The Commission of the City of Bozeman met in regular session in the Commission
Room, City Hall Building, Wednesday, 14 April 1965, at 1:00 Of clock p.m. Present
were Mayor Morrow, Commissioner Sedivy, Commissioner Langohr, City Manager Cutting,
I Assft ~ity Manager Fryslie, City Attorney Berg and the Clerk.
Mayor Morrow opened the meeting with a prayer and the following proceedings
were had:
Minutes of the last regular session held April 7, 1965, were read and it was
moved by Commissioner Langohr, seconded by Commissioner Sedivy, tha t the minu tea
be approved as read and the motion was carried by the following Aye and No vote;
those voting Aye being Mayor Morrow.. Commissioner Sedivy and Commissioner Langohr,
those voting No, none.
Authorization to Call for Bids:
ater Main.
The City Manager reported that he and the City Engineer had negotiated with
the County Commissioners as authorized for the establishment of a joint City-County
project to install a water main on Durston Road to serve the Gallatin County Rest
Home and tha t an agreemen t, to be presented in writing at a later date, had been
worked out for an equal sharing of the cost of the water main. The City Manager
aocordingly reques ted au thori ty to purchase cast iron pipe an d fi ttings in the
I approximate amount of $4,500.00 for the extension proposed on Durston Road, of a
City water main of adequate size to provide the necessary amount of water required
by the Gallatin County Rest Home with the cost of this material to be divided
equally with the County after the cost of the pipe and fittings to provide the
service connection into the Galla tin County Rest Home is deducted. It was moved
by Commissioner Sedivy, seconded by Commissioner Langobr, that the purchase of
the cast iron pipe and fittings as requested by the City Manager be authorized
and the Clerk of the Commission be directed to issue a "Call for BidS" for the
purchase, and the motion was carried by the fOllOWing Aye and No vote: those
voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; those
voting No, none.
Ordinance No. 849: Repealin~ Ordinance No. 844: Daylight Savi~ Time
The City Manager reported that in accordance with instructions from the
Commission given at its meeting on August 26, 1964, to termina te Da yl18 ht Sa ving
Time in Bozeman, the City Attorney had prepared an Ordinance repealing Ordinance
No. 844. The Manager invited attention to recent elections in which Daylight
I Saving Time had been rejected by the voters in all Montana Cities where the measure
was presented and as a result, the state wide circumstances that now exist are
almost a complete reversal of those that existed when the Commission adopted Day-
light Saving Time in 1964.
Ordinance No. 849 as prepared by the City Attorney, was presented, entitled:

The oonsensus being tha t such action appeared to be in the best interest of
the publio, it was moved by Commissioner Langohr, seoonded by Commissioner Sedivy,
that the ordinance be provisionally passed and presented on April 28, 1965, for
final passage, and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; those I
voting No, none.
Removal of Parkin~ at Federal Buildln~ Site: South Tracy
The City Manager and the Chief of poliee reported that the parking situation
around the Federal Building Site is becoming a serious traffic problem and it would
be to the best public interest and safety if parking on t he west side of Sou th Tracy
between Babcook & Olive Streets be temporarily prohibited, and $t a later date also
prohibited on the north side of East Olive between Traoy and Black Streets and on
the east side of South Black between Baboock & Olive Streets. It was moved by
Commissioner Sedivy, seconded by Commissioner Langohr, that the City Manager to-
gether with the Chief of Police and the Fire Chief be authorized to take such action
in the subject area as they deemed advisable in the interest of p.1blio safety and
to improve traffic conditions and the motion was carried by the following Aye and
No vote: those va ting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner
Langobr; those voting No, none.
Report on Northwestern District Recreation & park Conference: Seattle 28-31 March:

City Recreational Direotor White and Park Superintendent Cloninger reported
on their,attendanoe at the State Park & Recreational Meeting at Seattle, Maroh
28 thru the 31st. Their reports consisted of a complete resume of the program,
its attendance and values derived by the City in having representatives at meetings
of such na ture. Mayor Morrow extended the appreciation of the Commission on the
completeness of the reports. It was moved by Commissioner Langohr, seconded by
Commissioner Sedivy, that the reports of Mr. White and Mr. Cloninger be accepted
and the motion was carried by the following Aye and No v.ote: those voting Aye
being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; those voting No, none.
Authorization to call for Bids for "Chi 3 500.00
The Park Superintendent informed the Commission that his department has need
for a machine known as a "Chipper" for the disposal of tree trimmings in order to
make the City tree trimming operation more economical and efficient. The City
Manager ooncurred wi th t he Park Superintendent and requested authori ty to purohase
a "Chipper" maohine for the City at an estimated cost of $3,500.00 with payment to
be made from the Park, Cemetery and street funds. In concurrence wi th the re- I
commendation of the City Manager, it was moved by Commissioner Langobr, seconded
by Commissioner Sedivy, that the purchase of the "Chipper" be authorized am the
Clerk of the Commission be directed to issue a "Call for Bids" for the purchase
and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; those voting No, none.
Mobile Home Court - 1114 W. Babcock - M. L. Eldridge
Mr. & Mrs. M. L. E~drldge of 1114 W. Babcock appeared to present a requ~st

for connections to the City Water and sanitary sewer to permit installation of four
mobile homes on t heir property a t the t address. Following a discussion of the request
during which the Commission was informed that the Eldridge property is outside of
the City lim! ts and in an area proposed as Zone "A" Residential by the Ci ty-County
Planning Board, the City Manager recommended the request be denied in the public
I in teres t. The ma tter was tabled to permi t examine tion and fur ther study and will
be brought in for further consideration at the next regular meeting of the Comm-
ission on Wednesday, April 21, 1965.
Examination of Depository Bonds:
\ In compliance with the provisions of Section 16-2618, R.C.M. 1947, the City
Commission proceeded to examine the receipts for Depository Bonds and Securities
held by the Director of Finance as security for City funds deposited in Bozeman
banks. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that
the securi ties be approved and a list thereof be set for th in full in the minu tes
of this meeting and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; those
voting No, none.

