The Commission of the Gityof bozanan met in regular session in the Commission
Room, City Hall Building, Wednesday, 30 December, 1964, at l:uu o'clock P.M.
Present were Mayor Morrow, Commissioner Sedivy, C0mmissioner Langohr, Gity Manager
Cutting, Asa't Gity1V1anager FrysJ.ie, City Attorney Berg 0.00 the Cierk.
Commissioner Langohr opened tne meeting wi th a prayer and the fOiiowing
proceedings were had:

it was moved by Commissioner SedivYI seconded by Commissioner Langohr, that the
minutes be apvroved as read and the motion was carried by the fOilowing Aye and
No vote: Voting Ayel Mayor Morrowl Commissioner Sedivy and Commiss1oner Langohr;
voting No; none.
Considers tion of Bids for 1"lre Dept. Emergency Van
It was reported the t the bids for the Emergenc y VehicJ.e for the Pire Depart-
ment had been studied and the C1 ty Manager am the 1"lre Ohlef recommended award
of the purche se to Bozeman Motors, Inc. for a 1~65 Ford Truck on the basis of
that Company's bid of $2,033.92, It being the lowest ~nd best bid received and
equaling or exceeding tne s lJecifica tions as contained in the "Call for Bids. '"
It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the
award of this purCL.l8.Se be ml:tde to Bozeman Motors, Inc.. as recommended. The
motion was carried by the fo.uowing Ayw and No vote: Voting Aye, Mayor Morrow I
Commissioner Sedivy and Commissioner Langohr; voting No; none.
Public Hearing -- Special Improvement District No. 445
This was the time and place set by Commission Resolution No. 1162 to hear
protests, if anYI to the Creation of Special Improvement .lJistrlct No. 445.

Affidavit of' publication of Notice and the Cierk's Mailing Certificate stating
that a1i property owners had been notified as required by law were presented.
No written protests were on fi.le and no one appeared to verbally protest the
creation of the district.

Acquisition of James & Joan Ray property - Main & Rouse - (Gift & Pay)
The City Manager reminded the Commission that for severaL manths negotiations
witn James C. & Joan L. Ray for a more deslrab.le at te for the City's new Munlcij,Jal
Building Facility have been underway. At it's meeting on Sevtember 3u, 1964, tne
City Commission accepted Mr. Ray's proposition for trading his property diagona.lly
across Main Street, being Lot No's ten (lu) to nineteen (1~) inclusive, BLock ~D
of Rouse's First Addition to the City for its present property on the East end of
.tllock tt'c" of the Original Townsite of Bozeman. The Manager reported that alL pro-
cedural steps to accompLish that land trade were compLeted and presented to Mr. &
Mrs. James C. Rayon December 28, 1964, at whiCh time Mr. Ray made an entirely new
proposition for conveying hisproperty to the City as fo.l.lows:
Mr. & Mrs. Ray WOUld convey their property, appraised at $L63,uuO.uu to the
City by Deed for a caSh payment of tnirty-thousand dol.lars ($30,UOO.OU) with the
balance of the .land vaLue of $133,uuU.UO to be considered as their gift to the
City. The Manager noted that this magnificient gesture has accrued to Tne Oity
due to tne impressive and progress1 ve manner in which this Vi ty Commission has
administered tne City Governme.ut, and thl:tt this contribution ShOULd be t:tppreciated
by all of the Citizens of Bozeman as a particuLarLY sj,J.lendid gesture toward this
community in view of '~he hundreds of other pro.1ects Mr. & Mrs. Ray might otherwise
have seLected for tneir beneVolence.
The Manager further noted tnat the aC4uisition of the F8Y property wou~d
provide a site for the new Munic ipal Buildinl?: 1"aclLl ty C1nd off s tree t parKing far
superior in every res~ect tome existing site and it being positiveLY in the pub.lic
inLerest he strongly recommended that the du.lY executed BaEgain and Sale Deed con-
veying the Ray property to The City as here }Jreseuted, be accepted by the Commission

be authorized from tne City Parking Meter Fund. In concurrence wi~h The City Managers

Authority to Re-Invest Water Funds: ~75,OOO.OO U.S. Treasury Bills - 180 days.
It was reported by the Director of l"inance tha t $'151 uuO.uu Wa tar Funds now in-
vested in U. S. Treasury BiLls will mature on January 7, .19651 and he requested the
authority to reinvest the funds in like securities for a period of 180 days, or six
months. The Vity Manager concurred with the request and it was moved by Commissioner
Langohr, seconded by Commissioner Sedivy, that the investment as requested by the
Director of Finance be approved, and the motion was carried by t he following Aye
and No vote; Voting Aye, Mayo~ Morrow~ Commissioner Sedivy, and Com~issioner
Langohr; voting No, none.

License Bonds -- Geor~e Wellhouser (Plumbing. Gas Fitting. Electrical)
In c ompllance wi tn Cha. pters fifteen a nd sixteen of the Bozeman Municipal Code,
the plumbing, gas fitter and electrical bonds of George Wel~houser, Manhattanl
Man tana, were presented for <:l.pproval. The vi ty Manager reported the t the Bul1din g
Inspector has approved the concern and I' ecommended tha t the bonds be approved.
The City Attorney approved the bonds as to form and it was moved by (;ommlssioner

The City Manager and the Chief of Police stated tney were not aware of any
incidents in the operation of the above establiShments that would warrant dis-
approval of the application. In concurrence with the recommendation of the City
Manager, it was moved by Commissioner Langohrl seconded by Commissioner Sedivy,
tha t the above applica tions be approved and the lJirector of Finance be directed
to issue licenses in accordance therewi th, and the motion was carried by the
following Aye and No vote; Voting Ayel Mayor Morrowl Commissioner Sedivy and
Commissioner Langohrl voting No, none.
Decision of Board of Arbitration - S.I.D. No. 424 - (Paving - Lonp; Const. Co.)
The Uity Manager reported that there had been a proposal made by the Board
of Arbitration on the settlement of the assessment of the overrun of time disputed
by the Long Construction Company. The City Attorney advised the L.:ity Commission
tha t they should make no decision until tne Long Cons truction Company ei the I' accepted
or rejected the offer, therefore, the decision of the board of Arbitration is to be
tabled until a later date.

Director of Finance:
The I./i ty Manager advised the l.iommiaslon the report indica ted the s ta tua of
the budget at the close of the fifth month of the fiscal period to be satisfactory
and recommended that the report be approved and ordered filed. In concurrence
with the City Manager's recommendation, it was moved by Commissioner Sedivy, se-
conded by Commissioner Langohrl that the report of the Director of Finance be
approved and ordered filed and the motion was carried by the following Aye and No
vote; Voting Aye, Mayor Morrowl Commissioner Sedivy and Commissioner Langohr; voting
No, none.
