HomeMy WebLinkAbout1966-03-23 326 Bozeman, Montana 23 March 1966 The Commission of The City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, 23 March 1966, at 1:00 o'clock p.m. Present were Commissioner Langohr, presiding in the absence of Mayor Sedivy as Acting Mayor, Commissioner Morrow, City Manager Cutting, Ass't City Manager Fryslie, Acting City Attorney O'Connell and the Clerk. Commissioner Morrow opened the meeting with a prayer and the following proceedings were had: Minutes of the last regular session held 16 March, 1966, were read, and it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the minutes be approved as read, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow and Commissioner Langohr; those voting No, none. Designation of President Pro Tempore of Commission: In the absence of Mayor Sedivy, and in compliance with Section 11-3245, R.C.M. 1947, it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that Commissioner Langohr be designated to act as President Pro Tempore of the Commission, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow and Commissioner Langohr; those voting No, none. Absence of Mayor Sedivy: Mayor Sedivy was reported to be out of the City conducting a tour of the Montana State University Band. In concurrence with the reconnnendation of The City Manager, it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the absence of Mayor Sedivy from this meeting of the City Comm- ission be excused, and the motion was carried by the following Aye and No Vote: those voting Aye being Commissioner Langohr and Commissioner Morrow; those voting No, none. License Bond: Budd Plumbing and Heating: Plumbing. In compliance with Chapter 16 of the Bozeman Municipal Code, the plumbing bond of Jack Kyle, dba New Budd Plumbing and Heating, Bozeman, Montana was presented. The City Manager stated the Building Inspector had recommended the approval of the bond and the Acting City Attorney had approved the bond as to form. It was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the bond be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, and Commissioner Langohr; those voting No, none. License Bond: Frank J. Trunk & Son, Inc., a) plumbing b) heating: In compliance with Chapter 16 of the Bozeman Municipal Code, the certificates to continue the plumbing and gas fitter bonds of Frank J. Trunk & Son, Bozeman, was presented. The City Manager stated the Building Inspector had approved the continuation of the bonds and the certificates were approved as to form by the Acting City Attorney. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the continuation of the aforementioned bonds be approved, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr and Commissioner Morrow; those voting No, none. Authority to attend Fire Chief's meeting - Great Falls 26-27 March: Chief Huber and ABB'r Chief Hoey: It was reported that a meeting of the Montana Fire Cief's is scheduled to be held in Great Falls, 26-27 March 1966, ans in concurrence with the recommendation of the City Manager and the Fire Chief, it was moved by Commissioner Morrow, secnnded by Commissioner Langohr, that Fire Chief Huber and Ass't Fire Chief Roey be authorized to attend the school and, it being in the public interest, their expenses 1 I 1 1 I 1 be paid from the General fund, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow and Commissioner Langohr; those voting No, none. Authority to attend AWWA Convention - Missoula 31 March-2 April 1966 - City Engineer Fargo, Water Superintendent Dunahoo and SDP Operator Larson: It was announced that the American Water Works Association and the Montana Water Pollution Control Association Convention is scheduled to be held in Missoula, 31 March to 2 April 1966, and in concurrence with The City Manager's recommendation, it was moved by CommissionerLangohr, seconded by Commissioner Morrow, that the City Engineer Fargo, Water Superintendent Dunahoo and Sewage Disposal Plant Operator Larson be authorized to attend the convention and, it being in the public interest, their expenses be charged to the appropriate City funds. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr and Commissioner Morrow; those voting No, none. Surety Bond & Oath of office: R.R. Bassett -- Cashier & Water Collector: A surety bond in the amount of $15,000.00 written by Reliance Insurance Company for Raymond R. Bassett, Water collector and cashier, and for a period of one year from 1 March 1966, approved as to form by the Acting City Attorney was presented together with Mr. Bassett's oath of office. It was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the bond and oath of office be approved as presented, and the motion was carried by. the following Aye and No vote: those voting Aye being Commissioner Morrow and Commissioner Langohr; those voting No, none. Release of Old City Hall to Contractor Johnson for demolition: The City Manager informed the Commission that a considerable number of people had toured the Old City Hall on the 16th and 17th of March and that Gene Quaw had rendered an outstanding public service on both days conducting tours and relating the history of the