Dave Bruck represent~n~ the Bozeman Insuranoe Association - Present Fo~ Generato~ I David Bruck appeared to present, on behalf of the Bozeman Insuranoe Association, a fog generator to the Bozeman Fire Department to be used for deodorizing Building, which have been filled with smoke after a fire. Fire Chie~ Huber informed the Commission he had aooepted this equipmen t for the use of t he Fire Department. Mayor R. Harry Morrow expressed the City'S appreciation for the fine gesture of the bozeman Insurance Association providing the fire department with the fog generator to be used atter all fires. nO$2:S at Lar$2:e and a nuisance. Mrs. G. V. Jelly, 20 East Garfield Street, appeared to inquire as to the dis- position of a oomplain spe had filed against Jack Gardner alleging that the Gardner dog was at large and a nuisance, damaging ber yard in violation of Section 5.16 of the Bozeman Municipal Code. Mrs. Jelly was informed tl:et the defendent's Attorney had :tiled a demurrer in the case which had been taken under advlssnent by the Police Judge. Ordinance No. 851 - Vacating portion of West Koch Street. Ordinance No. 851 provisionallY' passed and adopted by the Commission at its Meeting on 14 July 1965, vacating a portion of Koch Street between 19th and 20th I Avenue in Kirk's First Subdivision was presented. ORDINANCE NO. 851 AN ORDINANCE OF THE CITY OF BOZEMAN VACATING THE NORTHERLY FIFTEEN FEET AND SOUTHERLY FIFTEEN FEET OF WEST KOCH STREET BETWEEN NINETEENTH AVENUE SOUTH AND TWENTIETH A VENUE SOUTH IN T HE CITY OF BOZEMAN, MONT ANA. The City Manager recommended that the Ordinance No. 851 be tinally passed and adopted. Resolution (unnumbered) Authorizing purchase of road oil from State Highway for 1965. A resolution authorizing the Ci~ Manager to purchase, not to exceed 25,000 gallons of road oil, during the fiscal year July 1, 1966 to June 30, 1966, for use I by the Street department in repairing pavement and for sealing certain sections of existing pa vement wi thin the Ci t Y from the State Highway Department was presented as follows: .!l~2.Q.1QIIQN VJHEREAS the City of Bozeman will hAve need during the fiscal year, July 1, 196) to June 30, 1966, for road oils for use in repairing streets and for sealing certain sections of existing pavements within the City, and WHEREAS, the City of Bozeman does not have proper facilities for handling and storying the needed cuantities of oils, and WHEREAS The Montana State Highway Department does have ruantities of the re- (~uired typ es of oils stored in Bozeman from which it can supply the cuantities needed for the City of Bozeman. NOW, THEREFORE, BE IT RESOLVED: That an emergency does exist relative to the procurement of road oils by the City Manager is hereby authorized to purchase stocks in storage in Bozeman, approximately twenty-five thousand (25,000) gallons of road oil, this to be purchased from time to time during the fiscal year, July 1, 1965 - June 30, 1966, as needed by the City of Bozeman for repair And sealing of existing pavements, and these quantities of road oils to be purchased at cost plus normal handling charges. In concurrence with the recommendation of the Ci.ty Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the purchase of 1900 feet of 3/4ft copper tubing be approved and the motion was carried by the following Aye and No vote, those voting Aye being Mayor Morrow, Commissioners Sedivy ;md Langohr, those voting No, none. Ordinance No. 853 -- (196)-1966) Salary Ordinance Ordinance No. 853, the annual salary ordinance, covering salaries of the heads of departments and employees who are direct appointees of the Commission was presented, entitled 9R~~NANCE NO. 853 AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA FIXING THE MONTHLY SALARY AND OFFICIAL BOND OF THE CITY MANAGER, THE HEADS OF DEPARTMENTS, AND THE EMPLOYEES OF THE CITY COMMISSION AS REQUIRED BY LAW. Mr. Lynn Eilefson, Mr. B. G. Nordling and Mr. Lloyd R. Myers appeared inbehalf of the Lion's Club in regard to a schedul conflict between their carnival and the Shrine Circus on an overlapping date. After thoroughly discussing the conflict, it was recommended by the City Manager, that the Lions Club continue with their original plans to sponsor the Inland Empire Shows during the period of July 26th to July 30th, inclusive for a fee of $50.00 per day for the five day period, and that the two organizations try to arrange for different dates for their shows in the future to avoid the conflict. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the two organ- izations continue with their plans a.s previously arranged and that they make every effort not to have a conflicting date in the future and the motion was carried by the following Aye and No vote, those voting Aye being Mayor Morrow and Commissioners Sedivy and Langhor, those voting No, none. PETITION FOR Street Lighting - from Main to the City Limits on N. 7th The City Manager presented a petition signed by approximately sixty-five percent of the property owners on North Seventh from Main Street to the north City limits reouesting that the City create a Special Improvement Lighting District in this area. In concurrence with the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the City Attorney be instructed to prepare a resolution of intention to create the district, and the motion was carried by the following Aye and No vote, those voting Aye being Mayor Morrow, Corrunissioners Sedivy and Langohr, those voting No, none. Request - Jaycee Rodeo Parade - Saturday after'noon 14 August 1965. I A request from the local Jaycees to stage a rodeo parade on Main Street, 14 August 1965, in the afternoon was presented. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the request be granted contingent upon street conditions at parade time which may recuire changing the parade route so as not to interfere with the construction work and the motion was carried by the following Aye and No votes, those voting Aye being Mayor Morrow Commissioners Sedivy and Langohr, those voting No, none. 202 Cancel.lat.iOn oiLieense Bond: _.Pa.lmquist Electrile" Helena. A letter from Palmquist Electric, Helena, Montana requesting the cancellation of their Electrical bond was presented. The City Manager recommended that the cancellation of the above mentioned bond be approved and the certificate returned. It was moved by Commissioner Sedivy, seconded by Comrnissioner Langohr, that the above action as recommended be approved and the motion was crrried by the following Aye and No vote, those voting Aye being Mayor Morrow, Corrunissioners Sedivy and Langohr,those voting No, none. In compliance lNith Chapter 16 of the Bozeman Municipal Code, the certificates for the plumbing and gas fitter bonds of Brmm Plwnbing and Heating was presented. The City Manager stated the Building Inspector had recommended the approval of the bonds and the certificates had been approved as to form by the City Attorney. License Bond: Electrician: Central Electric Sarvice - Lewistown The Electrical bond of Central Electric Service, Lewistown, Montana was presented. The bond having been approved by the City Building Inspector and as to form by the City Attorney, it was moved by Conunissioner Langohr, seconded by Commissioner Sedivy, that the continuation of the aforementioned bonds be approved and the motion Has carried by the following Aye and No vote, those voting Aye being Mayor Morrow, Commissioners Sedivy and Langohr, those voting No, none. Building Mov,3rs Bond -- Cotton's House Moving An indemnity bond for "Cotton's House Moving" in regard to building moving within the City limits of Bozenlan by subject firm was presented, having approval of the City Attorney I as to fonn. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the bond be accepted and filed and the motion was carried by the following Aye and No, vote, those voting Aye being Mayor Morrow, Conunissioners Sedivy and Langohr, those voting No, none. Reauest for SID projects; West Park Manor - Western General Enterprises The letter dated 28 May 1965 from Western General Enterprises reouesting special improve- ment districts for the construction of water, sewer, storm sewer and paving improvements in all of the West Park Manor development was again placed before the Commission. It was reported that the developers of this area are no primarily interested in a storm drainage project to serve North Twenty First Avenue. The City Manager advised the Commission that the Kirk Park area would become about twenty-five percent of the requested storm drainage district to impose an obligation on the Park fund for which no funds are available. After a thorough discussion of the rec:uested special improvement districts, it was moved by Cornmissioner Langohr, seconded by Commissioner Sedivy, that since no Park funds are avail- able to asstune any assessments against Kirk Park, the rec;uest, as presented, he denied. Change Order: S.I.D. No. 445 North 18th (Compaction Water Services Trenches) The Change order of S.LD. No. 445 prepared by Harold Hoskins and Associates to become a part of the original contract for construction of Improvements in the project described was presented as follows: S.LD. No. 445 - Compaction of water service line trenches (522 feet) installed by the City of Bozeman. To compact trenches to prevent settlement of soil underneath proposed paving and curb and gutter. Estimated cost - $144.00. The City Manager concurred with the Engineer and recommended the change order be accepted and approved as presented. R/W Easement: S.I.D. No. 454: East Main Sewer (Sande) An agreement to provide a Right-of-Way Easement for the 8" sanitC'lry sewer lateral install- ation in Special Improvement District No. 454 across the property owned by Mabel H. Sande, Norman C. Sande, and Carole A. Sande in portions of Block 36, Northern Pacific Addition in consideration of the sum of $200.00 was presented. The City Manager recommended that the City enter into the agreement and the claim for the payment in the amount of $200.00 be approved. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the easement agreement be entered into by the City, and that the Mayor a.nd Clerk of the Commission be authorized and directed to sign for the City and the claim for the payment of the amount involved be approved and the motion was carried by the following Aye and No vote, those 203 voting Aye being Mayor Morrow, Corrunissioners Sedivy and Langohr, those voting No, none. Heports for June (Continued) The following reports were presented: Director of Public Service I Director of Finance Disposal Plant Operator Fluoridation (May & June) Cemetery Building Inspector: (June & Semi-Annual) The City ~Janager commented on the report s and recommended their approval. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the reports be approved and the motion was carried by the following Aye and No vote, those voting Aye being Mayor Morrow, Commissioners Sedivy and Langohr, those voting No, none. Securit;y Checks returned - Bid Securiti~s The City Engineer and the engineers representing consultant Harold Hoskins and Associates had checked the extension of all bids submitted and recommended that the bid security of the four highest bidders be returned. The City Manager concurred in the recommendation of the Engineers and it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the bid security of the four highest bidders be returned and the motion Was carried by the following Aye and No vote, those voting Aye being Mayor Morrow and Conunissioners Sedivy and Langohr, those voting No, none.
