The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday, 27 April 1966, at 1:00 o'clock p.m. Present were Mayor Sedivy, Commissioner
Morrow, Commissioner Langohr, City Manager Cutting, Ass't City Manager Fryslie, City Attorney Berg
and the Clerk.
Mayor Sedivy opened the meeting with a prayer and the following proceedings were had:
Minutes of the last regular session held Wednesday, 20 April 1966, were read and it was moved
by Commissioner Langohr, seconded by Commissioner Morrow, that the minutes be approved as read,
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner'
Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none.
Protests on Eldri.dge property between South l':lth and 19th AVl'ntH?S on Babcock Street:
Mrs. Earl Peace, Mrs. O. O. Thomas and Mike Steiner again appeared before the Commission re-
garding protesting of the Eldridge property for use as a trailer court. A letter protesting in-
sta11ation of the trailer court was also in the hands of the Commission and the interested groups
asked for an opinion by the City Attorney in regard to any action that could be initiated by the
City to stop the installation. After considerable discussion, The City Attorney agreed to give them
an answer at the next Commission meeting to be held 4 May 1966.

BE TO THE BEST INTEREST OF THE CITY OF BOZEMAN AND THE INHABITANTS THERE-
OF AND OF THE INHABITANTS OF A TRACT OF LAND CONTIGUOUS TO THE SAID CITY
OF BOZEMAN AND HEREIN MORE PARTICULARLY DESCRIBED TO EXTEND THE BOUNDAR-

prepared by the City Attorney as instructed by the City Commission during its meeting of April
20, 1966, was presented. The City Manager recommended that the Commission adopt the resolution and
it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the resolution be
passed and adopted, and May 25, 1966, be set as the date for public hearin, and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner
Langohr and Mayor Sedivy; those voting No, none.
Watershed & Feasibility Study: Bozeman, Hyalite and Cottonwood Creeks: S.C.S.:
Mr. Kenneth Harmon from the Soil Conservation Service appeared before the Commission to explain
the needs for a study of the Bozeman, Hyalite, and Cottonwood Creeks Watersheds. He described the
problem of water storage and supply, flooding, irrigation, drainage, and other water management pro-
blems, including the need for recreational development, to show why Federal assistance is needed, and
also explained the application for this study to be made by his agency without cost to the City or
other agencies. Following a discussion of the watersheds needs and in concurrence with the re-
commendation of The City Manager, it was moved by Commissioner Morrow, seconded by Commissioner
Langohr, that this application for this watershed study be considered as long range planning that
could lead to carrying out works of improvement under the watershed protection and flooding pre-

vention progranv'be 'approved and entered into by the City as a sponsor, and that The City Manager
be authorized and directed to sign the application for the City, and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and

Request to Install Poles - Old Country Club fireworks area - Exchange Club:
Howard L. Painter and Marshall B. Bennett, representatives of the Bozeman Exchange Club,
appeared before the City Commission to ask permission to stage its annual 4th of July fireworks
display on 4 July 1966, in the area of the former Bozeman Country Club in accordance with the
same agreement as granted by the City to the club in prior years. They also asked permission to
install eighteen poles for permanent use in order that their display would be more substantial and
they also asked the City to improve the two entrances to the area in order that the present hazzard
to traffic would be eliminated. The City Manager recommended granting the request to stage the dis-
play and install the poles permanently with the understanding the poles would be installed and re-
moved at City request at the expense of the Exchange Club. It was moved by Commissioner Morrow,
seconded by Commissioner Langohr, that the above request be granted, as recommended, and the motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner
Langohr and Mayor Sedivy; those voting No, none.
Rearrangement of Thompson's 3rd Addition:
Jr. Tschache developer of the Thompson's 3rd Addition appeared before the Commission in regard
to the approval of the Rearrangement of Lot 8, Block 2 - Lot 5, Block 2 - Lots 2, 3, 8, Block 4
Lot 2, Block 5, Thompson's Addition No.3 to the City of Bozeman. The Park dedication included as
Lot 2, Block 5, completes provision of park land within the original Thompson Master Plan approved
in 1960 and exceeds the one-ninth requirement imposed by State Code.
In concurrence with the recommendation of the City Manager, it was moved by Commissioner
Langohr, seconded by Commissioner Morrow, that the plat be approved and the City Manager, be author-
ized to sign the plat as Director of Public Service, and the motion was carried by the following
Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy:
those voting No, none.
Park Project A'pplication for Grant Assistance:
The Recreation Director was present and together with the City Manager explained to the City
Commission, the components of an application to the Bureau of Outdoor Recreation for a grant in the
amount of $50,000.00 as fifty percent funding for the development of Kirk Park. The City's
Matching funds being proposed to be obtained from Commission Resolution No. 1262, S.I.D. No. 470
declaring it to be the intention of the City of Bozeman, Montana, to create a Special Improvement
District to be known as Special Improvement District No. 470 for the purpose of developing a portion
of Kirk Park, said proposed development to provide for multi-purpose play area, children's piay area,
picnic area, shade and decorative trees and shrubbery, sanitary facilities, pathways, dedication
monument, and special improvements such as waterlines, sewers and pavement of the portion of the
streets adjacent to and abutting Kirk Park.
It was moved by Commissioner Morrow, seconded by Commissioner Langohr, that submission of the
subject application be approved and the Mayor and the Clerk be authorized to execute the application
on behalf of the City and that Harold A. Fryslie be designated as the coordinator for this project,
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none.
Request to hold Candy Sale - Camp Fire Girls; Friday - 29 April 196b:
A letter addressed to the City Commission requesting permission for the Campfire Girls to hold
a candy sale on Friday, 29 April 1966, was presented to the City Commission, In concurrence with the
recommendation of the City Manager, it was moved by Commissioner Langohr, seconded by Commissioner

