HomeMy WebLinkAbout1965-07-28 204 MINUTES OF THE MEETING OF THE CITY OF BOZEMAN Bozeman, Montana 2S July 1965 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, \1ednesday 2S July 1965, at 1:00 o'clock p.m. Present were Mayor Morrow, Commissioner Sedivy, Commissioner Langohr, City Manager Cutting, Ass't. City Manager Fryslie, City Attorne;y Berg and the Clerk. I Corruni~;sioner Langohr opened the meeting with a prayer and the following proceedings were had; Minutes of the last regular session held Wednesday, 21 July 1965, were read and it was moved by Commissioner sedivy, seconded b;y Commissioner Langohr, that the minutes be approved as read and the motion was carried by the following Aye and No vote, those voting Aye being Hayor Mor:row, Conunissioners Sedivy and Langohr, those voting No, none. Sale of Bonds -- Special Improvement Di~;tricL No's. 454. 456, 1..57 & 458. This was the time and place set for the sale of bonds Of Specia.l Improvement District No's. 454, 456, 457 and 45S. Affidavits of publication of the separate notices of sale of the bonds of each district was presented. The Mayor and the City Manager outlined the proceedure for conducting this bond sale and stated that the amount of bonds to be sold for each district would be adjusted in accordance with low construction bids received as follows. No. 456 was $1,356.16 over the Resolution of Intention amount. The owners of this district have agreed to put up t,he difference over t,he amount of the bonds sold in cash. The Mayor announced no sealed bids had been received and that oral bidding could begin, follow- ing a discussion of bidding proceedure. . , I Mayor Morrow announced the City was rea.dy to conduct oral bidding on the bonds of Special Improvement District No. 454 in the amount of $31,000.00. Swanberg & Co. 4.65% Following the recommendation of the Director of Finance, concurred in by the City Manager, it was moved by Conunissioner Langohr, seconded by Commissioner Sedivy, that the bid of the W. H. Swanberg & Co., Great Falls, Montana, being the lowest and best bid submtted, the sale of the bonds be awarded the W. H. Swanberg & Co., Great Falls, Montana, and the bid security of the unsuccessful bidder be returned and the motion was carried by the following Aye and No vote, those voting Aye being Mayor Morrow, and Commissioners Sedivy and Langohr, those voting No, none. Mayor Morrow announced the City was read to conduct oral bidding on the bonds of Special I Improvement District No. 456 in the amount of $15,000.00. Following the recommendation of the Director of Finance, concurred in by the City Manager, I it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the bid of the Security Bank & Trust Company Bozeman; State Bank & Trust Company, Dillon; and the Gallatin 'rrust & Savings Bank, Bozeman, Montana, being the lowest and best bid submitted the sale of the bonds be awarded to the Security Bank & Trust Company, the State Bank & Trust Company and the Ga:Datin Trust Company and the Gallatin Trust & Savings Bank and the bid security of the unsuccessful bidder be returned and the motion WAS carried by the following Aye and No vote, those voting Aye being MAYOI' Morrow, and Conunissioners Sedivy and Langohr, those voting No, nono. Nayor Morrow announced the City was ready to conduct oral bidding the bonds of Special Improvement District No, 458 in the amount of $9,000.00. Savings Bank, Bozeman, Montana, being the lowest and best Bid submitted, the sale of thE: bonds be awarded to the Security Bank & Trust Company, the State Bank & Trust Company and the Gallatin Trust and Savings Bank and the bid security of the unsuccessful bidder be returned and t.he mot.ion was carried by the foIbwing Aye and No vote, those voting Aye being Mayor Iv'lOrrow and Conunissioners Sedivy and Langohr, tho se voting No, none. 206 Consider'ation of Bids: Sanitary Sewer Projects 454. 456. 457. and 458. - Water Mains - 457 Bids opened on July 21, 1965, for proposed construction of the sanit.<J.ry sewer lines and water mains in Special Improvement District No.'s. 454, 456, 457 and 458 were brought before the Commission for consideration of contract award. As directed, the City Engineer and the engineers representing Consultants Ha.rold Hoskins and Associates had checked the extensions of all bids submitted, prepared the final tabulation and reconunended that Frank J. Trunk and Son, Bozeman, Montana, be awarded the contract for the above mentioned improvements, I the firms bid of $105,710.05 being the lo\{ on all of the districts. It was further reported that the low bid for one project - district No. 456 - was $1,356.16 over the resolution of intention figures and that the property owners involved had agreed to pay the amount in question to permit the award of the contract. The City Manager concurred in the recommenda- tion of the Engineers and it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that Frank J. Trunk and Son be awarded the contract for the construction in Special Improvement District No's. 454, 456, 457 and 458 on the basis of their low bid in the aggregate amount of $105, 710.05 and the bid security of the unsuccessful bidders be returned and the motion was carried by the following aye and no vote, those voting Aye being Mayor Morrow and Commissioners Sedivy and Langohr, those voting No, none. Consider'alion of ConsLruction Bids: Feder'al Bl,'ig. Site pav"meXL widening-Long Const. Co. Bids opened on July 21, 1965, for pavement widening improvements around the Federal Building were brought before the Commission for consideration of contract award. As directed, the City Engineer and the engineers representing Consultants Ha.rold Hoskins and Associates had checked the extension