The Commission of the City of Bozeman met in regular seasion in the Commission
Room, City Hall Building, Wednesday, 19 May 1965, at 1:00 o'clock p.m. Present were
Mayor Morrow, Commis si oner Sedivy, Commis sioner Ie.I':\gohr, City Manager Cutting, Ass't
I City Manager Fryslie, City A ttorney Berg and the Clerk.
Commissioner Langohr opened the meeting wi th a prayer and tlJ3 following pro'"

Minutes of the last regular session held Wednesday, 12 May 1965, were read and
it was moved by Commissioner Langohr, seconded by Commissioner Sed1 vy, tha t the
minutes be approved and the motion was carried by the following Aye and No vote:

those voting No, none.
Request for Street Dance: Harrison St. - 8th to 11th: Men's Residence Assoc. M.S.C.
Frida 'Y t 21 May 1965.
A request fran-Steve Bryan of the Men's Residence Association for permission to
hold a street dance on Harrison Street between 8th to 11th Avenue on Friday, 21 Ma y
1965, was presented. The designated area is on the campus, therefore there will be
no traffic problem. In ,concurrence with the recommendation of the City Manager, it
was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that permission
to hold a street dance be granted and tlJ3 motion was carried by the follOWing Aye
and No vote: those voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner
I langohr; those voting No, none.
He-appointment to Police Commission - Don Cobb: 3 year - term expiring - 30 April 1968.
Mayor Morrow announced re-arpointment by the Ci ty Manager of Don Cobb as a member
of the Police Commissi on for a three year term ending April 30, 1968. It was moved
by Commissioner Langohr, seconded by Commissioner Sedi vy, tha t the re-appolntment be
approved and the motion was carried by the following Aye and No vo te: thos e va ting
Aye being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; those voting No, none.
Appointment of Municipal Band Director ... Francis White for 1965 on City Band Board.
A letter was received from Ralph C. Challender, Secretary of the Bozeman Municipal
Band reporting that the City Municipal Band Board had elected Francis E. White as Band
Director for the 1965 season. It was moved by Corr.missioner Sedi vy, seconded by Comm-
issioner Langohr, the t the Commission approve~ the election of Francis E. White, as
Band Director and the motion was carried by the following Aye and No vote: those voting
Aye being Mayor Morrow, Co~missioner Sedivy and Commissioner Langohr; those voting No,
none.

This wa s the time and place set in Commission Resolution No. 1193 for hear ing
protests to vacating the one block section of Hemlock Street between North Rouse Avenue
and North Church Avenue. Affidavit of Publication of Notice was presented together
with signed acknowledgement of service of the notice from owners of all abutting the
pr oper t y. There was no one present to protest, and no protests ha ving been filed, the
City Attorney was instructed to prepare an Ordinance vacat:1;ng said portion of Hemlock

Ordinance No. 850 -- Vacatin~
The Vity Attorney, as instructed, had prepared an ordinance vacating Hemlock
Street and adjacent Alleys. Ordinance No. 850 was presented, entitled:

public Hearing - Resolution No. 1194 - Special Improvement District No. 458 -
North 7th Sanitary Sewer - North Durston Road.
This was the time and place set by Commission Resolution No. 1194 to hear
protests, if any to the creation of Special Impt'ovement District No. 458. Affi-
davit of publication of Notice and the Clerk's Mailing Certificate stating that
all property owners had been notified as required by law were presented. No
written protests were on file and no one appeared to verbally protest the creation
or extent of the district.
The City Manager recommended that the City Attorney be instructed to pre-
pare a resolution to crea te the distric t. I

Plat 9f County Rest Home property - Including Annexation
A letter received from Harold A. Fryslie, Secretary of the Bozeman City-County
Planning Board was read. The City-County Planning Board favorably recommended that
the Gallatin County Rest Home Addition be approved as a final plat. After thorou!hly I
discussing the Gallatin County Hest Home Addition, it was agreed that final action
be deferred for revisi:>n and correction of the indica ted area of the p la t and park
dedication certificate.