Lobby. The City Manager also advised the Commission that the full retail price of the drapes as
quoted above would be $482.93. It was moved by Commissioner Langohr, seconded by Commissioner Morrow,
that the purchase of the subject drapes from the Chambers Fisher Company on the basis of that quotation
be approved and that Vice President and General Manager, William C. Hanshaw of that company be commended

It was reported that the State Library Association has scheduled a convention to be held in
Missoula, 12-14 May 1966, and the City Manager recommended that Miss Margaret Hileman, City Lib-
rarian, be authorized to attend the convention and, it being in the public interest, her expenses
be paid from the Library Fund, It was moved by Commissioner Morrow, seconded by Commissioner
langohr, that Miss Hileman's travel be approved as recommended, and the motion was carried by
the following Aye and No vote; those voting Aye being Commissioner Morrow, Commissioner Langohr
and Mayor Sedivy; those voting No, none.
Consideration of City Flags:
It was announced that the flag design submitted by Mrs. Edward (Doris) Ward of 1035 East
Olive was the design chosen by the contest judging committee as the contest winner and that action
of the committee could be construed as the committee's recomendation as the design for the official
Bozeman City flag. The City Manager stated he would write letters of inquiry to various flag manufact-
urers seeking information about the cost of having the flag made, and that he concurred in the
recomnlendation of the judging committee in view of the impressive competence of that committee. It
was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the design submitted by
Mrs. Edward Ward and chosen by the judging committee, be designated as the official flag of the
City of Bozeman with the approved option of adding the wording "City of Bozeman" to the design in
an appropriate manner, and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none.
Recognition of National Maritime Day - observed on 23 Nay 1966:
A letter was presented, received from the Maritime Commission, requesting recognition of
National Maritime Day, 23 May 1966, and cooperation with the programs of that Agency to be held on
22 May 1966. The Commission directed that Administrator Nicholas Johnson's letter be acknowledged
and that he be assured of our admiration of his agency and the Merchant Marine and of the City's
desire to fully cooperate in the program's observing National Maritime Day.
Draperies [or Business Office & Police Lobbies -- $337.28:
It was reported that Chambers Fisher Company had furnished the City with a quotation of $337.28
for finished complete and installed draperies for the Municipal Business Office and Police Department
for his civic interest and generous offer to supply this need.
The motion was carried by the

Contribution - Thomas, Dean & Hoskins, Inc., $50.00:
A letter dated, 26 April 1966, addressed to the City Manager from Engineer Consultant Thomas,
Dean and Hoskins, Inc., along with the check in the amount of $50.00. was presented. The firm

stated its desire to contribute that amount toward furnishing the new Municipal Building with their
contribution to be used at the discretion of the City Commission, and also congratulated the City
Administration and the citizens of Bozeman in accomplishing such a splendid improvement to the
City. In concurrence with the recommendation of the City Manager, it was moved by Commissioner

Morrow, seconded by Commissioner Langohr, that the contribution of $50.00 from Thomas, Dean and
Hoskins, Inc., for the purpose stated be accepted and that an expression of appreciation from
the City Administration be directed to that company, and the motion was carried by the following
Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor
Sedivy; those voting No, none.
Consideration of Claims to Contractors:

The following claims to contractors for the Municipal Building as prepared by the Architects
Berg and Grabow were presented as follows:

Coast to Coast Stores

A letter from Architect Oswald Berg, Jr. explained that the claim for the General Contractor
included a release of earnings leaving only a remainder of $15,000.00 to insure completion of the
contract. The letter also stated that the claim for Coast to Coast Stores represented full and
final payment to that firm since all of the work under the electrical contract had been completed.
The City Manager stated that he had audited the claims, that he was in agreement with the indicated
release of retained percentage of funds to Contractor Ingolf Johnson and recommended that the

claims be approved. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the
claims be approved and the motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none.
Realtors Week Proclamation: Week of 22-28 May 1966.
Mayor Sedivy, in concurrence with the recommendation of the City Commission proclaimed the
week of 22-28 May 1966 to be Realtor Week in Bozeman.
License Bond: Western Plumbing and Heating - Livingston, Montana: Gas Fitter and Plumbing:
In compliance with Chapter 16 of the Bozeman Municipal Code, the gas fitter and plumbing bond
oc Western Plumbing and Heating of Livingston, was presented. The City Manager stated the Building
Inspector had recommended approval of the bond and the City Attorney had approved the bond as to

form. It was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the bond be
approved, and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none.
