, at 1:00 o'clock p.m. Present were Mayor Sedivy, Commissioner Morrow, Commissioner Langohr, City Manager Cutting, Ass't. City Manager Fryslie, City Attorney Berg and the Clerk. Commissioner Morrow opened the meeting with a prayer and the following proceedings were had: Minutes of the last regular session held Wednesday, 2 March 1966, were read and it was moved by Commissioner Morrow, seconded by Mayor Sedivy, that the minutes be approved as read, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, and Mayor Sedivy; those voting No, none. Public Hearing Resolution No. 1249 - (Intent to Create SILD No. 461 - Maple Terrace Avenue:) This was the time and place set in Commission Resolution No. 1249 to hear protests to the creation of Special Improvement District No. 461. Affidavit of publication of Notice and the Clerk's Mailing Certificate stating that all property owners had been notified as required by law were presented. The City Manager informed the Commission that as of 5:00 o'clock p.m. March 8, 1966, there were no protests on file and no one appeared to verbally protest the creation of extent of the district. The City Manager recommended that The City Attorney be instructed to prepare a resolution creating the district. Commission Resolution No. 1254 COMMiSSION RESOLUTION NO. 1254. A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 461 6F THE CITY OF BOZEMAN FOR THE PURPOSE OF OPERATING AND MAIN- TAINING A STREET LIGHTING SYSTEM TO LIGHT BLACKMORE PLACE, TERRACE AVE- NUE, THE WESTERLY ONE-HALF OF NORTH SEVENTEENTH AVENUE, THE NORTHERLY ONE-HALF OF DURSTON ROAD AND TIlE EASTERLY ONE-HALF OF NORTH NINETEENTH AVENUE IN AND ADJACENT TO MAPLE TERRACE SUBDIVISION, BEING A REARRANGE- MENT OF TRACTS 1, 2, 3, 4, 11 AND 13 OF HOMESITES SUBDIVISION, CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA. PREPARED by the City Attorney was presented. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the re- solution be passed and adopted to create Special Improvement District No. 461, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No; none. This was the time and place set in Commission Resolution No. 1250 to hear protests to the creation of Special Improvement District No. 462. Commission Resolution No. 1255 COMMISSION RESOLUTION NO. 1255 A RESOLUTION OF THE CITY COMMISSION OF TIlE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 462 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF OPERATING AND MAINTAINING A STREET LIGHTING SYSTEM. TO LIGHT NORTH EIGHTEENTH AVENUE, FROM WEST BEALL STREET TO DURSTON RoaD, WEST BEALL STREET FROM THE ALLEY LINE OF BLOCK "B" AND NORTH NINETEENTH AVENUE, AND THE SOUTHERLY SIDE OF WEST DURSTON ROAD BETWEEN THE ALLEY OF BLOCK "B" AND NORTH NINETEENTH AVENUE AS PLATTED IN GRAF's FIRST REARRANGE- MENT OF BLOCK 6 OF KIRKS SECOND SUBDIVISION TO BOZEMAN, MONTANA. 1 I 1 Prepared by the City Attorney was presented. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Morrow, seconded by Commissioner Langohr_, that the Resol- ution, that the Resolution be passed and adopted to create Special Improvement Lighting District No. 462 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. 1 Bearing Resolution No. 1251 - )(Intent to Vacate Babcock St. & Alley (Wallace to Ida Avenue) This was the time and place set in Commission Resolution No. 1251 for hearing protests to v~cating a portion of East Babcock Street and alley of Block "B" Rouse's Second Addition. Affi- davit of publication of Notice was presented together with signed acknowledgement of service of the notice from owners of all abutting the property. There was no one present to protest, and no protests having been filed, the City Attorney was instructed to prepare an Ordinance vacating said portion of East Babcock Street and Alley of Block "B", Rouse's Second Addition. Ordinance No. 856 -- Vacating: ORDINANCE NO. 856 AN ORDINANCE OF THE CITY OF BOZEMAN VACATING A PORTION OF EAST BABCOCK STREET AND ALLEY OF BLOCK B, ROUSE'S SECOND ADDITION TO THE CITY OF BOZEMAN, STATE OF MONTANA. The City Attorney, as instructed, had prepared the above Ordinance No. 856 vacating a portion of East Babcock Street and Alley of Block "B", Rouse's Second Addition. Ordinance No. 856 was presented, and it was moved Commissioner Langohr, seconded by Commissioner Morrow, that the above Ordinance be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner MOrrow and Mayor Sedivy; those voting No, none. I Moving City Offices - 11 March 1966: Note this Last Meeting Old City Hall: The City Manager presented to the Commission a certificate prepared by the Architects stating that the Administration Building is "Substantially completed" and ready for occupancy as contem- plated by the contract. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the Administrative Offices, the City Engineering Department and the Building Inspection Department be authorized to move into the new building and that those departments be in operation in the new building on Monday, 14 March 1966, and the motion was carried by the following Aye and No vote: those voting Aye being Comm- issioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. It was also oficially noted that this would be the last meeting of the City Commission to be held in the Old City Hall. Request to hold fund drive 14-19 March 1966 (Bozeman Campfire Girls, Inc., ~ Proclamation:) Mayor Edmund P. Sedivy announced he had issued a proclamation designating the week of 14-19 March 1966 as Camp Fire Girl Week rec08nizing fifty-six years of service to girls aged seven through high school. 