The Commission of the City of Bozeman met in regular ssssion in the Commission
Room, City Hall Building, Wednesda.y, 8 September 1965, at I:OO o'clock p.m. Present
were Mayor Morrow, Commissioner Sedi vy, CommiSSioner Langohr, City Manager Cutting,
Ass't City Manager Fryslie, City Attorney Berg and the Clerk. I
Mayor Morrow opened the meeting wi th a prayer and the following proceedings
were had:
Minutes of the last regular session held Wednesday, 1 ~eptember 1965, were read
and it was moved by Commissioner Langohr, seconded by Commissioner Sedi vy, tha t the
minutes be approved as read and the mo tion was carried by' the follow ing Aye and No
vote: those voting Aye being Mayor Morrow, Commissioner Langohr and Commissioner
Sedi vy; those voting No, none.
Ligh t Bulb Sa le - Lion's Club: 22 Sep tember, 1965 - 5:00 o'clock to 9:00 o'clock p.m.
Richard Wike and Al Reimers representing the Lion's Club, were present to request
permission to hold their annual light bulb sale on wednesda:v, 22 September 1965, be-
tween 5:00 o'clock and 9:00 o'clock p.m. It was moved by Comm:i.ssioner Sedivy, seconded
by Commissioner Lan~ohr, tha t permis s i on to sell light bulbs be gran ted and the
motion was carried by the follow1ng Aye and No vote: those voting Aye being Ma yor

Central P.T.A. - Mr. Richard 1. Hamil ton
Establishment of a temporary "Mother's Patrol" to serve at North Seventh until I.
the construction is completed was requested by Richard I. Hamilton, on behalf of the
Central Council P.T.A. of which he is chairman.
The City CommIssion was informed by The City Attorney that authorization for
the organization and supervision of safety patrols lies only with the school authorities.
It was also reported that the City safety director who is the City Manager has the
power to designate the location of school crossings at which these patrols may operate.
The City Mana ger rec-:mmended tha t temporary school crossings be established on
Seventh at,Villard and on I'each at Grand in addition to the school crossing at Short
Street and Seventh Avenue and at Fifth Avenue and Durston Road already established
by City code. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy,
that temporary school crossings be established on North Seventh Avenue and on Durston

There is serious need for basement area and Mr. Ingolf Johnson has quoted a
price of fifty-cents per square foot for an additional twenty-six hundred square feet
of floor or a total of $1,300.00 to finish the basement floor in the administrative I
Unit of the Municipal Building Facility at this time . In con currence with the re-
commendation of The City Manager, it was moved by Commissioner Sedivy, seconded by
Commis s ioner La ngo hI' , that Ingolf Johnson be given the au thori ty to complete the
basement floor and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor M,ycrow, Commissioner Sedivy and Commissioner Langohr; those
voting No, none.

This was the time and place set for hearing protests to levying assessment for
Special Improvement District No. 445. Affidavit of publication of Notice was presented.
No one was present to protest and no protests having been filed, Resolution No. 1223
I provisionallypassed and adopted at the regular meeting held September 8, 1965, was
presented for final passage. In concurrence with the recommendation of the City
Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that

1965, was presented for final passage. In conncurrence with the recommendation of

A letter received from the ~lre Chief announcing the t l~odney Roys and Daniel
Figgins had satisfactorily completed the required six months period of their temporar y

and probe tionar y appointments as Lieu tenants and Firefighter respec ti vely in the
Bozeman Fire Department. The City Manager had confirmed these appoin tmen ts as a
permanent status subject to the approval of the Commission. It was moved by Comm-

The City Manager reported the International Association Chief of Police Con-
ven tion 1s scheduled to be L~eld in Miami Beach, Florida, October 2nd thru the 7th,
and recommended, in concurrence with the Police Commission, that Chief Vernon J.
Saunders be authorized to attend the convention. It was moved by Commissioner .
Langohr, seccncIed by Commissioner Sedivy, tha t t h3 Chief of Police, Vernon J. Saunders
be authorized to attend the cc;nvention and, it being in the public interest, expens es
in the approximate amount of $500.00 be charged to ilie General Fund. The motion was

Request for Student Loading Zcme: Willson School - Main Street between 4th & 5th Avenue
A letter from the Superintendent of Schols, addressed to Vernon J. Saunders,
Chief of Police, requestlng that the City provide for a student loading area in front
of the Willson Elementary SChool on ~faln Street for a distance of approxirrately eight
car lengths was presented. It was 'Suggested tha t the school will furnish the signs
and the Ci ty will ins tall them. In concur rance wi th the recommenda tlon of the City
Manager, it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, tha t

A general discussion regarding the contracts of S~lder & Sons and the over-run
on time limit was held. The y were scheduled to comple te cons truction by July 22, 1965,
but did not complete the construction until AugustJ..9, 1965, due to weather conditions.
The City Manager and the City Engineer concurred in the recommendation of the consult-
ant engineer, and the Manager informed the Commission that a determination had been
made that all VAlid claims against the con tractor resulting from the construction have
been paid, and recommended that any penalties against the contractor for over-run of
the contract time be waived. It was moved by Commis si oner Lan gobr, seCDnded by Comm-
issioner Sedivy, tha t in concurr'ence with the foregoing recommendations, the contrac t
work in Special Improvement District No's. 444, 446, 440, 450 and 455 be approved and
accepted as completed and that any penalties for over-run of contract tmle be waived
and final payment be made to the contractor upon presentation of a final es tima te

Sidewalks on South Willson: Hayes to M::lson Street. I
It was reported that there have been repeated requests to ha ve side v,a lks in-
stalled on South Willson between Hayes and Mason Street. After em sidera Ibe discuss ion

order sidewalks to be installed on the east side of Willson Avenue for the approximate
distance between Hayes and Mason Streets for the 1966 sidewalk program and so notify

An agreement to provide a Right of Way easement from Mon tana Power Comre ny for
moving the gas line in order to construct the tunne 1 1n the aIle y was pre sented. The
Ci ty Manager recommended tha t the City enter into the agreement, and it was moved by
Commissioner Langohr, seconded by Commissioner Sedivy, that the easement agreement
be entered into and the Mayor and the Clerk of the Commission be authorized and dir-

In compliance with Chapter 16 of the Bozeman Municipal Code, the cer tifi ca te
for the Electricians bond of George Norman, written by Western Surety Co., was pre-
sented. The City Manager stated the Building Inspector had recommended the aprroval
of the bond and the certificate had been approved as to form by the City Attorney. It
was moved by Commissioner Langohr, seconded by Commissioner ~edivy, that the afore-

The City Manager commented on the claims and stated he had audited them and_
found them to be true and lawful c1aim~ against the City of Bozeman and recom~ended
that they be approved and the Director of Finance be directed to is sue warrants in
paymen t. After examination of the claims in detail and checking agalnst the claim
register, it was moved by Commissioner Langohr, seconded by Commissioner Sedivy,
that the claims be approved and the motion was carried by the fOllowIng Aye and No
