The Commission of the City of Bozeman met in regular seseion in the Commission Room,
City Hall Buildingl ThursdaYI 12 November 1964, at 1:00 o'clock P.M.
Present were Mayor
Morrow, Commissioner Sedivy, Commissioner Langohr, City Manager Cutting, Assistant City
Attorney Angel, and the Acting Clerk.
Commissioner Sedivy opened the meeting with a prayer and the following proceedings
were had:
Minutes of the last regular session were read and it was moved by Commissioner Sedivy,
seconded by Commissioner Langohr that the minutes be approved as read and the motion was
carried by the following Aye and No vote, those voting Aye being Commissioners Langohr,
and Sedivy, and Mayor Morrow, those voting No, none.
Minutes of the special session held 10 November 1964, were read and it was moved by
Commissioner Langohr, seconded by Commissioner Sedivy that the minutes be approved as read
and the motion was carried by the following Aye and No vote, those voting Aye being Mayor
Morrow, Commissioners Langohr and Sedivy, those voting No, none.
Resolution No. 1152, . Levying Assessment in S.I.D. 432 - Final Adoption.
The Commission was referred to action at the last regular session continuing the hearing
on Resolution No. 1152, levying assessment for Special Improvement District No. 432. The
City Manager stated that the error in the assessment roll had been resolved, and that Montana
State College officials have been informed that an appropriate adjustment will be made in
all aseessments for subsequent years after final Federal audit has been made and the Walton
right-of-way condemnation case has been resolved. Since the assessments for 1964 are based
on estimated amounts, the City Manager recommended that Resolution No. 1152 be finally passed
andadbpted and it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that
the resolution be finally passed and adopted and the motion was carried by the following
Aye and No vote, those voting Aye being Mayor Morrow, Commissioners Sedivy and Langohr, those
voting No, none.
Consideration of Bids: Municipal Building Facility (Opened 29 October 1964).
Assistant City Attorney Angel advised the Commission that he and City Attorney Berg had
made a determination that it would not be legal to award a contract for the Municipal Build-

ing Facility on any of the bids received 29 October 1964 since the aggregate low bids exceed
the authorized bond issue and that it would not be legally adviseable to make an award for
construction of only a portion of the total progect. On the basis of the legal advise given
and upon recommendation of the City Manager it was moved by Commissioner Langohr, seconded
by Commissioner Sedivy that all bids received 29 October 1964 for the construction of the
Municipal Building Facility be rejected and the motion was carried by the following Aye and
No vote, those vote Aye being Mayor Morrowl Commissioners SediVYI and Langohr, those voting
No, none.

Municipal Building Facility.
Following a lengthy discussion of all circumstances surrounding the Municipal Building
Facility Program the City Manager informed the Commission that in order to bring the program down
to an estimated cost within the amount of the authorized bond issue the following major alternatives
may be first considered: 1) reduce the total floor area of the proposed unites by removing the
second floor of the administration unit, making provision for addition of this floor at a later
date and putting the combined Commission-Court Room in the basement at this time; 2) remove the
fourth lane in the fire equipment room and make an equivalent reduction in the size of the second
floor of the Police-Fire Unit which would eliminate the space for housing an ambulance or a rural
fire fighting unit as had been contemplated; 3) re-examine the need for the fire tower which,
if eliminated, would create a need for mechanical hose drying equipment and preclude this City
being elegible for hosting a proposed Montana State Fire Academy; 40 re-examine the area in the
basement of the Police-Fire Unit proposed as space for future juvenile jail cells. After discussion
it was moved by Commissioner Langohr, seconded by Commissioner Sedivy that the City Commission
instruct the City Manager and Architects to proceed with redesign of the Municipal Building Fac-
ility along the general lines previously mentioned with the objective of bringing the estimated
cost within the authorized bond issue amount and present new plans to the Commission at the earli-
est possible date and the motion was carried by the following Aye and No vote; Voting Aye, Mayor
Morrow and Commissioner Langohr; voting No; Commissioner Sedivy.
Stockholders Meeting- Meddle Creek Water Users Association - 16 November 1964
~otice having been recieved of the annual meeting of the Middle Creek Water Users
Association to be held in the Community Room of the Court House at 2:00 P.M., Monday, 16 November
19641 and upon recommendation of the City Manager it was moved by Commissioner Sedivy, seconded
by Commissioner Langohr, that Harold A. Fryslie be designated as the City representative at this
meeting and appropriate proxy be provided and the motion was carried by the following Aye and
No vote, those voting Aye being Mayor Morrow, and Commissioners Sedivy and Langohr, those voting
No, none.
Authority to Purchase Police Uniforms - Approximately $825.00
The City Manager informed the Commission that a need for new Police Uniforms existed
and requested authority to make the purchase in an approximate amount of $825.00 as provided for
in the current budget and it was moved by Commissioner Langohr, seconded by Commissioner Sedivy
that the purchase be authorized as requested and the motion was carried by the following Aye and
No vote, those voting Aye being Mayor Morrow, and Commissioners Sedivy and Langohr, those voting
No, none.
Appointment of Water Collector and Cashier - John M. Evans.
The City Manager announced his appointment of John M. Evans as Water Collector and Cashier
effective 23 November 1964 to replace retiring H.Dean Moore. He stated that Mr. Evans had worked
under his supervision from 1 May to 30 June 1962 as an administrative assistant and was especially
qualified for this appointment. It was moved by Commissioner Sedivy, seconded by Commissioner
Langohr that the appointment be approved and the motion was carried by the following Aye and No
votel those voting Aye being Mayor Morrow, and Commissioners Sedivy and Langohr, those voting
No, none.

Reports for October.
The following reports were presented:

The City Manager commented on the reports and recommended their approval. It was
moved by Commissioner SediVYI seconded by Commissioner Langohr, that the reports be approved
and ordered filed and the motion was carried by the following Aye and No vote, those voting
Aye being Mayor Morrowl Commissioners Sedivy and Langohr, those voting No, none.
Claims for October (continued).
The following claims No. 11797 to 11833 inclusive, were presented on the various
funds as follows:

The City Manager commented on the claims and stated he had audited them and found
them to be true and lawful claims against the City of Bozeman and recommended that they be
approved and the Birector of Finance be directed to issue warrants in payment. After exam-
ination of the claims in detail and checking the claim register, it was moved by Commissioner
Langohr, seconded by COmmissioner Sedivy that all claims as presented be approved and the motion
was carried by the following Aye and No vote, those voting Aye being Mayor Morrow, Commissioners
Langohr and Sedivy, those voting NOI none.
Adjournment.
There being no furhter business to come before the Commission at this time it was
, moved by Commissioner Sedivy, seconded by Commissioner Langohr that the meeting be adjourned and
the motion was carried by the following Aye and No vote, those voting Aye being Mayor Morrow