The U1ty Manager reported a claim was received, too late for consideration last
week, from the Chicago, Milwaukee, St. Paul & Pacific Railroad for its cost of raising
its track at its crossing of South Willson Avenue as a part of the approved cost
of Special Improvement District No. 428. Claim No's. 1185 and 1186 were presented I
on the various funds as follows:

The City Manager commented on the claims and stated he had audited them and
found them to be true and lawful claims against the City of Bozeman and recommended
that they be approved and the D:trector of Finance directed to issue warrants in pay-
ment. After examination of the claims in detail and checking against the olaim
register, it was moved by Commissioner Langohr, seconded by Commissioner Sedivy,
that the olaims be approved as presented and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Sedivy and
Commissioner Langohr; those voting No, none.
Storm Dralna~e Easement.. tangohr: (S.I.D. No. 455)
A right of way Agreement providing right-of-way for the storm sewer line
across the Langohr property oontemplated as a part of Special Improvement District
No. 449 was presented and upon recommendation of the City Manager, it was moved

Authorization to attend Montana State Library Association Convention'" Anaoonda
30 April & 1 May, 1965 (Miss Hileman.)
It was reported that the State Library Association has scheduled a Convention
to be held in Anaconda, 30 April and 1 May, 1965, and the City Manager recommended
that Miss Margaret Hileman, City Librarian, be au thorized to a ttend the Convention
an~ it being in the public interest, her expenses be paid from the Library funds.
It was moved by Commissioner Langobr, seconded by Commissioner Sedivy, tha t Miss
Hileman's travel be approved as recommended and the motion was carried by the
following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner

It was reported that the Direotor of Finance had requested authority to invest
funds in the following amounts in Certificates of Deposit:
$134,000.00 for Approximately 90 days.
150,000.00 for Approxtmately 30 days.
It being in the public interest, the ~ity Manager concurred with the request
of the Director of Finance and recommended authority to re-invest the above funds.
It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, tha t the
reinvestment as requested be authorized and the motion was carried by the following
Aye and No vote; those vottng Aye being Mayor Morrow, Commissioner Sedivy and

Annexation Stevens Subdivision & part Homesites Subdivision - North 17th
Consideration of a petition addressed to the City Commission, signed by
property owners of the Homesite Addition Subdivisions, exclusive of thos parts
of the Homes i te Add tion already within the C1 ty, and Stevens Subdi visi on requesting
annexation of that area to the City of Bozeman was presented for further consideration.
The City Manager reoommended that the request be approved and that the City Attorney
I be instructed to asoertain distriot boundaries and the City Attorney be directed
to preapre the documents neoessary to accomplish the annexation. It was moved by
Commissioner Sedivy, seconded by Commissi oneT Langohr, that the foregoing action
as recommended by the City Manager be approved and initiated. The motion was
carried by the following Aye and No vote; those voting Aye being Mayor Morrow,
Commissioner Sedivy and Commissioner Langohr; those 'YotingNo, none.
Request for vacatin~ of a portion of East College Street - Michael J. Schaer.
A letter from Mr. & Mrs. Michael J. Schaer requesting the vacation of a
portion of land located in the Spring Dell Addition, Block 1; lots 1, 2, 3 and 4
was presented. After discussing the request, which was interpreted as a request
for the City to vacate that portion of East College Street, east of South Black
Avenue, the City Manager informed the Commission that in view of the possible
need for the College Street in the not too distant future, he recommended the
request be denied in the public interest. It was moved by Commissioner Langohr,
seconded by Commissioner Sedivy, that the request be denied and the motion was

A petition to create Q Special Improvemtn District for the construction of
a sewer line to serve an area in B10c~Durston's Second Addition to Bozeman,
Montana, signed by G. M. Beatty, owner of Lot NOfS. 3, 4, and 5; Martha Bolles
Palffy, owner of Lot No's 10 through 18 all of block one, was preaented to the

City Commission. Following a discussion of the proposed area, it was moved by
Commissioner Sedivy, seconded by Commissioner Langohr, that the petition be
jabIed for further study and the motion was carried by the following Aye and
no vote: those voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner
Langohr; those voting No, none. I
Licenses Bonds: Chaney Plumbin~ qompany - Livingston (8) .Plumber; (b) Gas Fitter
In compliance with Chapter 16 of the Bozeman Municipal Code, the plumbing
and gas fitter license bonds of Chaney Plumbing Company, Livingston was presented.
The City Manager stated the Building Inspector had recommended the approval of the
bonds, and they had been approved as to form by the City Attorney. It was moved
by Commissioner LangohI', seconded by Commissioner Sedivy, that the aforementioned
bonds be approved and the motion was carried by the following Aye and No vote;

In compliance with Chapter 16 of the Bozeman Municipal Code, the Plumbing
and Gas Fitter license bonds of Al Dyksterhouse, Manha~i;an was presented. The
City Manager stated the Building Inspector had rec4mmended the approval of the
bonds, and they had been approved as to form by the City Attorney. It was moved