1 A letter from the Bozeman Camp Fire Girls, Inc., requesting permission to hold a fund drive from the 14th to the 19th of March, inclusive, was also presented to the Commission. In concurrence with the recommendation of The City Manager, it was moved by Commissioner Morrow, seconded by Comm- issioner Langohr, that the Mayor's Proclamation be approved and authorization to hold the fund drive of the Camp Fire Girls be granted, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. :121 322 Request to hold M.S.U. Rodeo Parade - 1:00 p.m. Saturday, 23 Aptil 1966. A request from the Montana State College Rodeo Club for permission to stage a parade from Bogart's Grove to Main Street and thence westerly to Eighth Avenue and on to Montana State University on Saturday, 23 April 1966, at 1:00 o'clock p.m. was presented to the Commission. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the request be granted and that the Rodeo Club be responsible for any clean-up work necessary at Bogart Grove and also of the removal of signs immediately after they have served their purpose and the motion was carried by the following Aye and No votes: Thos voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. Request to hold RUIIunage Sale (Old City Hall) - week of 14 March 1966 - as approved WCTU. The City Manager reported he had received a verbal request from Mrs. Alta Price for permission for the Women's Christiane Temporance Union to hold a rummage sale in the Old City Hall during the week of March 14, 1966. In discussing this request, The City Manager recommended that the request be denied in view of interfering with the City's announced schedule of operation during that week, and also due to the fact that the City proposed to close the building by the end of the week in order that it might be turned over to the contractors for demolition. It was moved by Commissioner Morrow, seconded by Commissioner Langohr, that in concurrence with the recommendation of The City Manager, the above request be denied and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. License Bond Continuation - Pauls Electric Co., - Billings (Electrical) In compliance with Chapter 16 of the Bozeman Municipal Code, the Electrical bond of Paul Schmittou, Billing~was presented. The City Manager stated the Building Inspector had recommended the approval of the bond and the City Attorney had approved the bond as to form. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the bond be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. lCMA advanced management training program: Chicago 8-13 May: Ass't City Manager: The City Manager reported the International City Managers association training program is scheduled to be held in Chicago, Illinois, May 8-13, and recommended that Harold A. Fryslie', Ass't City Manager, be authorized to attend the training program. It was moved by Commissioner Morrow, seconded by Commissioner Langohr, that Ass't City Manager, Harold A. Fryslie be authorized to attend the meeting,and, it being in the public interest, the expenses be charged to the general fund. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Traffic Pain/purchase for 1966: Cost $596.00: It was reported that the traffic department is in need of traffic paint for the year 1966, and to meet the need, The City Manager requested authority to purchase 175 gallons white paint and 30 gallons yellow paint at an approximate cost of $596.00. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the purchase be approved, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commission- er Morrow and Mayor Sedivy; those voting No, none. Consultant study of Sanitary Sewer System & Disposal Plant: Appli.cation for Planning Board Fund: The City Manager reported that he and City Engineer Fargo and Disposal Plant Operator Carl Larson had met with State Board of Health Officials to discuss Bozeman's need for necessary 1 I 1 revision and expansion of sewage collection and disposal facilities. Upon recommendation of The City Manager, it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the City Manager be authorized to prepare and submit an application to the Federal Water Pollution Control Agency for advanced planning funds to accomplish the necessary preliminary engineering 1 studies of the City's sewage collection and disposal requirements. Reports for February (~ontinued): The Following reports were presented: Fire Chief Cashier Building Inspector Police Judge Fluoridation Disposal Plant Operator The City Manager commented on the reports and recommended their approval. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No. none. Claims for February (continued): Claim No's 4407 thru 4450 inclusive were presented on the various funds as follows: General $5,195.40 Park $ 398.91 Street 971.59 Cemetery 138.26 Water 1,230.08 Band 5.76 S .D.S. 321.46 Garbage 94.25 Library 2 38 . 78 Parking Meter 37.05 Planning Board 3,044.50 Bldg. Constructiog,446.30 Total $18,122.34 The City Manager commented on the claims and found them to be true and lawful claims against the City of Bozeman and recommended that they be approved and the Director of Finance be directed I to issue watrants in payment. After examination of the claims in detail and checking against the claim register, it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the claims be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Leave Regulations: Regulations governing leave of absence for all City employees revised as of February 2, 1966, was presented following explanation by t~e City Manager of the specific revisions made since prior Commission Approval on November 27, 1957. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the revised regulations be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. Ad iournment: There being no further business to come before the Commission at this time, it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the meeting adjourn, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Comm- 1 issioner Langohr and Mayor Sedivy; those voting No, none.
