HomeMy WebLinkAbout1964-09-02 I 1- I 5 Bozemanl Montana September 2, 1964 The Commission of The City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, September 21 1964 at 1:00 o'clock p.m. Present were Mayor Morrow, Commissioner SediVYI Commissioner Langohr, City Manager Cuttingl Ass't. City Manager Fryslie, City Attorney Berg and the Clerk. Commissioner Sedivy opened the meeting with a prayer and the following proceedings were had: Minutes of the last regular session were read and it was moved by Commissioner Langohr, seconded by Mayor Morrow, that the minutes as read be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrowl Commissioner Sedivy and Commissioner Langohr; those voting No, none. ~.1:.':2.estrial?- Safety Citation ,!';?!-E~?. -- ~~~~tion of Pla.:g~~_,_ Dean Chaffin representing the American Automobile Association and the Montana Safety Council appeared to present a plaque to the City as the Association's award of a Pedestrian Safety Citation for 1963, commemorating the City's eight-year record of not experiencing a pedestrain fatality in traffic during eight out of the past ten-year period. Mr. Chaffin complimented the City and Police Department for an excellent safety record and it was moved by Commissioner Sedivy~ seconded by Comndssioner Langohrl that the City express its appreoiation of having reoeived the award. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrowl Commissioner Sedivy and Commissioner Langohr; those voting NOI none. Final Consideration SID No. 424 fa.: v ing ..,.,.....,-.JJ::..oEi!l....C ol?-.S.:tE~_?!2?~_C.o!J The City Manager referred the Commission to its action of August 12thl 19641 regarding its approval and acceptance of the work completed by Long Construction Co. under its contraot for paving in Speoial Improvement District No. 424 and approval of final payment to the contractor subject to a determination of what penalty is to be charged the contractor for over-run of the contract time limit for completion of the project. After a resume of the history of the oontract work had been given by the City Manager, and after discussion between City officials and Mr. James Feltl Vice-president and Attorney for Long Construction Company of the factors responsible for the over-run and with the concurrence of the City Manager~ it was moved by Commissioner Langohr, seconded by Commissioner SediVYI that with allowances for adverse weather and final clean up period the net over-run be considered as thirty-three days and that Long Construction Company be assessed a penalty of 33 days at $120.00 per day, or a total amount of $31960.00 for excess engineeringl and that the liquidated damage clause of th~ contract be waived. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner 1angohr and Commissioner Sedivy; those voting NOI none. Mr. Felt stated that as the official representative of the Long Construction Company, he rejected this settlement offered by the City and demanded that the disputed question be submitted to arbitration as provided in the provisions of Section 3.63 of the Contract for for the construction of the District and in conformity with the written demand for arbitration previously filed by Long Construction Company. Continuation Certificate George N?!~!:_,.-J~ Fitters_..BoE2-1 The Continuation certificate for the renewal of the gas fitters license bond of George Norman I Belgrade, Montana~ was presented. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that .1 the certificate be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Langohr and Commissioner Sedivy; those voting No, none. SID No. 442 JE!:~};~~li.2.~~_?~~_~~pl~...2-'_~~..::_, A~~_~~1_o!.:, This was the time and place set in Commission Resolution No. 1129 to hear protests to \ the creation of Special Improvement District No. 442, for the drainage and paving of various streets in Hoey's Maple Terrace Addition. The affidavit of publioation of Notice was presented together with the Clerk's Mailing Certifioate stating that all known property owners had been notified as required by law. No written protests were on file and no one appeared to verbally protest the proposed work or the creation or extent of the district. Commission Resolution no. 1131, entitled: COMMISSION RESOLUTION NO. 1131 A RESOLUT ION OF THE CITY COMMISS ION OF TBE CITY OF BOZEMAN CREAT]]iTG A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 442 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLllW A PAVEMENT PROJECT ON THE ENT IRE LENGTH OF BLACKMORE PLACE AND TERRACE AVENUE IN MAPLE TERRACE SUBDIVISION TO THE CITY OF BOZEMAN, BEING A REARRANGEMENT OF TRACTS 1, 21 3, 4, 91 11 and 13 OF HOMESITES SUBDIVISION I prepared by the City Attorney was presented. In concurrence with the reoommendation of the City Manager, it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that Commission Resolution no. 1131 be passed and adopted and that Harold Hoskins and Associates be authorized to firnish the engineering services for the district. After examination of the claims in detail and checking against the claim registerl it was moved by Commissioner SediVYI seconded by Commissioner Langohr, that all claims as presented be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Langohr and Commissioner Sedivy; those voting No~ none. Adjournmen~, There being no further business to come before the Commission at this time it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the meeting adjourn.
