Present were Mayor Morrow, Commissioner S,edivYI Commissioner Langohr, City Manager Cutting, Assistant City Manager Frysliel City Attorney Berg and the Clerk. Commissioner Langohr opened the meeting witn a prayer and the following proceedings were had: Minutes of the last regular session held 3U September 1964 were read and it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the minutes as read be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrowl Commissioner Langohr and Commissioner Sedivy; those voting No, none. Plans & Specifications: SID No. 441 No. 11th Ave. Paving Plans and speCifications as prepared by Harold Hoskins and ASsuciates were presented for Special Imvrovement District No. 441, paving on Nortn 11th Avenue. It was moved by Commissioner Langohr, seconded by Commissioner 3edivYI that the pltlns and speci1'ictltions for Special Improvement District No. 441 be approved as presented and tne motion was carried by tne fOl.LOwing Aye and No vote: tnose voting Aye being Mayor Morrow, Commissioner Langohr and Commissioner Sedivy; those voting No, none. Improvement of South 11th Avenue Following a diScussion of tne possibility of opening and improving South 11th Avenue from the vicinity of Curtiss Street to Main Street, It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the Manager and Assistant Manager be directed to carefully invest1gate all possibilities for the opening and improvement of the aforementioned section or Soutn 11th Avenue and the motion was carried by the folloWing Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Sedivy and Comr;1is sioner Langohr; tnose voting No, none. Plans and Specifj, ca tions : SID No. 442 Maple Terrace Paving Plans and specifications as prepared by Harold Hoskins and Associates were presented for Special Improvement District No. 4421 paving in the Maple Terrace Subdivision. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that plans and specifications for SpeCial Improvement Dis tric t No. 442 as pre sen ted be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; those voting No, none. Report of the International Conference of Building Officials Building Inspector Dona.ld Barrick made a full report of the International Conference of Building Officials a ttended by him in Glacier Na tiona.l Park on September 6-lU. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that Mr. Barrick's report be avp roved and he be commended for its installing necessary storm sewers and appurtenances where necessary, installing intregal concrete curb and gutters, and ins talla tion of' asphal tic-concrete paving on a portion of South Tracy Avenue beginning 249.7 feet South of Cleveland, and continuing to GarfieLd Street, also that portion of West Garfield Street between South Tracy Avenue and South Willson Avenue, signed by eight residents of the proposed district, was presented with an attachment signed by six other residents of the proposed districtl which informed the Oommission that tXley would protest the creation of the district unless I 24 excellence and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Langohr and Commissioner Sedivy, those voting NOI none. Petition for The Creation of a Special Improvement District A petition to create a special improvement district for the purVose of satisfactory arrangements be made for that portion of the proposed district not within the City Limits to bear a proportionate share of the cost of the Improvements. Upon recommendation of the City Manager, it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the City Attorney be instructed to prepare a resolution of intention to create the requested district, based upon information to be given to him by the City Engineer, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Resolution No. 1141 Authoriz:n~ Sale of General Obligation Bonds for $475.000.00 I Morrow and Commissioner Sedivy and Commissioner Langohrj those voting No, none. The City Manager presented a Proposed resolution preVared by the City Attorney for the purpose of setting the time and place for sale of Municipal Building Bonds in the amount of $475,000.00 Commissioner Sedivy moved its adoption: RESOLUTION NO. 1141 RESOLUTION SETTING TIME AND PLACE FOR SALE OF MUNICIPAL BUILDING BOUNDS IN THE AMOUNT OF ~p4'151000.00 BE I'l' RESOLVED BY THE CITY COMMISSION OF TIill CITY OF BOZEMAN I MON'l'ANA AS FOLLOWS: Section 1. Whereupon said resolution was declared duly passed by a majority of the Whole number of members of the Commission, and the Mayor being present affixed his signature thereto in approval thereof and the Clerk of the City Commission attested his signature thereto. Resolution No. 1142 Amending Reso lu tion No. 1127 The C1 ty Manager presented a proposed resolution prepared by the City Attorney for the purpose of amending Commission Resolution No. 1127, passed and adopted by the City Commission during a regular session held on July 1, 1964. Commissioner Langohr moved