The Commission of The City of Bozeman met in regular session in the Commission
Room, City Hall Building, Wednesday, 29 December 1965, at 1:00 o'clock p.m. presen t
were Mayor Morrow, Commissioner Sedivy, Commissioner LangohI', City Manager Cutting, I
Ci ty A ttorney Berg and the Clerk.
Commissioner Sedivy opened the meeting with a prayer and the following proceedings
were had:
Minutes of the last regular session held Wednesday, 22 December 1965, were read
and it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the
minutes be approved as read, and the motion was carried by the following Aye and No
vote: Those voting Aye be:l.ng Mayor Morrow, Commissioner Sedivy and Commissioner
Langohr; those voting No, none.
Settlement on Schultz & Lindsay Construction - Paving Contract & final Claims -
441, 442, 443, 445, 447, 448, and 451.
Rela ti ve to the final settlement of the city's contract with Schultz & Lindsay
Construction Company for paving and miscellaneous work in Special Improvement
District No's. 441, 442, 443, 445, 447, 448, and 451, the Commission was reminded tha t
the completion date for the contract was October 1, 1965, and the work was accepted
by the Commission on December 3, 1965.
A letter from consultant engineers Harold Hoskins and Associates dated December
21, 1965, recommended that the contract time be extended 23 days and because of the I.
cooperation and performance of the contractors on this contract and other work with-
in the City during the past season that liquidated damages for the remaining overrun
of the contract time be waived. They also recommended the t in accordance wi th pro-
visions of the contract, that the sum of $2,275.00 be deducted from the contractors
final estimate, for engineering services performed by the consultants beyond the
recommended extension of the contract time. The Commission was also informed that
the contractor had agreed to this settlement as evidenced by the signed final estimates.
The City Engineer and the City Manager having concurred in the above recommend-
ations, it was moved by Commissioner Langohr, seconrged by Commissioner Sedi vy, tha t
the time limit of the contract be extended and final settlement made with the con-
tractors as recommended and the motion was carried by the following Aye and No vote:
those voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr;
those voting No, none.
Petition for Side Walks: West Side of North 7th Ave.: Durston Road to Birch Street.
A petition addressed to the City Commission containing thirty-two names re- I
questing the construction of concrete side walks within the Royal Vista Addition and
Durston's Second Subdivision and particularly along the west side of North Seventh
Avenue from Birch Street to Durston Road was presented. The Commission directed that
the peition be acknowledged and tha t con s idera t ion of the me. tter be given in the
spring of 1966 when the new City Side walk program is established.

Authority to purchase 3/4" Water Meters: Approximately $950.00
The City Manager reported that the Water Department has need for additional
supply of 3/4" water meters and requested authority to .urchase th irty-two ma ter
meters at an approximate cost of $950.0U..lt was moved by Commissioner Langohr,
I seconded by CommIssioner Sedivy, tha t the purchase be approved and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Morrow, Comm-
issioner Sedivy, and Commissioner Langohr; tho se vo ting No, none.
Licenses Applications - City Beer and Liquor Licenses - 1966:
The following applications for City Beer and liquor licenses, tog e the r wi th the

The City Manager and the Chief of Police stated they were not aware of any
I incidents in the operation of the above establishments that would warrant disapproval
of the application. In concurrence wi th the recommenda tion of the Ci ty Manager, it wa s
moved by Commi s si oner Sedivy, seconded by Commissioner Langohr, that the above appli-
cation be approved and the Director of Finance be directed to issue lIcenses in accord-
ance U.i erewi th, and the motion was carried by the following Aye and no vote: those
voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; thos e
voting No, none. .
Ma y'or' s Proc lama tion-=_. "Alien A~dress Report Month" - January 1966 .
Mayor Morrow announced his proclama tion of the month of January 1966 as "Alien
Address Report Month." Aliens are required by law to list their addresses and other
information required by the immigration service in January. Cards for the reports
are available at the nearest post office.
It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that
the Mayor's proclama tion be endoresed and the mo ti on was carried by the following
Aye and No vote: those voting Aye being MayoJ' Morrow, Commissioner Sedivy and Comm-
issioner Langohr; those mUner N0, none.
I Contract: Consul tan t En,g;ineerinp;: Thomas, Dean & Hoskins, Inc. ,
The Commission was informed tha t Tom Thomas and Wa yne Dean, former representatives
of the Harold Hoskins and Associates Engineering Consultant firm who have supervised
the cons tr1Jction of improvements in Spec ial Improvemen t Districts in Bozeman for the
pas t ten ~ars have now incorporated under the new firm name of Thomas, Dean & Hoskins
In c . , to perform all such consultant services previously handled by Harold Hoskins
and Associates in the State of M'ntana. The refer e, new proposed contracts with

Thomas, Dean and Hoskins were presen ted, which if approved by the Commission W01Jld
permit an immediate start on new construction projects for the 1966 season.
In concurrence with the City Engineer, The City Manager recommended that the
City enter into the two new contracts so that engineering services can be rendered
to the City for the construction of paving, water lines, sanitary sewer lines and
storm drainage lines within improvement districts that have been or may be estab- I
lished. It was moved by Commissioner Sedivy, seconded by Commissioner LangohI',
that the two contracts as described be approved and entered into by the City, and
Mayor and the Clerk of the Commission be au thorized and directed to sign f or the
City and the motion was carried by the following Aye and No ~ote: those voting
Aye being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; those voting
No, none.
Adjournment:
There being no further business to come before the Commission at this time,
it was moved by Commis~1ioner Langohr, seconded by Commissioner Sedivy, that the
meeting adjourn, and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Mor row, Commis sioner Sedi vy and Commiss ioner Langohr; those