00., Billings, Montana, on April 28, 1965, were presented. The contracts and bonds
were approved as to form by the City Attorney, and it was moved by Commissioner Lan-
gohr, seconded by Commissioner Sedivy, tha t tm Mayor and the Clerk of the Commission
be authorized to sign the contracts for the City of Bozeman and the pledge for bid
security be returned to Schultz ann Lindsay Construction Co., Billings, Mon tana , and

Continuation License Bonds: Fullerton Plbg. & Ht~. --Plumbing & Gas Fitter License
In compliance with Chapter 16 of the Bozeman Municipal Code, the certificates
to continue the plumbing and gas fi tter bonds of Fullerton Plumbing & Hea ting, Ham-
ilton, Montana was presented. . The Gity Manager stated the BUilding Inspector had
approved the continua tion of the bonds and the certificates were approved as to
form by the City Attorney. It was moved by Commissioner Sedivy, seconded by Comm-
issioner Langohr, that the continuation of the aforementioned bonds be approved
and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Morrow, Commissioner Sedi vy ad Commis sioner Langohr; those voting No, none.
Authorlt to Re-Invest Funds: CD'S.
It was reported that the Director of Finance had requested permission to re-
invest varj ous maturing investments as follows:
Miscellaneous $100,000.00 - 30 day Certificate of Deposit
. Building 50,000.00 - 90 day Certificate of Deposit
I Building 50,000.00 - 90 day U.S. Treasury Bills
It being in the public interest, the Ci ty Manager concurred wi th the rer:lUest
of the Director of F'inance and recommended the authority to re-invest the above
funds. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that
the reinvestment as requested, be ap.r.)roved and the moti on was carried by the following
Aye and No vote: those vot:tng Aye be1ng Mayor Morrow, Commissi oner Sedivy a nd Comm-

Application to Construct Car Wash - Bair's E. Main Station
A letter was received from Mr. LaMont Bair, President of Bair's Service Station
in regard to making applica tion for the construction of a car wash in connection with
the East Main Street Service Sta tion in Boz eman, M-;ntana. In response to Mr. Bair's
request, it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that
the papers be forwarded to the Montana Sta te Board of Health for their Comments and
clearance, prior to final action on the application. The motion was carried by the
following Aye and No vote: those vot:1ng Aye being Mayor Morrow, Commissioner Sedivy,
and Commissioner Langohr; those voting No, none.

The ~ity Manager requested that he be granted vacation leave of absence from
May 20 to the 31st, inclusi ve, and tha t Harold A. l:jryslie, Assft City Manager be
designa ted to nerform the du tles of Ci ty Manager during the period. It waa moved
by Commissioner Langohr, seconded by Commis sioner Sedi vy, that the request for
vacation be granted and Mr. Fryslie designated as ActIng City Manager during the
period s ta ted and the motion was carried by the following Aye and No vote: those
vo ting Aye be lng Ma yor Morrow, Commissioner Sedivy and Commis sioner Langohr, those
voting No, none.

Key Club Request to holr'l Annual IBundleDays" drive: ending Saturday 22 May.
A request from Glen Smiley, Secretary of the Key Club of Boz emBn Senior High
School, for permission to canvass the town to gather clothes for their annual
"Bundle Da ys" drive was pre sen ted. It was moved by Commissioner Sedi vy, seconded
by Commissioner Iangohr, thatpermission to canvass the town to ga ther clothes for
their annual "Bundle Days" drive which ends Saturday, 2,2 May 1965, as requested I
be granted and the motion was carried by the following Aye and No vote: those voting
Aye being Ma yor' Morrow, Commissioner Sedivy and Commissioner Langohr; those voUng
No, none.
The Key Club also requested permission to undertake a car safety check some-
ti'l16 during the summer months and would like to be able to use one of the lane s
on Main Street for this purpose. After dis cuss ing the proposed request, the Comm-
ission agreed that the request to undertake a car safety check be tabled until they
get an opinion from the Chamber of Commerce.
