HomeMy WebLinkAbout1965-09-15 234 Bozeman, Mo~tana September 15, 1965 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall BUilding, Wednesday, 15 September 1965, at I:OU o'clock p.m. present were Mayor Morrow, Commissioner Sedivy, Commissioner Langohr, City Manager Cutting, Ass't City Manager Fryslie, City Attorney Berg and the Clerk. I Commissioner Langohr opened the meeting with a prayer and the fOllowing pro- ceedings were had: Minutes of the la st regular session held Wednesday, 8 September 1965, were read and it was moved by Commissioner Sedivy, seconded by CommIssioner Langollr, that the minutes be approved as read and the motion was carried by the fOllOWing Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; those voting No, none. Au thori t 'Y to Inve s t funds: Police Reserve - $2,500.00) U.S. Bonds permanent Care - b,ouo.ao) U.s. tlonds The City Manager informed the Commission that the Director of Finance had re- quested authority to invest operation funds in U.S. Government Securities as follows: Police Reserve - $2,500.00 maturing in 1972 Permanent Care - 5,000.00 maturing in 1973 The City Manager concurred in the request and it was moved by Commissioner Langohr, seconded by Commissioner by CommissIoner Sedivy, that the investments be authorized as requested and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner I Langohr ; those voting No, none. Report of Audits: (a) Sta te Examiner (b): CPA - Water Funds A complete annual audit by the state Examiner of all City funds and also a copy of the annual audit of Ci ty wa ter funds by ClArk, Stiff and Kirchoff, certi- fied public accountants, was presented to the City Commission for review. Appointment of Campus Police 8S Special Oi ty Police Officers A letter from R. J. Mullica, Ohief Traffic and Security Department officer of the Montana State University requesting that the following members of their campus police force be d.esigna ted as SpecIal Policemen of the Bozeman City Police force for another year ending September 15, 1966, without cost to the ~ity, was presented: John S. Dougherty - Route 2 Donald Skerrltt . 307 N. Willson Harold W. Pettus - Rau te 1 Loren G. Winks - 116 E. Dickerson Robert J. Mullica - 426 N. 4th It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, tba t in concurrence with the recommendation of the Police Chief and the City Manager, the appoints as requested be approved and the motion was carried by the following Aye I and No vote: those voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr ; those voting No, none. Rip;ht of 'Nay Easement S.I.D. No. 454 East side S~wer An agreement to provide a right-Of-way easement from the Humble Oil & Refining Company for the installation of an eight inch Sewer lateral in Special Improvement _m__n._________ 235 Dlstlrct No. 454 on East Main Street was presented. The City Manager recommended tha t the City enter in to the agreemen t, and it was moved by Commissioner Langohr, seconded by Connnissioner Sedivy, that the right-of-way easement be approved and the Mayor and the Clerk of the Commission be au thorized and directed to sign for the Ci ty and the motion was carried by the following Aye and No vote: those vo ting Aye I being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; tbose voting No, None. For final passage &. special tax levy: Resolution No. 1227 - S.l.D. No. 449 This was the time and place set for hearing pro tes ts to levying assessmen t for Special Improvement District No. 449. Affidavi t of publica tion of Notice was presented. No one was present to protest and no protests having been filed, Resolution No. 1227 provisionally passed and adopted a t the regular meeting held September 8, 1965, was presented for final passage. In concurrenoe with the recommendation of the City Manager, it was moved by Commissi)ner Sedi vy, seconded by Commissioner Langohr, tha t the resolution be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye be.ing Mayor Morrow, Commissioner Sedivy, and Commissi)ner Langohr; those voting No, none. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the resolution be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Sedivy, and Commissioner Langohr; those votIng No, none. COMMISSION RESOLUTION NO. 1235 A RESOLUTION OF 'IRE COMMISSION OF THI~ CITY OF BOZEMAN, MONTANA LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 458 IN THE CITY OF BOZEMAN, COUNTY OF GALIA TIN, STATE OF MONTMiA TO DEFRAY THE COST OF CONSTRUCTING AND MAKING THE IMPROVEMENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 458. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the resolution be provisionally passed and adopted and September 22, 1965, be set as the d ate for public hearing and the motion was carried by the following Aye and I No vote: those voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner 18ngohr; those voting No, none. PTA - WHITTIER School - Re~ard;n~ stop li~hts & Mothers Patrol A group of mothers of the Wittier Elementary School PTA headed by Mrs. A. J. Lamb, was present to discuss with the Commission the problem of those school children crossing North Seventh Avenue, particularly hazardous due to the construction in progress on tha t a venue and to inquire wha t can be done immedia tely and dur ing tbe interim period, to safeguard the children until construction of t he street is completed and request whatever action is possible to secure the installation of traffic lights. The Whittier PTA mothers reported they have tried a "Mother's patrol," wbich went into operation on Monday and ended on Wednesday, because not only was it dan- gerous tryIng to direct the traffiC, neither was it effective and the question of the mother's liability had been raised. Both the City Attorney and the County Attorney stated they felt the "School Boy pa trol' law, initiated by the last legislature, may not relieve the mothers or adults serving on suoh pa trol of. liability. Upon learnirg these opinions, Mrs. Alan Lamb, I then announced, "The mother's patrols are dissolved, here and now, until we have some- thing official, in writing, relative to liability." The WhittIer PTA were informed that traffic lights are the ultimate solution of the school crossing problem, tm t conduit has been installed on the intersections of both Durston rtoad and Villard Street with Seventh Avenue to permit installation of traffic lights and renewed efforts would be made to obtain the lights, and all City 238 departments will work very closely wi th the school groups and the con trac tor to im- prove school crossing conditions and to control traffIc in order to improve the school cross Ing si tua tion. Centra 1 PTA - Traffic Safe ty Commi ttee - Mr. rlichard I. Hamil ton Mr. .l;{ichard I. Hamil ton, Chairman of the Cen tral PTA 'ITaffic Safety Commi ttee appeared to present a letter addressed to the City Commission containing the following I recommendations of the Bozeman Central Council PTA Traffic Safety Committee, to be aoted upon immedia tely in order to reduoe the hazards to school pupils a t school crossings. 1. Automatic stoplight which would stop traffic during the school traffic ffrush hoursff. Locations: 1. North 7th at Villard and at Durston 2. West Main at 11th 2. Erection and main tenance of uniform school zc;ne and school crossing signs where these do not now exist. :3. Pain ting of curbs a t school crossings to mark of f "no parking area" at such crossings and thil enforcement of local ordinances governing the distance from an intersect- ion that an autbmobi1e may be parked. 4. Painting of roadway approaching sohool zone with suitable lettering (i.e. School Crossing ahead) to serve as add- itional warning to motorists. 5. Painting of stripes on roadway at school crossings where these do not now exist. 6. Trimming of trees, shrubs and other vegetation which obscures visibility of school zone ~nd school crossing signs. I The City Commission also assured the Central PTA - Traffic Safety Committee that it is ever mindful of the local needs and will make every effort within the- .
