Present were Mayor Morrowl Commissioner Sedivy, Commissioner Langohr, City Manager Cutting, City Attorney Berg and the Acting Clerk. I.... .. Mayor Morrow opened the meeting with a prayer and the following prooeedings were hadt Minutes of the last regular session were read and it was moved by Commissioner Langohrl seconded by Commissioner Sedivy that the minutes be approved as read and the motion was carried by the fol... lowing Aye and No vote~ Voting Aye Mayor Morrowl Commissioner Sedivy and Commissioner Langohr, voting No: None Minutes of the special session held 29 Ootober 1964 were read and it was moved by Commissioner Sedivy, seconded by Mayor Morrow that the minutes be approved as read and the motion was carried by the following Aye and No vote: Voting Aye, Mayor Morrow. Commissioner Sedivy and Commissioner Langohr voting No; None. Resolution No. 1152 ... Levying Assessment in S.I.D. 432 - Continue Hearing. This was the time and place set for hearing protests to levying assessment for Special Improve... ment District No. 432. Affidavit of publication of Notice was presented. The City Manager informed the City Commission that a protest to the assessment had been received from Montana State College and requested that the hearing on Resolution No. 1152 be continued. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy that the hearing on Resolution No. 1152 levying assessment in S.I.D. No. 432 be continued and the motion was carried by the following Aye and No vote: Voting I Aye I Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; voting No: None. Resolution No. 1153 - Levying Assessment in S.I.D. 439 - Final Adoption. This was the time and place set for hearing protests to levying assessment for Special I~ provement District No. 439. Affidavit of publication of Notice was presented. No one was present to protest and no protests having been filed, Resolution No. 1153 provisionally passed and adop..ted at the regular meeting held 28 Ootober 1964, was presented for final passage. In conourrence with the recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the resolution be finally passed and adopted and the motion was carried by the fol- lowin,g Aye and No vote: Voting Aye, Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; voting No: None. S. I. D. 439 (Sanitary Sewer N. 18th Ave.) Aoceptance of Contract and Final Payment to Contractor. A certificate from Harold Hoskins and Associatesl Consulting Engineersl stating that construc- tion of sanitary sewer lines within Special Improvement District No. 439, had been completed in accordance with the plans and specifications of the contract by utility Builders# Inc.1 of Great Fallsl Montana, and reoommending that the City accept and approve the project as completed was presented. The City Manager and City Engineer concurred in the recommendation of the consultant I engineerl and the Manager informed the Commission that the determination had been made that all valid claims against the contractor resulting from the construction have been paid. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy that in concurrence with the foregoing recommendations the contract work in Special Improvement District No. 439, be approved-and aocepted as completed and final payment be made to the oontractor upon presentation of a final. estimate and claim in proper order and the motion was carried by the following Aye and No vote:-voting Aye, ""I" ' "I. I .. Mayor Morrow, Commissioner Sedivy and Commissioner LangohrJ; voting No; None. S. I. D. 440 (IVater l~ins North 11th Ave.) Acceptance of Contract and Final Payment to Contractor. A certificate from Harold Hoskins and Associates, Consulting Engineers, stating that construc- tion of water mains within Special Improvement District No. 4401 had been completed in acoordance with the plans and specifications of the contraot by Utility Buildersl Ind. of Great Falls, Montana, and recommending that the City accept and approve the projeot as completed was presented. The City Manager and Ci~ Engineer concured in the recommendation of the consultant engineer, and the Manager informed the Commission that a determination had been made that all valid claims against the con- tractor resulting from the construction have been paid. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr that in concurrence with the foregoing recommendations, the con- tract work in Special Improvement Distriot No. 440 be approved and accepted as completed and final payment be made to the contractor upon presentation of a final estimate and claim in proper order and the motion was carried by the following Aye and No vote: Voting Ayel Mayor Morrowl Commissioner Sedivy and Commissioner Langohr; voting No; None. Cancellation of Surety Bond: C. K. Wilson; as of 12 October 1964. The surety bond of C. K. Wilson deceased Clerk of the City Commissionl was presented and upon reCommendation of the City Manager it was moved by Commissioner Langohrl seconded by Commissioner Sedivy that the bond be cancelled effective 12 October 1964 and the motion was carried by the fol- lowing Aye and No vote: Voting Aye, Mayor Morrow, Commissioner Sedivy and Commissioner LangohrJ; voting No; None. Consideration of Bids: Municipal Building Facility. The City Manager recommended that further consideration of bids for the construction of the New Municipal Building Facility be continued for one week to allow additional study and it was moved by Commissioner Sedivy, seconded by Commissioner Langohr that consideration of the bids be con- tinued for one week and the motion was carried by the following Aye and No vote: Voting Aye, Mory Morrowl Commissioner Sedivy and Commissioner Langohr; voting No; None. Appointment of Clerk of the City Commission: Bill R. Johnston. Mayor Morrow stated that the Conuniss ion had taken applications for the postion of Clerk of the City Commission under consideration and it was moved by Commjssioner Langohr, seconded by Com- missioner Sedivy that Mr. Bill R. Johnston be appointed to the position of Clerk of the City Com- mission effeotive 16 November 1964 and upon execution of the oath of office and furnishing a surety bond in the amount of $151000.00 and the motion was carried by the following Aye and No vote: Voting Aye, Mayor MQrrowl Commissioner Sedivy and Commissioner Langohr; voting No: None. Retirement of H. Dean Moore: Effective 31 December 1964. (Employed 1 Au[,ust 1953) A letter addressed to the City Manager from H. Dean Moore, Water Collector and Cashier, re- questing that he be relieved of his duties effeotive 31 December 1964 due to age and declining health was read. The City Manager stated that it was with deep regret that he found it necessary to accept the resignation of Mr. Moore and expressed the desire that more fitting recognition of the superior service to the City of Bozeman by Mr. Moore be made at a later date. It was moved by Commissioner Sedivy, seconded by Commissioner langohr that the Conunission concur in the comment of the City Manager and express the appreciation of the Commission to Mr. Moore for his supreme dil- igence in performing the duties of a difficult position and that Mr. Moore be informed that his- fine efforts have been continuously noted by the City Comndssion and the motion was carried by 49 50 the following Aye and No vote: Voting Ayel Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; voting No; None. Request for Sidewalks Against Curbs: North 20th Avenue. The City Manager referred the Commission to an earlier request from Western General Ente~ prises, Inc. to construct sidewalks against the curbs in North 20th Avenue and stated that sub- sequently a similar request having been received from two property owners on North 20th Avenue, the matter had again been given study and he recommended that the request be denied. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the request to construct sidewalks against the curbs in North 20th Avenue be denied and the motion was carried by the fol- lowing Aye and No vote: Voting Aye, Mayor Morrowl Commissioner Sedivy and Commissioner Langohr; voting No; None. Authorization to Attend state Association of Planninc Boards Meeting: Helena - 6 November 1964. Authority to attend a reorginization meeting of the State Association of Planning Boards in Helena, 6 November 1964, was requested by the President, Seoretary and four members of the Boze:rna.:n City-County Planning Board. Upon recommendation of the City Manager it was moved by Commissioner Sedivy, seconded by Corrnnissioner Langohr that the authority be granted as requested and the ex- pense be paid from the Planning Fund and the motion was carried by the following Aye and No vote: Voting Aye, Mayor Morrow, Corrnnissioner Sedivy and Commissioner Langohr; voting No; None. Claims for October. The following claim No.'s. 11539 to 11796 inclusivel were presented on the various funds as follows I The City Manager commented on the claims and stated he had audited them and found them to be true and lawful claims against the City of Bozeman and recommended that they be approved and the Director of Finance directed to issue warrants in payment. After examination of the claims in detail and checking the claim register, it was moved by Commissioner Langohrl seconded by Commissioner Sedivy that all claims as presented be approved and the motion was carried by the following Aye and No vote: Voting Aye, Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; voting No; None. Adjournment.