its adoption: RESOLUTION NO. 1.L42 A RESOLUTION OF THE COMlHSSION OF THE CITY OF BOZEMANI MONTANA AMENDING RESOLUTION NUMBER 1121/ OF THE COMMISSION OF 'rIlE CITY OF BvZEMAN, MONTANA, WHICH PROVIDES FOR THE REDEMPTION OF MUNICIPAL BONDS FRUM AND AFTER FIVE YEARS INSTEAD OF FROM AND AFTER TEN YEARS FROM TIffi DATE OF ISSUE. ,WHEREAS, the City Commission of tne City of Bozemanl Montana, did on the 1st day of July~ 1964, pass and adopt Resolution No. 112'/ providing for the issuance of qp4'15,UUO.00 municipal building bonds in accordance wi th the authority conferred by tne voters of the City of Bozeman at a special e~ection he~d on June 21 1964; andl WHEREAS, it has come to the attention of the City Commission that under and pursuant to Section 11-23041 R.C.M. 1947, that municipal bonds issued for a longer term than five (5) years may be redeemed at the option of the city or town five (5) years from the date of issue on any interest paymen~ da te thereafter. Electrical License Bond New Bond Compliance of Chapter 15 The Electrical License Bond of Shelby Appliances owned by l\~r. and Mrs. Paul Elting was presented. The bond was approved by the Building Inspector and the City Attorney had approved the bond as to form. It was moved by Commissioner Sedi vy, seconded by Commissioner Langohr, tha t the elec trical license bond of Shelby Appliance by approved and ttle motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Langohr and CommiSSioner Sedivy; those voting No, none. Authority to Invest $21000.00 Park Trus t Fund It was reported that $2,uUO.uU of tne Park 'Trust Fund are available for investment and the City Manager recommended that the Director of Finance be authorized to invest these funds in U. S. Govern~ent securitios due August 15, 1972 It was moved by Commiss ioner Langohr J seconded by Commissioner Sedivy, tha t the inves tmen t of the Park Trust Funds be authorized as recommended and the motion was carried by Morrow, Commissioner the fOllOWing Aye and No vote: those voting Aye being Mayor Langohr and Commissioner Sediyy; those voting No, none. following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; those voting No, none. I 26 Authority to Purchase Ford Tractor Loader $)950.00 Street Department It was reported that the Street Department has need for a front end loader for its Ford Tractor and being a budget item the Manager requested authority to purchase the loader at an approximate cost of $950.UO. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the purchase be authorized as recommended and the motion was carried I by the following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; tnose voting No, none. Historic Con~ittee to Survey Present City Hall A discussion W~8 held of the demolition of the existing City Hall upon completion of the porposed new municipal building facility and ttle desirability of preserving any part of the structure that may be of sufficient historic value. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that Mayor Morrow appoint a committee with Dr. M. G. Burlingame as Chairman to survey the present City Hall and Opera House and make recommendations to the City Commission of those parts of the building having historic value that should be preserved in the public interest and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; those voting NOI none. Commissioner Sedivy Designated to attend Music Conference - Washingtonl D.C. It was reported tha t Commissioner Sedivy had been des igna ted to represent Montana at the National Conference on the use of Educational Media in the I Teaching of Music as a delegate from the Montana Music Educators' Association, made possible by a grant from the National Office of Education, the conference to be held in Washington, D. C. from 7 December to 11 December, 1964. It was moved by Mayor Morrow, seconded by Connnissioner Langohr, that Commissioner Sedivy be congratulated for the distinction of his selection and the motion was carried by the following Aye and No vote: those voting Aye h:';ing Mayor Morrow, Commissioner Sedivy, and Commissioner Langohr; those voting NO, none. D . 440 S.I.D. 439 Total The City Manager commented on the claims and stated he had audited them and found them to be true and lawful claims against the Ci ty of Bozeman and recommended that they be approved and the Director of Finance directed to issue warrants in payment. After examination af the Claims in detail and checking against the Claim register, it was moved by Commissioner Langahr, seconded by Commissioner SedivYI that all claims as presented be approved and the motion WetS carried by tne following Aye and No vote: tnose voting Aye being Mayor Morrow, Commissloner Sedivy and Commissioner Langohr; those voting No, none. Report of Breakfast served by Fire Department A report of tne success of the breakfast served by the Fire Department to openF'ire erevention Week on October 5th was made by Fire Chief Huber.
