The Commission of The C1.ty of Bozeman met in regular session in the Commission
Room, Ci ty Hall Building, Wednesday, 1 December 1965, at 1:00 o'clock p.m. Present
Were Mayor Morrow, Commissioner Sedivy, Commissioner Langohr, Acting City Manager
Frys lie, City Attorney Berg and the Clerk. I
Mayor Morrow opened the meeting with a prayer and the fo llowing proceedings
were had:
Minutes of the last regular session held Wednesday, 24 November 1965, were
read and it was moved by Commissioner Sedivy, Seconded by Commissioner Langohr,
that the minutes be approved as read and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Sedivy and
Commissioner Langohr; those voting No, none.
Authority to Travel - Planning Board Members, Helena, Montana - December 10, 1965.
It was reported a meeting of the ~tate Planning Board Associati~n was sche-
duled for Helena on Friday, 10 December 1965. The AcUng City Manager recommended
that Harold Korslund, president of the Bozeman City-County Planning Board, and
possibly two other be authorized to attend this meeting and the expenses paid from
the planning fund. It was moved by Commissioner Langohr, secan ded by Commis sione r
Sedi vy, that the authorization to attend the meeting on Friday be so approved and
the motion was carried by the following Aye and No vote: those voting Aye Being
Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; those voting No, none. I
purchase of Property - Off Stre et Parklr;g.
Wa.i te and Company, Realtors of Bozeman, as agents, had offered the Jones
property on Wes t Mendenhall Street a t Willson Avenue, be ing Lots 9 to 10 inclusive,
Block A, Tracy's 2nd Addition, to the City for a price of $47,000.00, and acting
on informal instruction from the City Commission, the City made a counter of fer to
purchase the property for $42,500.00 cash.
A letter dated 1 December 1965 from Gardiner C. Waite of Waite and Company,
acting as agent for owners Moses C. and Jefferson Jones, advising of the acceptance
of the City's counter offer to purchase the subject property for a cash price of
$42,500.00 and :Including stipulations that the City 1) give adequate notice to
Lux Transfer, present tenants, and, 2) c lo s e the purchase transaction at the earliest
possi ble da te, was presen ted to the City Commission.
Following discussion and in concurrence with the recommendation of the Acting
City Manager, it was moved by Commissioner Langohr, seconded by Commissioner Sedivy,
that the City Manager, City Attorney and Director of Finance be instructed to pre- I
pare appropriate documents to accomplish the purchase of the Jones property at a
cash price of $42,500.00 without delay, and the motion was carried by the following
Aye and No vote: those vo ting Aye being Mayor Morrow, Commissioner Sedivy and
Commissioner Langohr; those voting No, none.

]eer License - "J & L Land & Livestock Company - one-half year 1965.
An application from the J & L Land & livestock Company for one-half year City
Beer License, together with the re~uired fee of $lUU.OO was presented.
The Acting Ci ty Manager and t he Chief of Police s ta ted they were no t aware of
I any basi a tha t would warrant di sapproval of the ar;plica tion. In concurrence with
the Recommendation of the Acting City Manager, it was moved by Commissioner Sedivy,
seconded by Commissioner Langohr, fuat the application be approved and the Director
of Finance be directed to issue the license in accordance therewith and the motion
was carried by the following Aye and No vote: those voting Aye being Mayor Morrow,
Commissioner Sedivy and Commissioner Langohr; those voting No, none.
Request to in stall temporary schoolboy signs.
It was reported that there have been repeated requests to have schoolboy signs
installed on a temporary basis on North Seventh Avenue on either Villard Street or
Short Street or both and it was moved by Commissioner Langohr, seconded by Commissioner
Sedi vy, that the Montana State Highway Department be contacted requesting permission
to plaoe the schoolboy signs in one of the above areas on a temporary basis and the
motion was carried by the following Aye and No vote: those voting Aye being Mayor
Morrow, Commissioner Sedivy and Commissioner Langohr; those vo ting No, none.

The Acting City Manager commented on the report and recommended approval the r e -

report be approved and ordered filed and the motion was carried by the following
Aye and No vo te: those voting Aye being Mayor Morrow, Commissioner Sedivy, Commissioner
Iangohr; those voting No, none.
Alley between 9th and 10th Avenues - Villard to Dura ton.
A number of interested property owners appeared before the Commission in regard
to the north-south alley, between North 9th and 10th Avenues from Villard Street
to Durston Road. It was reported that this is a dedicated alley which the City
believes should be opened and improved to permi t the establishment of garbage ser-
vice. It should also be established that alleys are public thoroughfares that
should be opened and made serviceable in the public interest. The residents were
also informed that The City has only operational funds available for the maintenance
of streets and alleys and only pit-run gravel could be placed on the aIle y to provide
a base for garbage trucks, however, in the event the proper ty owners wished to do so,
I they may have fine gravel placed in the alleys a t their own expense.
It was moved by Commissioner Sedivy, sec0nded by Commissioner Langohr, that
the subject matter be taken under consideration for further study for a period not
to exceed two weeks to de termine estima ted costs for improving the aIle y wi th fine
gra vel or pa ving, and during which time the Commission will also examine a petition
presented to the City Commission last summer by property owners which asked that

the alley be opened to provide for garbage service, and the motion was carried by
the following Aye and No vote: tho se voting A ye be ing Ma yor Morrow, Commissioner
Sedivy and Commissioner Langohrj those voting No, none.

There being no further business to come before the Commission at this time, I
it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, tha t the
