HomeMy WebLinkAbout1965-08-25 2t9 Bozeman, Montana 25 August, 1965 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday 25 August 1965, at 1:00 o'clock p.m. Present were Commissioner Sedivy, presiding in the absence of Mayor Morrow as Acting Mayor, I Cmr.missioner Langohr, Ass' t Ci ty Mana ger Frys1ie, City Attorney Berg and the Clerk. Commissioner Ie.ngohr opened the meetlng with a prayer and the following pro- ceedings were had: Minutes of the last regular session held Wednesday, 18 August 1965, were read and it was moved by 1tcting Mayor Sedivy, seconded by Commissioner Langohr, tha t the minutes be approved as read and the motion was carried by the following Aye and No vo te : those voting Aye being Acting Mayor Sedivy and Commissioner Langohr; tho se voting No, none. Mayor's Absence - Approved: In compliance with Chapter 2.08.030 of the Bozeman Municipal Code, it was moved by Commissioner Langohr, seconded by Acting Mayor Sedivy, tha t Mayor Morrow be gran ted vacation leave of Absence from August 19, 1965, to Augu st 31, 1965, and the t Comm- iss ioner Sedivy be designa ted as acting Presiden t Pro Tempore of the Commission, and the motion was oarried by the fo llowing Aye and No vote: those vo ting Aye being Acting Mayor Sedivy and Commissioner Sedivy; those voting No, none. Face Amount (Denomination) S.I.D. Bond No's. 456 - $500.00, 457 - $1,000.00, 45E3 - $500.00 I It was reported tha t the Attorney, Mr. Wesley W. Wertz, examining the trans- cript of the proceedings on SpeCial Improvement District No's. 456, 457, and 458 requested that the City Take some official action in setting the amount or denom- ination of these bonds and in compliance with this request, it was moved by Aoting Mayor Sedivy, seoonded by Connnissioner Langohr, tha t the bonds in the to ta 1 amoun t of $15,000.00 for Speoial Improvement District No. 456 for a period of twenty years be in the denomination of $500.00 each and shall be dated August 1, 1965. The motion was carried by the following Aye and No vote: those voting Aye being Acting Mayor Sedivy and Commissioner Langohr; those voting No, none. It was moved by Commissioner Langohr, seconded by Acting Mayor Sedivy, tha t the bonds in the total amount of $62,OUO.00 for Special Improvement District No. 457 for a period of t wen ty years be in the --denomina tion of $1,000.00 ea.ch and shall be da ted August 1, 1965, The motion was carried by the following Aye and No vo te : those voting Aye being Acting Mayor Sedivy and Commissioner Langohr; those voting No, none. It was moved by Acting Mayor Sedivy, seconded by (;ommissioner Langohr, that the bonds in the total amount of $9,000.00 for Special Improvement Distriot No. 458 I for a period of ten years be in the denomination of $500.00 each and shall be dated August 1, 1965. The motion was oarried by the following Aye and No vote: those voting Aye being Acting Mayor Sedivy and Commissioner Langohr; those voting No, none. Authority to Invest funds: $100,000 Bldg. Funds 30 da funds 30 da y C. D . , 100,000 Miscl funds 30 day Treas. bills, It was reported that the Director of Finance had requested authority to invest tIOO,OOO building funds for thirty days in Certifica tes of Deposit, $100,000 Miscl. 220 funds for thirty days in Certificates of. Deposit, $100,000 Miscl. funds for thirty days in U.S. Treasury Bonds, and $100,000 Miscl.'funds for sixty days in U .8. Treas- ury Bonds. In concurrence wi th the reconmenda tion of t he Ac ti ng C i tyManager, it was moved by Acting Mayor Sedivy, seconded by Commissioner Langohr, that the invest- ments as requested be approved and the motion was carried by the following Aye and I No vote: those voting Aye being Acting Mayor Sedivy and Commission er Langohr; those voting No, none. Cancellation Electrical Bond: Herb's Electric A letter requesting that the Electrician's bond and license of Herb's Electric, be cancelled, was presented. The Acting city Manager recommended that the City comply wi th the reques t and it was moved by Commis sionerLan gohr, seconded by Ac ting Mayor Sedivy, that the cancellation of the bond be approved and the motion was carried by the following Aye and No vote: those voting Aye being Acting Mayor Sedivy and Commissioner Sedivy; those voting No, none. Approve Electrical Bond -I.?en Hespen The Electrical bond of Ben Hespen was presented. The bond having been approved by the City Building Inspector and as to form by the City Attorney, it was moved by Commissioner Langohr, seconded by Acting Mayor Sedivy, tha t the aforementioned bond be approved and the motion was carried by the following Aye and No vote: those voting Aye being Acting Mayor Sedi vy and Commissioner Langohr; those voting No, none. Determination - No primary election - 31 August 1965: 11-3215 R.C.M. 1947. I In compliance with Chapter 11-3215, paragraph (5) of R.C.M. 1947, it was reported tha t since the number of legally qualified candida tea for the office of Commissioner a t such primary election did not exceed twice tbe number of vaoancies in the Commission to be filled, no Municipal Primary Election would be held for the year 1965 and the two qualified candidates, R. Harry Morrow and Donald D.Lanphear, shall be deemed duly nominated and shall be placed on the general ballot. In con- currence with the recommendation of the Acting City Manager, it was moved by Acting Mayor Sedivy, seconded by Commissioner Langohr, that no primary election be held and that the two candidates be declared nominees for the general election and the motion was carried by the following Aye and No vote: those voting Aye being Acting Mayor Sedivy and Commissioner Langohr; those voting No, none. Resolution No. 1219 - Assessin~ S.I.D. No. 441: Provisional Passa~e: Resolution No. 1219 levying assessment for the construction of Special Improvement District No. 441 in the amount of $72,000.00 was presented entitled: COMMISSION RESOLUTION NO. 1219 A RESOLUTION OF 'IRE COMMISSION OF THE CITY OF BOZEMAN, I MONTANA LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 441 IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CON- STRUCTING AND MAKING THE r~PROVEMENTS WITHIN SAID SPECIAL D~PROVEMENT DISTRICT NO. 441. It was moved by Commissioner Langohr, seconded by Acting Mayor Sedivy, I that the report be approved and the motion was carried by the following Aye and No vote: those voting Aye being Acting Mayor Sedivy and Commissioner, Langohr; those voting No, none. Mrmtana State Highway Commission - Share of cost of North Seventh Ave. & Main Street. The Montana State Highway Commission submitted to the City of Bozeman a claim in the amount of $182,151.42 in payment of the City of Bozeman's participating share of the oost of construction of Federal Aid Project U 222 (16), 7th Avenue and Main Street in Bozeman ~pecial Improvement District No. 452.