old Opera House on these two days of open house in the old building. Malcom Story also assisted in showing the building. The City Manager ex- plained that the old building has been vacated by the City, items of interest to the historic committee had been removed, and recommended that the building be released to general contractor I.M. Johnson for demolition on Friday, 25 March 1966. In concurrence with the recommendation of The City Manager, it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the old City Hall and Opera House be hereby declared vacated and abandoned for any further public use and released to the general contractor for demolition as of Friday 25 March 1966, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr and Commissioner Morrow; those voting No, none. Military Refresher Course: Fort Knox, Kentucky - Chief of Police Saunders - 27 March 2 weeks: Police Chief Vernon Saunders an active member of the Montana National Guard has been ordered to Fort Knox, Kentucky to partictpate in a refresher course for approximately two weeks beginning 27 March 1966, and has requested that he be granted vacation leave of absence to enable hime to attend the school. The City Manager reported he had approved the request in support of the nations defense program as being in the public interest, and it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the approval of the request be confirmed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Moruowand Commissioner Langohr; those voting No, none. Public Hearing Resolution No. 1252 - (intent to Create SID No. 463 - Paving Thompson's 3rd Addition: This was the time and place set in Commission Resolution No. 1252 to hear protests to the crea- tion of Special Improvement District No. 463. Affidavit of publication of Notice and the Clerk's Mailing Certificate stating that all property owners had been notified as required be law were pre- sented. The City Manager informed the Commission that as of 5:00 o'clock p.m., 22 March 1966, there were no protests on file and no one appeared to verbally protest the creation of extent of the district. :127 :328 The City Manager recommended that The City Attorney be instructed to prepare a resolution creating the district. Commission Resolution No. l256~ entitled: COMMISSION RESOLUTION NO. 1256 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 463 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING AN ASPHALTIC CONCRETE PAVING PROJECT WITH CONCRETE INTREGAL CURB AND GUTTERS, NEO- ESSARY EXCAVATION AND FILL, GRAVEL BACKFILL, NECESSARY STREET MONUMENTS AND OTHER APPURTENANT WORK THERETO, ALSO THE CONS TRU- CTION AND INSTALLATION OF STORM DRAINAGE PIPE, INCLUDING NEC- ESSARY TRENCH EXCAVATION AND BACKFILL INLETS~ MAN-HOLES AND OTHER NECESSARY APPURTENANT STRUCTURES, ON SOUTH TRACY AVENUE ABUTTING ON LOT 2 OF BLOCK 4 AND LOT 5 OF BLOCK 3, HILL STREET FROM SOUTH THIRD AVENUE EASTERLY TO HIGHLAND COURT, AND ON HIGHLAND COURT ABUTTING ON LOT 2 OF BLOCK 5~ LOT 8 OF BLOCK 2, ALL IN THOMPSONS ADDITION NUMBER 3 TO THE CITY OF BOZEMAN~ MONTANA. 1 prepared by the City Attorney was presented. In concurrence with the recommendation of The City Manager~ it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the resolution be passed and adopted to create Special Improvement District No. 463, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr and Commissioner Morrow; those voting No, none. Public Hearing Resolution No. 1253 - Intention to Create SID No. 465, Paving N. 18th and Beall St. This was the time and place set in Commission Resolution No.1253 to hear protests to the creation of Special Improvement District No. 465, affidavit of publication of Notice and the Clerks Mailing Certificate stating that all property owners had been notified as required by law of the district. The City Manager recommended that The City Attorney be instructed to prepare a I were presented. The City Manager informed the Commission that as of 5:00 o'clock p.m., 22 March 1966, there were no protests on file and no one appeared to verbally protest the creation of extent resolution creating the district: Commission Resolution No. 1257, entitled: COMMISSION RESOLUTION NO. 1257 A RESOLUTIOB OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 465 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRU- CTING AND INSTALLING A PAVEMENT PROJECT ON A PORTION OF NORTH EIGHT- EENTH AVENUE BETWEEN WEST BEALL STREET AND THE SOUTHERLY LOT LINES OF LOT 26, BLOCK A, AND LOT 9 OF BLOCK B, GRAF"s FIRST REARRANGEMENT OF BLOCK 6, KIRKS SECOND SUBDIVISION~ AND A PORTION OF WEST ~EALL STREET FROM THE CENTERLINE OF THE ALLEY OF BLOCK A TO THE CENTERLINE OF THE ALLEY OF BLOCK B OF SAID GRAF' S FIRST REARRANGEMENT OF BLOCK 6, CITY OF BOZEMAN, MONTANA. prepared by the City Attorney was presented. In concurrence with the recommendation of The City Manager, it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the resolution be passed and adopted to create Special Improvement District No. 465, and the motion was carried by the following Aye and No Vote: those Voting Aye being Commissioner Langohr and Commissioner Morrow; those voting No, none.
