RELEASE OF BUILDING PERMIT RESTRICTIONS
WHEREAS, the CITY OF BOZEMAN, a Municipal Corporation of the State of
Montana, hereinafter called the "City" entered into an Improvements Agreement for the
West Winds PUD Phase 4 Subdivision being filed as Document No. 2311613; and
WHEREAS, the City filed a Notice of Building Permit Restrictions on said
subdivision, with said document being filed on September 30, 2008, as Document No.
2211662; and
WHEREAS, the CITY OF BOZEMAN, a Municipal Corporation of the State of
Montana, hereinafter called the "City" entered into an Improvements Agreement for the
West Winds PUD Phase 5 Subdivision being filed as Document No. 2316129; and
WHEREAS, the City filed a Notice of Building Permit Restrictions on said
subdivision, with said document being filed on December 1, 2008, as Document No.
2316304; and
WHEREAS, additional improvements agreements have been recorded at various 1
times as Document Nos. 2316129, 2311613, and 2438409 to renew assurance of
construction of requirement improvements; and
WHEREAS,certain improvements have been constructed and a new improvements
agreement has been accepted by the City for remaining improvements which explicitly
replaced all prior improvement agreements and which new improvements agreement does
not restrict issuance of building permits;
THEREFORE, the City hereby certifies that the Building Permit Restrictions
established in Document Nos. 2211662 and 2316304 have been satisfied regarding the
issuance of building permits for Lot 1, Block 4, West Winds Subdivision Phase 4 and Lot
1,Block 3,West Winds Subdivision Phase 5 and as such the restriction on building permits
are released.
