Pursuant to call in compliance with the provisions of Section 11-3249, R.C.M.
1947, and Section 2.08.060 of the Bozeman Municipal Code, the City Commission of the
I City of Bozeman met in special session, Monday, 24 May 1965, at 9:00 o'clock a.m.
at the City Hall. Present were Mayor Morrow, Commi ssioner Sedivy, Commissioner
Langohr, Acting City Manager Fryslie and the Clerk.
The purpose of the meeting was to consider a possible negotiated settlement
of the Federal Condemnation Suit for two parcels of property in Block "A" of Black's
Addition of the City of Bozeman formerly owned by the City of Bozeman and currently
a portion of the Bozeman Federal Building site.
The City Commission had received a telephone call from Butte on this date
whereby Michael J. O'Connell, the Cityfs special legal council for this Federal
Condemnation case advised that the Federal representatives were willing to give
favorable considera tion to a settlement in an aggregate amount of $100,000.00, and
tha t the Federal representa ti vas were not wilLing to discuss a proposed settlement
in access of $100,000.00.
Following considerable discussion of this ma tter, it was moved by Commissioner
Sedivy, seconded by Commissioner Langohr, that the City of Dozeman accept the
Federal Governments compromise offer in an aggregate amount of $100,000.00 and that
I the Cityfs legal council be instructed to take the necessary action to effect this
compromise settlement. The motion failed by the following Aye and No vote: those
voting Aye being Mayor Morrow; those voting No being Commissioner Sedivy and
I Commissioner Langohr.
It was moved by Commissioner Langohr, seconded by Corr:missioner Sedivy, that
the City Commission instruct Michael J. O'Connell to advise the Federal represent-
at i ve that the City of Bozeman will accept a compromise offer in the aggregate
amount of $110,000.00. The motion was carried by the follow.ing Aye and No vote:
those voting Aye being Mayor Morrow and Commissioner Lang ohr ; thos e vo ting No be Ing
Commissioner Sedivy.

There being no further business to come before the Commission at this time,
it was moved by Commissioner Sedivy, seconded by Commis si onsr I.e.ng ohr, tha t the
meeting be adjourned and the motion was carried by the following Aye and No vote:
Those voting Aye being Mayor Morrow, Co"missioner Sedivy and Commissioner Langohr;
those voting No, none.
