I Mayor Morrow opened the me eting with a pra yer and the fo llowing proceedings were had: Minu tes of the last regular session held Wednesday, 28 April/t65, were read and it was moved by Commissioner Langohr, second ed by Commie stoner Sedivy-, tha. t the minutes be approved as read and the motion was carried by the following Aye & No vote: those voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; those voting No, none. Minutes of the Special Meeting held Thursday, 29 April 1965, were read and it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, tha t the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; those voting No, none. Request: Jayceens to build cyclone fence - hold ti cket sale . Mrs. Vernon Whiteman, President of the Jayceens, appeared before the Commission to re(1uest permission for the Jayceens to build a cyclone fence on one side of Bogarts Grove along the creek and to extend to the end of the tennis court area for a pro- I taction to the children playing ih this area. After discussing the proposed request, the Commission agreed that fencing this area may present a bigger hazard th9.n now exists and recommended the JayceBDs oonsider sponsoring some other community project of which there are many to choose. Mrs. Whiteman also requested permission to set up a booth on Main Street from which to sell tickets Satul!day, Monday and possibly- Tuesday for the Musical of Irma LaDuca to be held on Tuesday, May 11, 1965. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that permission to set up the booth and conduct the sale be granted subject to the approval of the location by the Chief of Police. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Sedivy, and Commissioner Langohr; thos e voting No, none. City-County A~reement for Water Main on Durston Road - for Gallatin Rest Home The Oity Manager reported that in accordance with the City Corr~missioD3instructions, an agreement had been drawn up between the City and Gallatin County for an equal shar ing of the coat of the water main to be installed on Durston Road to provide the necessary amount of water requ1red by the Gallatin County Rest Home. The I.;ity I Manager also noted that the County Commissioners had already signed the Agree- \,.; ment and recommended tha t the i ty enter into t he Agreement. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the Agreement between the City and Gallatin County be entered into, and tha t the Mayor and Clerk of the Commission be authorized and directed to sign for the City, and the motion was carried by the following Aye and No. vote: those voting Aye being Mayor Morrow, .59 Commissioner Sedivy and Commissioner Langohr; those voting No, none. Open Bids: Cast Iron j'ipe & F:l.ttinr~s for Water Ma~n Extension to Gallatin County Rest Home ThiS was the time and place set for opening bids for Cast Iron Pipe & Fittings for installation of a water main on Durston Road to serve the Gallatin County Rest Home. The affidavit of publication of the Notice to Bidders was presented. It was I moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the bids be opened I.:l.nd read and referred to the City Engineer for tabu1at:l.on, study I.:l.nd re- commends ti on. The motion was oarried by the f:111owing Aye and No vote: those voting Aye being Msyor Morrow, Comm:l.ssloner Sedivy and Commissioner Langohr; those voting No, none. The City Manager reported that we had received only one bid for the cast iron pipe and fittings as fOllows: Pacific States Cast Iron Pipe Co., Provo, Utah - $3,184.61 The City Manager ooncurred in the recommenda tioD of the Ci ty Engineer, tl'a t the Cast Iron Pipe and Fittings purchase be awarded to the Pacific States Cast Iron Pipe Co., of Provo, Utah, on the basis of its bid in the amount of $3,184.61, since unit prices offered are the same as offered in a previous purchase bid of this company which was the lowest bid of four subm1 tted at tha t time. It was moved by Commissioner Sedivy, seconded by Connnissloner Langohr, tha t the bid in the amount of $3,184.61 be accepted and the purchase be awarded to Pacifio States Cast Iron Pipe Co., provo, Utah, as revommended and the motion was carried by the I following Aye and No vote; those vot:l.ng Aye being Mayor Morrow, Commissioner Langohr, and Commissioner Sedivy; those voting No, none. Resolution No. 1195 - Creating S.I.D. No. 457; Sanitary Sewer & Wa ter Mains - Thompsons 3rd Addi tlon. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Langohr, seoonded by Commissioner Sedivy, that the Resolution No. 1195 be passed and adopted to Create Special Im- provement District No. 457. Request to hold Armed Forces Day Parade: Thur sda 'Y ~ 13 May 1965 - Boze"an Chamber of Commerce A request from the Boz eman Chamber of Commerce for permis sion to conduct a parade of ml1i tary un! ts as a part of the Armed Forces Da y program on Thursday, 13 May 1965, at 1:50 p.m. was presented. The City Manager reported that the parade route would be from Seventh Avenue to Wallace Avenue and that he and the Chief of Polioe concurred in reoommending the request be granted. It was moved b7 Commissioner Sedivy, seconded ~. ." 160 by Commissioner LangOhr, that permission be granted to stage the parade as requested and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; those voting No, none. Petition for Street Li of 8th between ar sets A petition to create a special improvement district for street lighting to serve an area including North 9th, 10th, 11th and part of North 8th between I Mendenhall and Villard was presented to the City Commission. The City Manager reported that Mr. Eugene E. Hamil ton, Manager of the Montana Power Company and assis ted by members of the Hous ek~:epers Club obtained most of the signatures on the peti tion to create the lighting di strict and recommended tha t in accordance with the petition, t ha t the Ci ty Attorney be instructed to pr epare a resolu tion of intention to create the district. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the foregoing action as recommended by the City Manager be ap pro ved an d ini tis ted . No's 444, 446, 449, 450, & 455: R. J. Studer & Sons The contract documents for construction of Special Improvement District NOfS. 444, 446, 449, 450 & 455, as awarded to R. J. Studer & Sons, Billings, Montana, on April 28, 1965, were presented. The contracts and bonds were approved as to form by the Ci ty Attorney, and it was moved by Commissloner,Sedivy, seconded by Comm- issioner Lang ohr, tba t the Mayor and the Clerk of the Commission be authorized to I sign the contracts for the Ci ty of Bozeman and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrow, Commie si oner Sedi vy and Commissioner Langohr; those voting No, nane. Desi~nation of Clean-up Week in Bozeman - 16-23 May 1965 - J. C. Request. A verbal request from the local Jaycees tha t Mayor Morrow proclaim the week of May 16 to May 23, 1965, as the Cityts annual "Clean-up Week" for 1965 was presented. It was moved by Connnissioner LaQ?;ohr, me.ended by Commissioner Sedivy, that Mayor Morrow issue a proclamation designating the week of May 16 to May 23, 1965, as the Cityt s annual "Clean-up leek" and the motion was carried by t he following Aye and No vote: those voting Aye, being Mayor Morrow, Commissioner Sedi vy and Commissioner Iangohr; those vo ting No. none. Right-of-way Easement - Montana State College - Greekway Subdivision S.T.D.No. 446 An agreement to provide a right-or-way easement for the purpose of install~ng water mains and sanitary sewer mains in Special Improvement District No. 446 across the property of the Montana State College was presented. The City Manager re- I commended tha t the City enter into the agreemen t, and it was moved by Commis sioner Langohr , seconded by Commissioner Sedivy, t hat the right-of-way agreement be entered into by the City and the Mayor and Clerk of the Commission be authorized and directed to sign for the C1 t y. After examination of the claims in detail and creoking against the Claim Regis ter, it was moved by Commissioner I.e.ngohr, seconded by Commissioner Sedivy, that the claims be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner IB.ngohr ; thos e vo ting No, none. Request - Choose Small Museum Planning Committee - Gallatin-Bozeman Area A letter was reoeived from Mr. Merrill G. Burlingame in regard to choosing a Small Museum Planning Committee f0r the Gallatin-Bozeman area. In response to Mr. Burlingame's request it was moved by Commissioner Sedivy, seconded by Commissioner I.engohr, tha't Mayor R. Harry Morrow be designated as representative of the City of on the Museum Planning Committee and the motion was carried by t he following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Sed! vy and Commissioner I.8.ngohr; those voting No, none.
