Eshbaugh - TapRoomBozeman City Commission, As the parent of a three kids at Hawthorne school, I continue to be concerned about the impact of a bar serving beer and wine across the street from my children's school. When the City Commissioners approved the CUP last year, it appears to have been based on a recommendation from the City Planning Office that it fell under the local ordinance exception to state law for a restaurant beer and wine license. However, this was erroneous. The Taproom holds a full beer license with a wine addendum that does not closely restrict its alcohol sales to only a percentage of total revenue (like a restaurant beer & wine does). What was approved was a bar, one that serves alcohol directly and visibly across the street from Hawthorne during school hours, beginning at 11:00 am. As you heard at the December 19 City Commission meeting, this poses a direct public health concern on the students and the community. As such, the Commission has a responsibility to act to further protect the children. I just learned that the Taproom is seeking renewal of the existing beer/wine permit today. The city commissioners should take this time to establish specific conditions for ongoing use of the permit. Suggested modifications to conditional use of existing beer/wine permit: 1. Install screens on rooftop deck to block view 2. No use of on-street (Rouse) outdoor patio during school days and hours (11:00-5:00, Mon-Fri)) 3. Keep all garage doors on Rouse closed during school days/hours (11:00 am – 5:00 pm) 4. No music on roof top deck or outside speakers during school days/hours (11:00 am – 5:30 pm) 5. Alcohol deliveries (kegs) must park and be delivered through front door on Mendenhall (not visible to Hawthorne classrooms) 6. Clean all sidewalks each night and each morning to clear environment of garbage Thank you for your consideration. Cheryl Eshbaugh
