HomeMy WebLinkAbout1965-07-14 195 Bozeman, M0ntana July l~, 1965 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, 14 July 1965, at 1:00 o'clock p.m. Present were Ma yor Morrow, Commissioner Sedivy, Commissioner Langohr, City Manager Cutting, I Ass't City Manager Fryslie, Acting City Attorney O'Connell and the Clerk. Mayor Morrow opened the meeting with a prayer and the following proceedings were had: Minutes of the last regular session held Wednesday, 7 July 1965, were read and it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the minutes be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; those voting No, none. Hear~ng - Resolution No. 1212 Vaca tion of portion of Koch Street between 19th and 20 th Ave. This was the time and place set in Commission Resolution No. 1212 for hearing protests to vacating a portion of Koch Street between 19th and 20th Avemle. Affi- davit of Publication of Notice was'~resented together with the Clerk's Mailing Certificate stating tha tall proper1ty owners had been noti!i ed. No written protests were on file and no one appeared to verbally protest the vacation of a portion of Koch Street between 19th and 20th Avenue. The City Manager recommended that the City Attorney be instructed to prepare I an Ordinance vacating said portion of Koch Street between 19th and 2uth Avenue. ordinance No. 851 -- Vacating Portions Koch street. The 01ty Attorney, as instructed, had prepared an Ordinance vacating a portion of Koch Street between 19th and 20th Avenue in Kirk's First Subdivision. Ordinance No. 852: Rep~alinp; Section 4.04.070 B~lC: regardjng dancing: Ordinance No. 852 provisionally pa ssed and adopted by the Commission at its meetIng on July 7, 1965, repealing section 4.04.070 of the Bozeman Municipal Code I rela tlng to the prohibi tion of dancing on premis es licensed for t he retail sale s of beer was presented: ORDINANCE NO. 852 AN ORDINANCE REPEALING SECTION 4.04.070 6F THE BOZEMAN MUNICIPAL CODE RELATING TO THE PROHIBITION OF DANCING ON PREMISES LICENSED FOR THE RETAIL SAIE OF BEER. The City Manager recommended that the Ordinance be finally passed and adopted. It was moved by Com~issioner Langohr, seconded by Commissioner Sedi vy, the t the Ordinance No. 852 be finally passed and adopted and the motion was carried by the 1-96 - following Aye and No vote: those voting Aye being Mayor Morrow, Commis s i,-mer Sedivy and Commis sinner Langohr; those vo ting No, none. Motorcycle shop on corner of Babcock and Rouse: Mrs. Joseph A. McGuire of 116 Sou th noo se Avenue appeared to inqu ire a bou t provisions of the Zoning ordinance pertaining to vehioular sales and service in I the Central Business District. Mrs. McGu ire s ta ted tha t the opera tion of the motor- cycle agency a t the c orner of Babco ck Street and Roo se A venue appear to be displaying vehicles in the street area and conducting a repa:1r shop in viola tion of t he ordinance and further inquired as to why the City has not taken corrective action in the matter. After a thorough discussion of the complaint and the provisions of the Ordinance, the Commission requested that the City Attorney render an opinion as to the proper legal interpretation of the pertinent sections of the ordinance and action was de- ferred pending receipt of tba t opinion. Con tinued observa tion of the su bj ec t agency operation was also directed. Lion's Club - Request to sponsor the Inland Empire Show. It was reported the Lion's club had requested permission to sponsor the Inland Empire Shows d"ring the period of July 26th to Jul~T 30th, inclusive. Since the Shrine Club sponsoring of the Shrine Circus on July 30th has had prior approval, it was the feeling of the Commission that the Shrine Club should be contacted for an expression of its attitude in regard to the overlapping date. It was moved by Cornmissi oner Langohr, seconded by Commissioner Sedivy, tha t the I request be tabled until next week for further study. Acting City Attorney Michael J. O'Connell was excused 2:20 p.m. Pro?ress report - Construction of Municipal Building Facility. Architect William Grabow appeared to explain to the Commission the progress of the construction of the Municipal Building FaciIi ty and presented a progress schedule submitted by General Contractor, Ingolf Johnson, indicating that " the Police-Fire Department Unit would be su bstantially completed by September 10, . 1965, and the Administrative Unit by October 15, 1965. Mr. Grabow reported that a considerable amount of the more difficult part of the work may be accomplished and the tit appears reasonable to. expect completion as schedu led. Appreciation was expressed for Mr. Grabow's very enlightening report.