of all bids submtted, prepared the final tabulation a.nd informed the Commission that contrary to expectations there remains a serious rmestion as to the availability of the site for the construction of this project which would be some justification for the high bids received. The City Manager concurred in the recommendation of the Engineers and it was moved by Commissioner Sedivy, seconded by Commission Langohr, that all the bids received be rejected and the project be readvertised in 1966 and the motion was carried by the following Aye and No vote, those voting Aye being Mayor Morrow and Commissioners Sedivy and Langohr, those voting No, none. Consideration of Bids: Award of'iValks & Curbs 1965 The City Engineer having completed his study of the bids for construction of Walks & Curbs (1965) recommended that Wallace Diteman, Inc., Bozeman, Montana, be awarded the contract for the improvement of the walks and curbs on the basis of its low bid of $1,888.00. The City Manager concurred in the recommendation of the City Engineer, and it was moved by I. Commissioner Langohr, seconded by Commissioner Sedivy, that the bid be awarded as recommended and the motion was carried by the following Aye and No vote, those voting Aye being Mayor Morrow and Commissioners Sedivy and Langohr, those voting No, none. Dog at Large - Mr. G. V. Jelly, 20 East Garfield Mr. G. V. Jelly, 20 East Garfield, appeared to further inquire about a complaint which had been filed against Jack Gardner alleging that the Gardner dog was still at large and in violation of Section 5.16 of the Bozeman Municipal Code. Mr. Jelly was informed that the original complaint had been dismissed but the City Attorney filed an amended complaint which is now pending in the Police court. City Attorney Ben Berg excused 3:30 p.m. Appropriation O,dinance No. 854 (Budget 1965-1966) The City Manager reviewed the proposed budget for the fiscal year ending June 30, 1966 and Ordinance No. 854 was presented, entitled: ORDINANCE NO. 854 AN ORDINANCE APPROPRIATING HONIES FOR EXPENDITURES DEEMED NECESSARY AND IN ACCORDANCE WITH BUDGETERY REQUIREMENTS FOR MAINTENANCE ETC., OF THE MUNICIPAL GOVERNMENT OF THE CITY OF BOZEMAN, MONTANA, FOR THE FISCAL YEAR ENDING JUNE 30TH, 1966. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the ordinance be provisionally adopted and August 4, 1965, be set as the date for public hearing and the motion was carried by the following Aye and No vote, those voting Aye being Mayor Morrow and Commissioners Sedivy and Langohr, those voting No, none. Re-Investment of City Funds - $100.000.00 Building funds - 30 days. $34,000.00 Parking I Meter - 180 days, $100.000.00 Miscellaneous - 30 days It was reported by the Director of Finance that $100,000.00 Building funds; $34,000.00 parking meter funds and $100,000.00 miscellaneous funds now invested in Certificates of Deposit have matured and he requested authority to reinvest the funds in like securities. It being in the public interest, the City Manager concurred with the request of the Director of Finance ana recommended authority to reinvest the $100,000.00 building funds for a period of thirty days; the $34,000.00 parking meter funds for one-hundred eighty days and the $100,000.00 miscellaneous funds for thirty days in Certificates of Deposit. It was moved b;y Commissioner Langohr, seconded by Commissioner Sedivy, that the reinvestments as requested by authorized and the motion was carried by the following Aye and No vote, those voting Aye being Mayor Morrow, and Commissioners SediVJ' ,'lOd Langohr, those voting No, none. 207 Reschedule Inland Empire Shows - Lions Club 2 to 7 August , .. It was reported that the Lions Club had contacted the Inland Empire Shows and were success- ful in changing their dates for the carvival from July 26-30 to August 2 to 7 inclusive. It was moved by Commissioner Langohr, seconded by.Conunissioner Sedivy, that the request of the Lions Club be granted and that they be commended for their untiring efforts to avoid the conflict with the Shrine Circus and the motion was carried by the following Aye and No vote, those voting Aye being Mayor Morrow, and Commissioners Sedivy and Langohr, those voting No, I none. Appointment and Re-Appointments to City Board & Commissions. Mayor Morrow announced his appointments or re-appointments to various City Board or Comm- issions, as follows: PLANNING BOARD TERM ENDING Dr. H. C. Cheever Two Years Ending 6-30=67 C. V. Henderson Two Years Ending 6-30-67 CITY BAND BOARD R. B. McCulloch to fill the unexpired term of Frank Brown (no longer in Bozeman) ending 12/31/65. It was moved by Corrunissioner Sedivy, seconded by Commissioner Langohr, that the City Commission concur in the appointments and/or re-appointments, and the motion was carried by the following Aye and No votes, those voting Aye being Mayor Morrow, and Commissioners Sedivy and Langohr, those voting No, none. Appointment - Hatold Hogg to fill vacancy of Loren Hardie The City Manager announced his appointment of Harold Hogg as a member of the Police Commission to fill the unexpired term of Loren Hardie (resigned) for a term ending April 30, 1967. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, thAt the appointment of Harold Hogg be approved and the motion was carried by the following Aye and No vote, those voting Aye being Mayor Morrow, and Commissioners Sedivy and Langohr, those voting No none, Adjournment: .1 There being no further business to come before the Commission, it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the meeting adjourn and the motion was carried by the following Aye and No vote, those voting Aye being Mayor Morrow, and Commissioners Sedivy and Langohr, those voting No, none.
