M. Present were Mayor Morrow, Commissioner SedivYI Commissioner Langohr, City Manager Cuttingl ABs't City Manager Fryslie, City Attorney Berg and the Clerk. Commissioner Sedivy opened the meeting with a prayer and the fallowing proceedings were had: Minutes of the last regular session held December 16, 1964, were read and it was moved by Commissioner Langohr, seconded by Mayor Morrow that the minutes be approved as read and the motion was carried by the fOllowing Aye and No vote: Voting Ayel Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; those voting No, none. Public Hearing -- Special Improvement District No. 443 This was tne time and place set by Commiss1on Resolut1on No. 1157 to hear protests, if anYI to ~he creation of Special Improvement District No. 443. Affidavit of publication of Notice and the Clerk's Mailing Certificate stating that all. property owners had been notified as required by law were presented. The City Manager informed the vommission that as of 5:vv o'clock P.M., December 221 1964, the written protests to the creation of the District constituted a total. of 35.52% on a front foot basis of tne property inCluded within the boundaries of the district and to oomply with Section 11-22u6, R.C.M.I 1947. City Attorney Berg recommended that the Resolution No. llb? be tabled at the present time for consideration and further study. It was moved by Commissioner SedivYI seconded by Commissioner Langohr, that the resolution be tabled for further study and the motion was carried by the following Aye and No vote: Voting Aye, Mayor Mor.row, Commissioner Sedivy and Commissioner Langohr; voting No, none. Public Hearing -- Special Impro"ement District No. 444 This was the time and place set by Commission Resolution No. Ilb8 to hear protestsl if any, to the creat1:m of Special Improvement District No. 444. Affidavit of publication of Notice and the Clerk's Mailing Certificate stating that all property owners had been noti fied as required by law were presented. In concurrence with the recommendation of The City Manager, it was moved by Commissioner Langohr, seoonded by Commissioner ~edlvy, that tne Commission Resolution No. 1158 be withdrawn from the agenda for correction. The City Manager reconnnended that the City Attorney instructed to prepare a resolution to create the district. In concurrence with the recommend- ation of The City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that Commission Resolution No. 1168 be passed and adopted to create Special Improvement District No. 446, the motion was carried by the following Aye and No vote; Voting Aye, Mayor Morrow, Commissioner Sedivy and Commissioner Langohr; voting NOI none. Public HearIng -- Special Improvement DiB trict No. 447 This was the t~e and place set by Commission Resolution No. 116U to hear protests, if any, to the creation of Special Improvement District No. 447. Following a thorough discussion of the proposed district witn a group of the protestants and other interested citizens attending the meeting, and with tne City Attorney, The City Manager recommended that tile protests flIed be decJ.ared . insufficient and the Ci ty Attorney ins tructed to prepare a resolution to create the District. Following a discussion of the project with property owners involvedl the City Manager reconmended that the ResoLution No. LL61 be tabled at the present time for further study. After discuss ion of the plans and in concurrence wi th the recommenda tion of The City Manager and Mr. Oswald Berg, Jr., it waB moved by- t,;ommissioner Langohr and seconded by Commissioner Sedivy that the C!erk of tne Commission be directed to publish a "Call for Bids" based on the plans as wesented, 'to be opened at a Special. Meeting of the Commissi,n on Thursday, Febroary 4th, 1~65, at 7:30 o'cLock R. M.
