The Commission of The City of Bozeman met in reguiar session in the Commission
Room, City Hall Building, Wednesday, 13 Janua ry, i965, at l:vU o'clock P.M. Present
were Mayor Morrow, Commissioner Sedivy, Commissioner Langohr, Ci ty Mamger Cutting,
Ass't City Manager Fryslie, City Attorney Berg and the Clerk. I
Commissioner Sedivy opened the meeting with a prayer and the fol~owing proceedings
were had.
Minutes of the last regular session held January 6, ig65, were read and it was
moved by Commissioner Langohr, seconded by Commissioner Sedivy that the minutes be
approved as read and the motion was carried by the following Aye and No vote: Voting
Aye, Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; voting No, none.
Re-Appointment of Board Members:
Mayor Morrow announced the re-appointments of individuais to various City
Boards or Commissions as foliOWS:

Manager Cutting commented that each of the individualS mentioned were very
oapabie and excellen t board members. It was moved by Commissioner Sedivy,
seconded by Commissioner Langohr, thB. t the se appointments be approved and the
motion was carried by the foliowing Aye and No vote: Voting Aye, Mayor Morrow,
Comm:tssioner Sedivy and Commissioner Langohr; voting No, none.

Authori ty to Perform Pre liminary Eng ineerinp; E. Main St. Sewer
City Manager Cutting informed the Commissioners tila t the extensi ve amount
of preiimlnary engineering work required to establish the proposed Sanitary Sewer
Project to serve an area in Blocks 24, 25, 27, 28 and portions of vacated Streets
and Avenues wi thin the Northern Pacific Addition to Bozeman, Montana cannot be
done by our present City Engineering force and presented a proposition from Harold
Hoskins and Associates offering to perform this preliminary engineering for a fee
of $500.00, refundable to ~he City from their normal fees if the project is con-
s true ted . In concurrence with the recommendation of the City Mana ger, it w as moved I
by Commissioner Langohr, seconded by CommiSSioner Sedivy that the proposal of Harold
Hoskins & Associates as presented, to do the preiimin~ry engineering on the proposed
project be accepted und the motion was carried by the fOiiowing Aye and No vote;
Voting Aye, Mayor Morrow, Commissioner Sedivy and Commissioner Langohr, voting No,
none .

Finding of Board of Arbitration - SID No. 424 Paving (Accepted by Long Const. Co.,)
The \"/ity Manager reported unat the decision of the board of Arbitration
assessing the Long Construction Co., a penalty of $2,960.00 for excess engineering
due to the overrun of the time limit on its contractf'or S.I.D. No. 424 had been
accepted by the Long Construction Company. Tne Manager stated in consideration of
I all circumstances surrounding this ca s e , he would recommend that the City Also accept
the findings of the Arbi tra tion BOclrd and ha t in accordance therewi th the fina 1
payment to the Long Construction be authorized when claim is presented in proper
form. In concurrence wi tn tne recommendation of ~he City Manager and the City
Attorney, itwas moved by Commissioner Sedivyand seconded by Commissioner Langohr,
tha t findings of the Arbi tra tion Board be accepted, a nd final pa yment be approved
and the motion wes carried by 'the fOl.1oWing Aye and No vote: Voting Aye, Mayor

Municipal League Committees Meeting & Le~islative Dinner
It was reported the Municipal League has scheduled a Meeting to be held in
.l1elena, January 2ls t, 1965, along wi th a Legis1a ti ve dinner and The Oi ty Manager
re4uested that the members of the City Commission and he be authorized to attend the
meeting, as weii as the dinner. It was moved by Commissioner Langohr, s eccmded by
Commissioner Sedivy, that authorization for the officiais cited to attend the Muni-
cipal League Committee Meeting and the Legislative Dinner be granted, and it being
in the public interest, the expenses incurred be pa1d from the General Fund. 'I'ne

ban ks . It was moved by Commissioner Sedlvy, seconded by Commissioner Langohr that
the securities be approved and a iist thereof be set forth in fU~l in the minutes
of this meeting and the motion was carried by the fOllowing aye and No vote: Voting

of the proposed distr~ct, it was moved by Commis si oner Lan gohr, seconded by Comm-
issioner Sedivy, that consideration of S.I.D. No. 443 - Pav1.ng S. 13th and 14th
be tabled for continued study and the motion was carrJ.ed by the following Aye and

Claim register, it was moved by Commissioner Langonr, seconded by Commissioner
Sedi vy, that all claims as presented be approved and the motion was carrled.by

The Commiss~on was reminded of its action on May 13, .L964, conSidering a
petition for street iightin~ in an area mentioned in tue original petition and
in view of the status of deveiopments, the Ci ty Manager sugges ted ~.tue segre-
