HomeMy WebLinkAbout1965-04-28 147 Bozemans Montana April 2 , 1965 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hail Building, Wednesday, 28 April 1965, at 1:00 Of clock p.m. Present were Mayor Morrow, Commissioner Sedivy, Commissioner Langohr, City Manager Cutting, v Ass't ity Manager Fryslie, ~nd the Clerk. I Commissioner Sedivy opened the meeting with a prayer ~d the following proceedings were had: Minutes of the last regular session held Wednesday, i4 April 1965, were read and it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, tha t the minutes be approved as read and the motion was carried by the following Aye and No vote: Those voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; thos e va Ung No, ncne. Consideration of Bids: utilities - S.U.D. No's. 444, 446, 449, 450 and 455 - H. J. Studer & Son. Bids opened on April 21, 1965, for propr;sed construction of the water mains, sanitary sewer lines and storm drainage improvements in Special Improvement District No's. 444, 446, 449, 450 and 455 were brought before the Commission for consideration of contract award. As directed, the City Engineer and the engineers representing consultant Harold Hoskins and Associates had checked the extensions of all bids submitted, prepared the final tabulations and recommended that R. J. Studer and Sons. Billings, Montana, be awarded the contract far the above mentioned improvements, the I firms bid of $112,421.70 being the lowest a nd best bid submi tted. The City Manager concurred in the recommendation of the Engineers and it was moved by Commissioner Langohr , seconded by Commissioner Sedivy, that subject to the sale of 1he bonds of the districts, R. J. Studer & Sons be awarded the contract for the construction in Special Improvement District No's. 444, 446, 449, 450 and 455 on the basis of their low bid of $112,421.70 and the bid securi ty of the unsllccessfu1 bidders be returned The motion was carried by the following Aye and No vote: those va ting Aye being Ma yor Morrow, Commissioner Sedivy and Corrrrnissioner Larg ohr; those voting No, none. Consideration of BidS: Pavement & Draina e - S.l.D. No's. 441 Schul tz & Lindsay Constru ction Company Bids opened on April 21, 1965, far proposed paving and storm drainage in Special Improvement District No's. 441, 442, 443, 445, 447, 448 and 451 were brought before the Commission for consideration of contract award. As Directed, the Ci ty Engineer and the engineers representing consultants Harold Hoskins and Associates had checked the extensions of all bids submitted, prepared the final tabulations and recommended that Schultz & Lindsay Construction Company of Billings, Montana, be awarded the contract for the above mentioned improvements, the firm's bid of $215,257.47 being .1 the lowest and best bid submi tted. The City Manager concurred in the recommendation of the Engineers and it was moved by Commissioner Sedivy, seconded by Commissioner L9.ngohr, that subject to the sale of the bonds of the districts, Schultz & Lindsay '....,. The motion was carried by the following Aye and No vote; thoffi voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; those voting No, none. 1_48 Report of Fireman Command School - Yakima, Washington 12-15 Afril; (Chief Huber and Ass t Ohler Hoey.) In the absence of Fire Chief Huber, Ass't Chief Hoey reported on their attend- ance at the Fireman's Command School conducted at Yakima, Washington, during April 12 tbru the 15th. Ass't Chief Hoe:1 was particularly oomplimentary as to the manner in which the school was conducted and remarked the guest speakers were very in- I forma ti ve. He also reported they were trying to organize a Command School to be held in the State of Montana for the convenience of the Firemen of this state. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that Ass't Chief Hoey be highly commended on the excellent manner in which the report was presented and tha tit be accepted and approved and the motion was carried by- the following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr ; those voting No, none. Resolutjon No. 1194 - Tntention to Create S.I.D. No. 458 (Sanitary Sewer North 7th.) Resolution No. 1194 Commission Resolution No. 1194, Entitled: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN MONTANA, DECLARING I T TO BE THE INTENTION OF THE CITY Q!t' BOZEMAN TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 458 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING AN EIGHT INCH SANITARY SEWER LINE IN THE A LLEYS OF BLOCK ONE AND PORTION OF BLOCK TWO OF DURSTON'S SECOND SUB- DTrVISION TO THE CITY OF BOZEMAN, MONTANA. prepared by the City Attorney was presented. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Langohr, secorrled by Commissioner I Sedivy, t hat the resolution be passed and adopted and May 19, 1965, be set as the date for public hearing and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; those voting No, none. Completion of Sale of Bonds for S.I.D. No._~5?_-~E!ain Stre_et ~-N.()E.E.h. .s.evenj;!l~JJj~7i~/~5YOl Reference was made to the action of the Commission receiving bids for the bonds (, for Special Improvement District No. 452 on March 17, 1965, information having been received that the construction contract bas now been awarded by the State Highway Commission for the reconstruction paving projec~ ,on Main Street and North Seventh Avenue, Special Improvement District No. 452, it is therefore now in order to complete the sale of the bonds to Securi ty Bank &: Trust Company, Boze~n'J.T', .Montana and Piper Jaffray, & HopWOOd, Minneapolis, Minnesota. Following the recommendation of the Director of Finance, concurred in by the Ci ty Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the sale of the bonds in the amount of $185,000.00 be awarded to the Security I Bank & Trust Company, Bozeman, Montana and Piper, Jaffrey & HopWOOd, Minneapolis, Minnesota, on the basis of their low bid of 3.94% and the motion was carried by the following Aye and No vote: those voting aye being May-or Morrow, Commissioner Sedivy and Commissioner Langohr; those voting No, none. Utility Easement Agreement - C.M.St.? &"k.~ailw~ S.T.D. No. 446-447 An agreement to provide a utility easement from the Chicago, Milwaukee, St. Paul and Pacific Railway for the water mains and sanitary sewers installation in Special Improvement District No. 446 and the paving project in Special Improvement District 149 No. 447, on South Third Avenue and Greekway Subdivision was presented. The City Manager recommended that the City enter in to the a greeme nt . It was moved by Comm- Issioner Langobr, seconded by Commissioner Sedi vy, that the Easement Agreement be entered into by the City, and the Mayor and Clerk of the Commission be authorized and directed to aign for the City and the motion was carried by the following Aye I and No vote: those voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner Iangohr ; those voting No, none. License Bond - Electrical - Curley Nay.br Electric Company - Billln~s In compliance with Chapter 16 of the Bozeman Municipal Code, the electrical license bonds of Curley-Naylor Electric Company, Billings, Montana, was presented. The City Manager stated the Building Inspector had recommended the approval of the bond, and the bond had been approved as to form by the City Attorney. It was moved by Commissioner Sedivy, seconded by Connnissioner Iangohr, tre t the aforementioned bond be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner Iangohr; those voting No, none. Authority to purchase thirty-two (32) 3/4" Water Meters - ApprOXimately $950.00. The City Manager reported that the Water Department has need for additional supply of 3/4" water meters and requested authority to :purchase thirty-two water meters at an approximate cost of $950.00. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, tha t the purchase be approved and the motion was I carried by the following Aye and No vote; those voting Aye being Mayor Morrow, Commissioner Sedivy and COF~issioner Langohr; those voting No, none. Reque st for Poppy De y Sale - 22 MaY_.:I-965 Veterans of Foreign Wars. (V.F.W.) A request from the Veterans of Foreign Wars to designate Saturday May 22_.1965, as "Poppy De. y" and parmi t the sale of the poppies on the t da y was read. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the request be granted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner Lsngohr; those voting No, none. Right of Way Easement - Marguerite Kirk property west of south 20th: S.I.D. No. 456 An agreement to provide a right-of-way easement for the purpose of installing a sanitary sewer in Special Improvement District No. 456 across the property of Marguerite Kirk west of South 20th was presented. The City Manager recommended that the City enter into the agreement, and it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the easement agreement be entered into by the City and the Mayor and Clerk of the Commission be authorized and directed to I sign for the City. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner ~edivy and Commissioner Langobr; thos e voting No, none. Public Hearin Resolution No. 1190 This was the time and place set in Commission Resolution No. 1190 to hear protests to the creation of ~pecial Improvement District No. 457. The City Manager informed the Commission that as of 5:00 o'clock P.M. April 24, 1965, there were no protests on file. Following a discussion of the proposed district and since there were no pro- tests on file and no one present to protest, the City Manager reoommended that the I City Attorney be instructed to prepare a Resolution creating the district.
